If you’re in a 1099 and do not own in any way the equipment you are driving, you’re getting scammed. You can justify it all you want to yourself, but if the IRS found out your company was doing 1099 on company drivers, they’d come and destroy the company you work for with back taxes. It’s tax fraud a scam, and you have less rights to fight against your employer if they ever screw you over in other ways. Stop falling for it. If you need an exact number, they are stealing 7.65% from you.

That is the individual's fault. As a 1099 you have a lot of options for retirement savings not available to others. (SEP IRA and SE 401K) and obviously everyone should be maxing out a Roth IRA regardless. 100% depends on what you do and if you are smart about it. Used to work in public accounting and trust me there are dudes doing 1099 out there making bank. I've seen dudes come in with a stack of 30+ 1099s from various companies and making hundreds of thousands of dollars a year. But they do something specific, like niche, and can sell their services to whoever and all that. In trucking though, especially lease op, yeah it's a sham. All the lease op drivers for companies like swift, prime, Stevens transport etc if the IRS was serious and would crack down on it they aren't true independent contractors they are by laws on the books actual employees. It amazes me the trucking industry can get away with this shit.

Yeah most I saw was a dude who did something crazy with cyber security, he had if I remember right 42 1099s in a single year and his gross was just shy of 400k I was like gosh dam that must be nice lol. But 1099 so shave off 15.3% plus then federal and any state withholding taxes, paying for his own benefits out of his own pocket too obviously. But that's when being a 1099 is worth it, and then you can pick and choose your own jobs where you go who you work for how long what hours you work for as long as the work you are getting paid for gets done as requested by the client etc.

I did 1099 labor building irrigation systems and loved it. They paid all expenses and I wrote off as much as I could on my taxes. We were paid by the foot and once the crew built a few together it came out to a damn nice hourly rate. Your paying taxes either way.

I'm 1099 and I don't feel scammed yea I have to pay for all my insurance and stuff but I also get paid way more than I did at My other jobs. I get paid 27 percent gross of a load and don't pay for anything on the truck. I'm making around 3k a week. So as I explained to another person arguing about a lousy 7 percent. Whatever goverment gets an extra 7 percent but I also get 100 percent more than I earned at Crete or what other people earn at different companies. I'll work this job for 2 years and buy my own brand new truck in cash seems like a good deal to me. I could earn more but loads are shit still. Even on flatbed the best I made was 4 dollars a mile.

I have never had a load not say detention pay. I havnt had a tarp load yet but ima watch for that. And I wish I had a 2020 freightliner. My current truck is a 2013 volvo and that iv had since February and it has NEVER worked fine. I had scr problems that limited my power to zero going up any hill and I'm down to 14 mph be that fully loaded at 80k or bobtail makes no sense. I'm currently down because my turbo went bye bye smoke is pouring out any hole it can find on the entire exhaust and my scr problem still isn't fixed. Funny enough I'd still rather work with this guy over Crete or crengland which were my first 2 companies.

Thing is if you do it and document evidence you’re actually an employee there’s a form you can fill out (SS-8 I think), and if the IRS decides you’re right you don’t pay any taxes on that income (cause they go and buttfuck your employer for that money + penalties). Could make those gigs pretty lucrative in the short term assuming they’re paying you enough extra to offset the lack of benefits.

This is all very simple. File a request with the IRS where you outline your employment situation, include all details, and ask them for a determination. If they say you are a W2 employee, let them know you and X number of other drivers are classified this way and you need help… they will be more than happy to investigate.

I’m a 1099 company driver. I make about $75k year. I put aside 31% out of each check in its own account, and pay that to Uncle Sam every time estimated taxes are due. Last year I got like a $2k tax refund. I understand that paying for insurance out of pocket is more expensive than with a company. I probably loose about $200-$300/mo just from that. So I essentially make about $72k/yr. It does suck but you’re saying it’s even worse than that? Sorry I have researched it and I guess I didn’t come across the right info. You’re saying this is a scam?? Please excuse my ignorance. Looking for some more details. Anyways I’ve been looking for a local W2 gig in Atlanta for the past few weeks.

Yes absolutely! Employees and employers share a certain amount of tax contributions under the standard w2 set up. When you agree to 1099, you now are the employee AND the employer, so you are now covering their fair of taxes they are supposed to be paying, which works out to 7.65% of your annual gross income. A lot if people believe they can ‘’make up for that’ with write offs, but you would have to write off A LOT to break even. So say you gross 100k per year, you’re losing 7,650. At 25% tax rate (just a rough estimate) you’d have to write off over 30k to break even. How much are you writing off?

1099 is the tax form for independent contractors. You are responsible for paying all taxes on your own, so it's easy to fall into a tax deficit if you aren't responsible. You also have no company health insurance so you are responsible for paying the full premium if you want insurance. You also have little to no protections that employees get because you are technically your own company working for someone else. So if you are let go, you have no unemployment benefits, etc. If you are an employee of a company, you get a W2 form.

Yea but if most ppl make around 50 to 60k a year driving and he makes 3k a week the tradeoff is well worth it. He still makes more. Alot of truckers take home no more than around 1100 a week after taxes, many even less. The average pay is pretty low and and he gets more than double that. The internet is full of driving gods who never make mistakes, are better than you, and make 100k a year. some really do but many are full of shit. I bet if you asked on here what ppl make everyone will be making 100k a year and everyone is ballin and they never made any mistakes driving. Ppl lie to look good all the time. Clearly, you have no idea what it costs the company to actually hire you and keep you employed(if you dont, go educate yourself before you open your mouth). Knew many small company owners where the only way they could keep drivers employed was as 1099, otherwise rates just weren't high enough. I started as a 1099 driver, and it was much better than a W2. My pay structure could only work as 1099. Share the risk, share the rewards. I got paid 30% of gross. My 1st week paycheck was over 3k. And it stayed like that for over a year. When i was training others, i got paid as high as 6k a week. Tell me what w2 would pay you that? Especially for a beginner. At the end of the year, go to someone who knows what they are doing, and you pay much less taxes than what would've been deducted from you as w2. With a 1099, health insurance for you and your family, per diem food allowance, any and everything you get for the job is fully deductible. With W2, it could only be deducted if you elect itemized deductions instead of the standard. So you immediately lose $25900 in dedications if married. More if you have kids. You can choose whatever fits you best, but i am sick of how superior people like you act with your W2s and unions. W2 is good for risk aversive people who want a consistent pay and dont mind getting paid less. 1099 is for the people with the true American spirit ;)

Straight out of the gate, a 1099 status transfers whatever the current FICA percentage is, the one I remember is 7.15%, from the employer to you. Other things equal, the same compensation on a 1099 is 7% worse. Then you get into the situation where an employer is liable for the tort acts of their employees, but a contractor can be held liable separately. Why would you sign up for that? When looking at these deals, and I'm not a trucker, but the basic principle of negotiation is whatever the opposing party is asking for that you didn't want should be suspect. 1099 status is top of the list here.

Tort cases are not so simple. Not always the case that 1099 is included. Also the reason I pay more tax is because I make more income. If my income was the same as w2 I would get money back also. If you are traditional LLC you definitely pay more because you are double taxed (income tax plus self employment tax)

Damn i didnt know that many of these are still around. Not Americans speaking ones at least.... im in chicago i remember this a bit. White freightliner mafia version of it tho, not volvos. It was with eastern European companies. My dad did this years ago when we came to the usa in 1992 from Poland. Basically you have to stretch the truth on your taxes. From what I remember and this was a long time ago. He still drives but as a w2 now. He had an accountant, and the guy would add a bunch of writeoffs without receipts to back it up. As long as it was within reason ppl got away with it. There's not many Polish companies that do that anymore. A lot of the sketchy ones went under after 2007. The only ones I've heard of or ran into rently were from companies owned by russians or ukranians guys. A friend of mine worked at a russian company cause he got a dui and they hired him after a year passed. They basically had felons, ppl with wreckless driving, dui's, etc... all 1099. I would trust leaving my car on their lot lol....

You also have the right to set your own schedule, negotiate compensation, work for multiple companies/clients, and sub-contract jobs. If you are doing swifts lease op program for example you can only haul swift trailers, you can only take loads that come through swift and down to you. You can't take that lease op swift truck and go haul a load you find on a load board or whatever for another company. Aka that makes you a swift employee and not an independent contractor. Unless there's a whole different set of rules and laws for trucking in regards to independent contractors, which I don't think there is, you fall under the general IRS definitions of 1099. And not being able to work for anyone else or haul another companies freight while being a lease op driver definitely makes you an employee and not a true independent contractor. I'm sure these guys have spent buckoo bucks on lawyers and accountants writing these contracts just right that they get away with it technically somehow. But at the end of the day the lease op drivers are really actual employees. But the IRS doesn't want to spend years and decades fighting them in court as these lease op programs greatly benefit the mega carriers that offer them and the megas would no doubt spend the money and time fighting it out in the courts. Same reason the IRS doesn't go after the truly wealthy, it's a headache they can hire teams of lawyers and accountants who can drag things out for years if not decades. Plus in their case as well they are hiring lawyers and accountants to take advantage of every tax loophole and law and make it legal or at least appear legal before they file their taxes anyways. It's far easier to go after Joe Bob with a small construction company who fucked up his companies taxes or incorrectly filed someone as an independent contractor then it is to say go after just for example a billionaire for possible tax evasion or a mega trucking company who can spend millions of dollars fighting the IRS in courts if they decided to do so.

There are surprisingly a lot of folks against 1099. I think there are a lot of 1099s that if they went company would quickly go back to 1099. Make more money and go home for as long as you want as long as bills are paid 1099s got hit when freight slowed down, and if you don't understand the industry and prepare for economic ups and downs with an emergency fund then you probably got screwed. Basically, if you can run a business or have experience being self employed, go 1099. If you want to be self employed and learn the ropes, go 1099 and save as much money as you can (%30-60 of income), and if you don't have discipline to save then stay W2. Before I owned a truck I leased one as 1099 and saved up enough to get a truck. Busted my ass off, didn't go to casinos or hotels, paid my taxes on time so the bills never piled up, etc. Also don't do traditional LLC, do an SCorp. More paperwork but you save about 5k in taxes every year. It's not a scam, you just have to learn the ins and outs. A lot of people can't deal with the smallest of issues or stress and just give up. My mom always said don't buy a second property to rent because things can go wrong and you might get bad tenants. But that's the same thing for all businesses. Things will always go wrong and you have to adapt. I've seen some serious fools go 1099 and succeed, so if they can do it so can you. If your company is unfair to 1099, double check that theory. If others in the company are doing it and enjoying it, then ask them what they do because chances are you just don't know how to 1099

When I switched from being a company driver running Target dedicated to 1099 lease op running the exact same account and miles I went from making 75k a year to 120k the next year, on track for around 145k this year. Even having to pay for everything myself now I’m still netting nearly double what I was 2 years ago. I won’t deny there’s plenty of crappy deals and shady companies out there and it’s a minefield but if you’re in a legit 1099 position with a decent company you can make money.

A 1099 situation can work for or against you. As a 1099 you’re only required to do exactly what’s in the contract. If the employer ask you to do anything outside of the contracted role you say no. They can’t force you to skip breaks or break laws to get a delivery done. Make sure your 1099 contract pays enough to cover the taxes they would have taken out in pay and covers your costs for a private healthcare plan.

Your actual cost as a W2 is some where around 2.5 time your pay rate so $10hr would cost the company $25hr and they split their tax and healthcare cost with you on W2 via their pay rate.

So as a w2, the government is giving you an auto 14k, and you admit you’ve never spent that much, so the government is giving you a FREE write off for the difference. So as a 1099, you’d still have to beat 14k in write offs before you even start to catch up. It’s not worth it, I promise you, if you sat down and write out all the numbers as 1099, and w2, w2 would win. Even in a best case, you break even, you’re doing a lot more work keeping track of all this little bs for no reason.

I have ran the numbers and I'm glad my boss gives me the option. With a w2 you can't write off job related expenses but you can add them to your deduction total, but you take the standard at 14k or the exact amount, whichever is higher. This is called itemizing. With my 1099 I get to take my standard deduction and also write off all of my job related expenses. Work clothes, occasional parts, fuel, personal vehicle mileage. Everything that is needed to do the job I am contracted to do that isn't supplied. Of course I "bill" in anything I end up having to purchase to do the job.

Oh boy. It’s a long story. Ok first off, the whole strike thing to me is so appalling. I compare it to a toddler throwing a tantrum for not getting some candy at best, and borderline terrorism at worst. You got a pay raise? Great! Now all your customers have to pay higher fees, did the customer get a better product or better service? Hell no they didn’t! Now everything associated with your place of employment has to raise their prices too. Now groceries are even higher etc. but you ‘deserve’ a pay raise right? No! You earn what you’re worth, and what the market will support, not worth however much you can get by threatening the entire economy, that’s so selfish and nearly terrorism. It is an absolute scam for people who don't know how 1099 works. I have been receiving & filing my own 1099 for 5 years in a different industry with zero audits prior to trucking, so I have lots of experience. I received a 1099 with my first company & at the end of the year, I filed & submitted lots of deduction. Even with the combination of self-employment tax & income tax (yes, 1099 is taxed 2 ways), I still end up paying less tax than what I'm supposed to pay if I was W2. A few downside is I don't have benefits package nor PTO, as well as paying TurboTax for self-employment tax fees. However, my annual premium of my own health insurance combined with my tax is still less than W2 tax. Also, since I don't have PTO, my company allows me to take off whenever I want, however long I want. I don't get paid if I don't work anyway.

And how much are you writing off? And I’m an employer. When I write a paycheck to an employee, say 1500, 1500 isn’t what comes out of my bank account and into yours. Your check would show 1500, minus whatever taxes you signed up for on w4, then my bank account shows 1500 plus an additional 7.65% in taxes that every employer pays for the employee. Signing up as a 1099, you make yourself both the employee and employer, so now that additional 7.65% is on you

You don't have 1099 employees... unless it's illegal. You have w2 employees OR you have 1099 contractors. W2 employers have to match some of the taxes that the employee pays. A 1099 contractor has to pay both their pay and the "employer" part, because they are their own employer. 1099 contractors should be renting/leasing/owning their own equipment and have the ability to decline loads for any reason. If you are 1099 and do not have these, it's illegal. You are an employee and your "employer" is making you pay their taxes.

Showers, food, Uber whatever. Granted no health insurance, but honestly seems like a worthy trade off.. I get taxed at 24% out of my current check. Lease payments are 100% tax deductible as a business expense, and you can lease a truck fully under warranty every few years, eg, you don't pay out of pocket for repairs, avoiding the potential pitfalls of ownership. Please explain to me why that would make someone an idiot. Both options (leasing and purchasing) are viable, it just depends on how profitable your company is and how much capital you have to get started. I've had plenty in the past, outside of trucking and with trucking. As long as you do research, know your expenses versus revenue, read your contracts, set up your business correctly, keep track of money, etc, its not difficult. So many drivers treat a "settlement" as a paycheck and wonder why they're broke after 5 years and owe the IRS $60k.
