Kinda sad that it is qualified in the way it is. These two were murdered and because of the way the laws work, it's still about them riding ebikes.

What was OP’s point then? They said the 2 people who died were murdered and then implied that the truck driver isn’t being charged with murder because the victims were riding e-bikes. I interpreted that to mean that OP thinks law enforcement is giving the truck driver a slap on the wrist because of all the e-bike hate, but in reality, the truck driver is going to be charged with the same crime they would have been charged with if the victims were pedestrians.

It’s not murder unless the truck driver was intending to hit and kill the e-bike riders. The article says the e-bike riders and truck driver knew each other and were hanging out somewhere in the area drinking before the accident. Based on the article, it sounds like vehicular manslaughter x 2.

Either intent or reckless disregard for human life. It is not actually required to intend. Extreme recklessness or depraved heart. Then there is the felony murder rule where if you were commiting another felony and someone died it is murder even without intent. It is unclear if any of these apply here but they could depending the circumstances. Very little information on this article to say one way or another.

While you are correct on several points, the reckless disregard for human life factor doesn't come into play unless the person had at least malicious intent, that's how the depraved heart idea is included.
