Just to get this straight: car cuts off truck = “truck should have dealt with it.” Truck moves over with a similar gap behind him = “unsafe lane change.” Got it.
The car created the problem by moving into the truck’s lane with very little room. The truck then moved left to create space, and suddenly everyone discovers lane-change law.
I’m not saying the truck gets a free pass. A lane change still has to be safe. But if the standard is “don’t move over unless you have plenty of room,” then that standard applies to the car too.
Otherwise this just becomes: four-wheeler does something stupid, truck tries to avoid it, and then the CDL holder gets blamed because he’s the bigger, easier target.

I mean you have video evidence of his turn signal being put on before you passed him and had room on the left to change lanes and allow him over. Why maintain the lane just to block him? No need, if your left lane is open, move over and avoid the whole thing.

Now if he had stayed in his lane and been unable to stop in time due to the car cutting him off, then it would have possibly been the cars fault.

I don’t feel like he needed to take evasive maneuvers because of that car. He never even tapped his brakes. And then you can see how much room was between him and the SUV I feel like he could’ve just slowed down if that was the case.

No it didn't have to. But if they did they would have never had a risk of an accident. People are way to hung up on the law aspect, truck got cut off and wanted to avoid slamming the breaks and got over (dangerously), you could have stayed still and got clobbered and then been in the right. Or lets take all the risk out of it completely and not waste an entire day filing reports and months of legal battles just to prove you are right.

There was no need to slam on his brakes though… actually he never even touched his brakes. He wasn’t avoiding nothing. And we’re taught to go to the shoulder when avoiding an accident, not further into traffic 🙃

So theres multiple variables.
The truck more than likely has our favorite cameras like samara, smartdrive, lytx especially with AI integrated. Bulling the driver to drive "safely" but it doesnt account human factor. By that, I mean it will ding, safety sees it, safety crucifies the driver for being human.
With that being said, a car merged to his lane. Now the trucker will get dinged for "unsafe distance". Instead of pissing mfs off for slowing down and wait for the following distance to increase, and with the prices of fuel; its better to merge. He may be dinged for fuel efficiency as well if he has samara and if the company cares about it or not. Im not sure with other brands.
The truck could also have the annoying sensors that sound alarms, thus creating a distraction to some drivers. That varies.
The pov driver could have slowed down or merged to the next lane. It almost seems like the pov driver is distracted because they waited to the last second to react. Most people would have merged on over if they see a truck start to merge.
Truck may have not watched the mirrors and the road.
This appears to be new jersey. Povs driver behavior should be expected. Its also important to note NJ is a no fault state.
Should this happen at a fault state, the blame could be all on the truck or at some states both. A good attorney would ream the trucks driving log records; but if its impeccable, a Saul Goodman can shift the blame to the pov driver for failing to adhere the last clear chance doctrine. Meaning if the fault is 99% truck and 1% pov, no one gets anything.
Otherwise, truck is at fault and normally is held to a higher standard. Even with the nuance of the tech companies being in trucking.

Truck by far lmao. When you pull into a lane your thought process shouldn't be "I have room if they slow down" it's just a yes or no "do I have room".
Now you could make the argument if the car hit the truck rear that they should have slowed down, but the car was parallel to the truck before it even started entering the lane.
Really the car was kind of an idiot as well but legally that truck is a bigger idiot. Only one of these drivers carries a CDL and drives for a living. The truck should have done better.

Not slowing to avoid an accident may carry some blame to pov car and a good lawyer can absolutely destroy any “unsafe” lane change challenges. So it could absolutely put most if not all blame on the car. The most damning evidence is the dashcam. Without it a sideswipe full blame on trucker is actually more plausible

That wasn’t unsafe on the trucker? That car clearly going faster than him and had the right of way, because he’s the one trying to merge. The car would’ve had to slam on its brakes to avoid rear ending the truck IMO. I’m three weeks in OTR, so I’m still fresh out here. I felt like the trucker played bully ball.
