Are you saying you waited 20 minutes in total? I'm not sure you have much argument, but it's worth posting on the forums the automod suggests just in case something else could help you.
LucidFir@reddit (OP)
Yeah i was in the area for 20 minutes total because the signs are only at the entrance, so when i pulled over there was no sign next to me that i could see.
Issue date 26 of May so I've got 7 days to pay £60, or i can fight it
JBEqualizer@reddit
There are 4 seperate signs for what is essentially a lay-by warning you about the 5 min max waiting time.
Tim-Sanchez@reddit
Sorry, if you search the /r/legaladviceuk subreddit you'll see what I mean
Master-Trick2850@reddit
"I drove down the entire one way street because only the entrance had a one way sign"
see the issue?
mad-un@reddit
If you read the signs, it does actually say you can stay for up to 5 mins, unless you've been at a funeral, when you can stay for 23 minutes. So you should be all good to contest it!
LucidFir@reddit (OP)
Oh thank god, driving to their offices with a fire-[reddit redacted] now!
Lily121291@reddit
So you entered the section that had the sign saying it's an enforced area and then you're wanting to fight it because you drove further into said area and there wasn't a sign directly in front of you, but you drove past the sign when entering the area? is that right?
You'll end up paying even more if you try and fight it.
LucidFir@reddit (OP)
Well, to be accurate, I'm wanting to ask reddit if I have a leg to stand on so that I don't waste my time doing something futile. I was hoping that road signage rules about sufficiently spaced signage would apply, but the rules I'm thinking of are for Canadian govt owned roads. I've been out of the UK for a little bit. It does seem like I do not, in fact, have a leg to stand on.
Any-Pattern8246@reddit
You could argue it being similar to Thornton v Shoe Lane Parking [1971] 2 QB 163 that the signs are NOT clearly advertised before you arrived. BUT if the signs were BEFORE you arrived then you'd have no case/can't argue its similar to this case that the signed were not clear/advertised before you entered etc. You can try and see what happens. But be prepared for the no if the signs were advertised what you said before you entered. Just saying.
Buddha-dan@reddit
No longer £60 I guess, 7 days gone already.
LucidFir@reddit (OP)
£60 if paid within 14 days of date of issue, which was May 26, which was 1 week ago.
SammySalmon63@reddit
If it's from a private parking company it's not a fine - it's an invoice for an alleged breach of contract.
Only courts and councils can issue fines.
Kezly@reddit
Obligatory "I'm not a legal adviser", but I imagine they will claim the sign at the entrance is clear and visible, and the responsibility is on you to have read it on arrival.
Difficult-Vacation-5@reddit
Appeal it. You have nothing to lose. As per rules once the appeal is started they'll need to freeze the deadline.
LucidFir@reddit (OP)
I would lose 40 quid compared to paying at the cheaper rate.
WesternEchidna854@reddit
They will likely say that signage was adequately placed for when you drove in and you should have read this, given it was clear of any obstructions and visibility was clear.
Sorry about your situation bud, it's just if you fight it you may kick the can down the road and just end up paying it . Good luck mate
Beartato4772@reddit
On what basis would you be appealing?
LucidFir@reddit (OP)
Lack of signage across the entire area.
Drath101@reddit
I'm sorry mate but there's plenty of signage. "I didn't notice the sign because I was distracted while driving" isn't going to land you anywhere with it. I empathise, I've been to 4 funerals this year, but you're in the situation now
LucidFir@reddit (OP)
Cheers, I just thought I would check first. Some countries require the signage to be consistent across the length of the road, not just at the entrance. Sometimes stuff just straight up isn't enforced. Worth a check. Thanks!
not1or2@reddit
If the signs are at the entrance and you were there 20 minutes then it’s your issue. Question to ask yourself is were you within the controlled “5 min drop off area” for 20 min? If so then the fine was issued correctly.
StickmanEG@reddit
Pay it at the cheaper rate. No way you’d win this.
Dolphin_Spotter@reddit
Absolutely. Even if it's just to cause these robber barons some minor inconvenience.
LucidFir@reddit (OP)
Currently sitting at a difference of £40 if I'm just going to fail anyway. I edited the post as I found the issue date 26 of May
-info-sec-@reddit
You should frame it, you've paid £100 for it 🤜🤛♥️
Zool375@reddit
Although I sympathise with your situation I can guarantee they won't. Sorry OP.
