RTX 3070Ti New VS RTX 3080 10gb Used?

So... I'm doing an upgrade from GTX 1660 SUPER and these are the most budget-friendly options I found locally. I'm a bit of a noob, so not sure what should I get
RTX 3070Ti is from a local shop with a full 3y warranty
RTX 3080 is from someone on marketplace
About 3080: Furmark FPS is 57, GPU hotspot is 104°C, VRAM temps are 94°C. The GPU doesn't look like it was in a mining rig, though it has been disassembled at least once. Memory is from Micron
The price is basically identical for the two, so I'm not sure on whether I should play it safe or gamble here?

Assuming they're the same price, I'd personally go for the 3080 but I've also never had issues with used PC parts. I'm sure if I'd had a bad experience in the past I'd feel differently.

Honestly 104c hotspot on the 3080 would make me nervous already lol. The card is obviously way stronger, but if both prices are basically the same I’d probably take the safer 3070 Ti with warranty instead of gambling on somebody’s opened-up marketplace GPU.
Especially at 1080p honestly, the 3070 Ti is still gonna feel like a massive upgrade from a 1660 Super anyway

I would probably get the 3080 considering that for warranties, the 3070, even if unopened, probably doesn't have a manufacturer warranty anymore.

And if the warranty is from a shop itself (I can refund/ask for a replacement from the shop (also technically I can send them it for repairs, but I heard bad reviews about their repair service)), should I still go for 3080?
