Innocent until proven guilty doesn’t really matter. A company is not the legal system. I guarantee your company will know. We get all the tickets mailed to us. Most won’t wait to see if it gets reduced. If they find you to be a risk, bye bye.
It absolutely matters. Just because they got a ticket doesn’t mean they are guilty. Who mails you the ticket? If you fire someone for a traffic offense they haven’t been convicted of you are opening yourself to a lawsuit along with whoever sends the ticket.
Lol I’m glad you are a legal expert. Where did you go to law school? The state sends the ticket genius. Not some random person. Every inspection also gets sent to the company. You aren’t on this side of things so you don’t really have a clue what you’re talking about. You can spout off all you want about convictions and all that. If a company deems you are a risk, they fire you. There’s not really much you can do about it.
Where did you go to law school? Funny you would bring that up when neither of us are lawyers. Inspections are sent to companies, no doubt. Warnings are written because you cannot fight them as a driver, correct. Speeding you are innocent until proven guilty. That’s why when you sign the ticket they tell you it’s not an admission of guilt, because it’s not. The only ticket that come along with an inspection is a ticket written by a dot officer that also performed an INSPECTION. Even at that it MIGHT sat the reason the driver was pulled over, speeding or following to closely for example, but it does not say the driver is guilty of the infraction.
If a company fired me for an infraction that was found not guilty of commuting in court I would sue them for wrongful termination.
In America we all have legal protections even if some dick in the safety department doesn’t think drivers are worthy of those protections.
It’s funny that you write this wall of text that has this whole triumphant I’m right attitude. But you are still wrong. You really don’t seem to understand employment laws either. Most states a person can be fired for zero reason. You are also completely wrong about the whole citation only coming from the officer who did the inspection. MANY states have separate committees that decide on tickets after the inspection was done even if the officer did not write one. Ohio is an example.
Look I get it you have this tiny little brain. And since your mom watched Matlock as a kid, you think you the legal system. You also have to shout the same thing over and over even though it means joint. None of that matters. Your company can fire you at any point if they deem you are a SAFETY risk. It doesn’t need any conviction. Just like if they had reports from other people about you doing unsafe things.
So, from the “dick” in the safety department……I hope I fire someone like you and you sue for “wrongful termination”. Our lawyers will me laughing the whole way. I’ll be laughing about how your ignorant ass won’t get hired anywhere else because of the reason you were fired.
I’m going to leave this up for a bit and then block you. Got a real ignorant boomer attitude and it’s gross. Later loser, don’t break the law and I won’t fire you.
I got a passing a stopped school bus ticket thrown out , to it to court n the other admitted that he wrongfully pulled me over. But you just gotta fight it n court allot of the time they’ll just dismiss the case
I never showed up for the court. Once in Arizona and once in Florida. Both times a lawyer handled it. However, your attorney will know if you need to be there in person.
I got clocked 99 in a 65 once in NC. Went to pass some truck, and he did the speed up game on me, so I mashed it. Cop said he didn't realize big trucks even went that fast and "only" wrote me up for 89 in a 65, so it wasn't 25+ (wreckless driving) ...got a lawyer and entire thing got dismissed.
You're in Texas and doing CMV so you can't do defensive driving or alternate options. Your only hope is to hire a traffic lawyer and set a trial date. There are some technical requirements for radar and lidar use. Usually the manufacturer has a process to test the equipment each day. Yearly the devices are suppose to be inspected. A lot of time the daily stuff is skipped or not logged. Creates enough doubt to have things swing in your favor. You can either research and defend yourself or hire a lawyer to do it for you. The superspeeders guys on YouTube always promoting the ticket clinic.
It's possible contact a lawyer that specializes in that, they can really work some magic to invalidate the officer, like if they didn't calibrate the speed radar
Yah but it was in the rolling texas hills and I was fully loaded tanker, I explained how the surge was hard to control and he bought it but I sure as fuck didn’t make the mistake again.
