The scope being mounted to that piece is a choice.
It's also getting beat to hell from the brass since there doesn't appear to be a brass deflector shielding it.
I doubt it holds zero.

to have a scope that would be remotely accurate, a pivoting rail mount like those aftermarket ones for SKS would probably be a good idea

from my desk it looks like you'd need something like the classic AK pattern side-mount adapters, because you also need it to come up over the ejection port and act as a brass deflector.
That scope is getting beat to hell.

with how this rifle works that means loading will be difficult. Also with a side mount you'd need to cut into the wooden stock. whereas a dog leg top rail is pretty much drop in fit

What about a side mounted scope bracket would interfere with loading a magazine from the bottom of the weapon?
And what do you think a dog leg is? Are you just talking about a long rail adapter mounted in front of or behind the action group? A "dog leg" mount is also a side mounted adapter thar comes over the top or bottom.
A long eye relief optic fully forward of the action group would also work better than whatever's going on here but I suspect this scope was mounted more for aesthetics than function.

No. A side mount will make charging the weapon difficult. This gun is typically loaded by pinching the cover on the top.

Did you watch the video? There's a handle on the side. No pinching necessary.
And a side mount would only interfere with a top pinch if you mounted it too far back.

Where are you going to attach the rear mount? And how does that interfere in pinching the top cover to cycle the action any less than a side mount?
You may have "handled" them but you're talking out your ass to invent reasons why your personal preference is the correct solution.
There's more than one way to skin a cat and mount an optic.

Whats even better is with overgassed Gewehr 43s (dont shoot them with the original gas system) you can shoot a guy 100 yards away while also throwing hot brass at a guy 30 feet away, on a shed roof.

Yeah not happening because we very rarely have these types of shooting ranges in Germany, but good to know. Wouldn’t that be solved by mounting a long eye relieve optic further forward on the gun?

No, but it was solved by making optics better.
And by making the new bolt carriers lighter and adding a hydraulic buffer to them.
You always could run a long eye releif optic, just had to be a well manufactured one.

It’s easy to ask this with hindsight but the design is from the early 1940’s when autoloaders were fairly novel and designers were still working out what did or did not work well.
