The one I went to was a company owned school. They openly said "all wr are teaching you is to do the few backs you need to demonstrate, how to double clutch a transmission, the EXACT WORDS you have to say to pass a pretrip, (but not what you are actually looking for) and to pass your written and driving exam. Everything you need to know beyond that you will have to learn during your hands on period with a trainer.
Which for me was 6 weeks of holding the steering wheel on interstate while my instructor slept.

When I went through 8 years ago, we talked about slack adjusters, as part of the pre-trip, when other students asked how to check them and how to adjust them, they’d conveniently change the subject, or ramble about auto adjusters on every truck now and not needing to do it. I had worked on trucks, I knew how to do brakes and how to properly adjust manual and auto adjusters, so I’d show the students who were actually interested in learning.

My mom is a CDL instructor and examiner. She makes every single student memorize their PTI, inside and out of the truck. They will not move that truck on to the main road if they do not do it correctly. They can move it on the pad or training track, but not the road. It really depends on the morals and values of the place of learning. Some dont care, "you'll get trained more at swift or whatever your first job is." We care though, we want our students to be confident in their abilities with the truck. We dont want to send them to their death.
One previous student did get in a major accident with himself though, he was forced to run loads and fell asleep at the wheel, he turned himself into a turtle. Hes okay though! Although he's likely gonna lose his cdl because he's at fault for falling asleep. Even though the company he worked for was forcing him to take loads and drive more than he should. I haven't heard much about it, its likely still in investigation.
Always fight your DMs when they want you to run an unsafe truck. Not only is your life at risk, but every one around that truck too. A simple brake issue could mean life or death with Semis. A slightly frayed tire could mean life or death. Never take a truck or trailer that has an issue, have them fix it ASAP. Always use your good judgment too.
Mom refused to take out container trailers that had bad tires or missing lights, or any issue dealing with the pigtails and glad hands. Her DMs would tell her "oh just take it, its fine" or she would tell them her steer tire need fixed "Oh just run it, its fine". She forced them to call the on-site mechanics, didnt matter if it was 3am or 12pm, she had them get those mechanics. She will also force the mechanics to get it right, if they said "oh its good, i fixed it" and she would test whatever was fixed, and if it failed she told the mechanic to fix it correctly, not Jerry rig shit together.

Trailer clearly just had a brake job but only on one side, while the other side is technically "legal" while they had it in the shop and on the jack they should have went ahead and replaced the brakes on the other side as well.
They are also out of adjustment due to a missing pin on the automatic slack adjuster, you can see it hanging down on the far right side of the third picture. It's actually a really easy/quick fix and there's basically no excuse for it to have been missed.

Thought you meant the fresh brakes and got confused lol that second pin hole on the slack adjuster is what makes it an auto slack adjuster. Brakes would still work until the pad is out of adjustment but thats really a temp fix for when you don't have the right Clevis on the side of the road.

Per FMCSA regulations, employers musr keeo a detailed log of all work done to repair each vehicle, as well as annual inspections plus the DVIR.
If he noted it on a pre-trip, refused to drive, and then the company has the DVIR logs showing the defect but no logs showing a repair? Or even better, if the defect is still present on the trailer?
If that gets proven in a court of law, that company is absolutely fucked and may as well shut down. It's why, when a company has done wrong, or if they can't prove that they were 100% in the right, they settle quickly.

Not really. Depending on the state employees have allot of power. And courts are likely to weigh the arguments on both sides equally taking into account why one would bring suit in the first place. The standards of proof in a civil case are much different than criminal. Nothing needs to be proven beyond a reasonable doubt. The court only needs to find that it’s more likely than not that something happened.

Again, all they need is a statement from a mechanic stating that the driver was wrong. Last time I checked, the commercial driver would not qualify in court as an expert witness as a mechanic… And employers do keep records of repairs. It’s called receipts and invoices.

I was yelled at by a dispatcher for it when I was at QC but they were just mad that the issue had to be fixed now. I can only imagine how long theyve known about it.

And you do realise that in a court of law, any diesel mechanic saying that pic 2 and 3 were fine would either be demonstrating extreme incompetence or outright committing perjury? You could bring in literally ANY DOT enforcement officer, whom's credibility as an expert witness is far beyond that of a diesal mechanic, and any one of them would put those brakes out of service.
And yea - it's not just invoices and receipts that a lawyer can subpeona but the entirety of every DVIR, repair parts, orders, entire maintenance log. And not JUST for that truck but for every single truck.
And then call on other current and past drivers for the company to give witness statements. Get DVIRs for additional trucks and trailers of the company. See about acquiring a potential lvl 4 or 5 inspection done at the companies terminal.
Then you start comparing this to mileage. Do the trailers have 150k miles on em, but few brake pad replacements? Hub cap seals start to dry rot after a few years, how many have they replaced? Does the maintenance of the vehicles match the age and use of the vehicles?
If a company is absolutely 100% by the books and doing everything right, then yea, bring it to trial.
But if a company isn't? If their maintenance and parts replacement isn't lining up with use and age? If their drivers are consistently, across the board, saying that their DVIRs have no issues and nothing is ever wrong?
Then yea, any good lawyer is going to scrurinize the shit outta that.
And while I may be unsure about whether this driver filled out his DVIR properly? I am 100% sure that you won't find a single mega in the states that does everything 100% by the book.
And final note - any lawsuit against a carrier is a speedy lawsuit. A motor carrier does not have the ability to delay or hold up a lawsuit in court with legal minutae for years. 210 days, or 7 months, and then a judge has to hear out the case.
Truckers have amazing legal protection. But then we have assholes like you trying to discourage and dissuade use of those protections. Hell, I wouldn't be surprised if there's a conspiracy between carriers to try to control the narrative here.

Thats why I always keep the yellow receipt on my pre trip and post trip driver report. And pictures help always. At least in my yard, we have cameras EVERYWHERE so its so hard for any employee to self sabotage. If you refuse to drive it then it will stay in the yard with cameras. Stuff like this irritates me cause they dont understand it falls on us drivers

While the actual competence of a truck driver when it comes to diagnosing an issue can and always is a huge question, holding a CDL means, to the government, you are 100% qualified to conduct AND diagnose issues pertaining to certain areas of the truck. Brakes, especially, are included in that.
2nd - he has pictures of brake pads that are worn below the minimum standard. That is absolutely unrefutable.
3rd - Every single truck driver, in the US, has the right to refuse to drive an unsafe vehicle, period. Furthermore, any issue called out in a DVIR must be inspected and then repaired if an issue is actually found before it can be loaded.
Any attempts to get a driver to drive an unsafe vehicle, or to punish a driver for refusing to drive an unsafe vehicle, is an absolutely massive mistake on the employers part.
We truckers have barely any protections when it comes to our wages. If a company decides that they dont want to pay us, we can only get the feds to go after federal minimum wage for hours worked.
But when it comes to safety? We have the BEST legal protections out of almost any workers in the country.

Have you seen the posts here. Most manual adjustments on auto slacks are because people do them improperly. Read and talk to the brake manufacturers. Bendix is very clear that a manual adjustment is for emergency situations only and they should be avoided.

It is not missing a pin. There is two holes in there. One of them is utilizing a pin. The other is simply for you to put a screwdriver through to aid you in making an adjustment while you are out in the field and do not have the means to clean the threads on that rod. That is all it is. There is nothing missing.

The last picture. They’re talking about the rod that goes from the brake can to the slack adjuster. If you look to the far right middle of the pictures you’ll see the adjustment rod from the slack adjuster has no pin in it and the adjuster rod is extended pretty far.

Debt pin that is missing is not actually missing. Look closely there is two holes in that piece. One hole is for the pin which it has a pin in it and it is being used. The other pin is for a screwdriver to go in to assist you in turning that piece when you are making an adjustment.

lol no that is not what that is for. Those slack kits come with a big pin and a little pin. The little rod off the slack is supposed to be pinned to the brake can rod too. That is the piece that automatically adjusts the slacks. It’s not for a screwdriver lol

You could always manually adjust the slacks, not that hard. Also if it passes a trailer brakes test and tug test on push rod its legal. Your employer might be in the right if you didnt specifically mention that it failed tests. You also wanna have evidence employer refused to put it in the shop

Under 49 U.S.C. 31105(a)(1)(B), an employer may not discharge, discipline, or discriminate against a driver because the driver refuses to operate a vehicle because the operation violates a regulation, standard, or order of the United States related to commercial motor vehicle safety, health, or security, or because the driver has a “reasonable apprehension of serious injury” due to the unsafe condition of the equipment.
This is commonly referred to as the FMCSA/STAA whistleblower protection statute. It covers retaliation such as firing, forced resignation, suspension, reduction in miles/pay, harassment, blacklisting, disciplinary write-ups, and retaliation for refusing unsafe loads or equipment.
Examples include refusing to drive with defective brakes, bald tires, steering defects, inoperative lights, serious HOS violations, improperly secured cargo, equipment placed Out-of-Service, or vehicles violating FMCSA safety regulations.
The refusal generally must be based on either an actual FMCSA/DOT safety violation, or a reasonable belief that operating the vehicle would create a serious safety hazard.
49 C.F.R. 396.7 Operating a vehicle in unsafe condition prohibited, 49 C.F.R. 392.7 Driver must be satisfied equipment is in safe operating condition, 49 C.F.R. 392.3 Fatigued/ill driver prohibited from operating, 49 C.F.R. 392.14 Extreme caution in hazardous conditions.
Drivers alleging retaliation under STAA generally file complaints through OSHA within 180 days of the retaliation. OSHA investigates STAA whistleblower complaints on behalf of the U.S. Department of Labor.
Drivers have 180 days from the alleged retaliation under 40 USC 31105. The controlling statute is 49 USC 31105 (b)(1) that states a driver must file the complaint with OSHA not later than 180 days after the alleged violation occurred.
This is not typically filed directly as a lawsuit first. The process usually starts administratively through the Occupational Safety and Health Administration (OSHA), which investigates STAA whistleblower retaliation claims.
The 180-day clock generally starts from the termination date, suspension date, disciplinary action, constructive discharge, or other retaliatory act. If retaliation is ongoing (continuing retaliation, blacklisting, repeated discipline, etc.), newer retaliatory acts may create newer filing windows, but older acts can become time-barred individually.
Drivers may also potentially have state wrongful termination claims, public policy retaliation claims, wage claims, discrimination claims, or contract claims, which can have completely different statutes of limitation depending on the state.
Unfortunately many drivers wait too long because they think they must “build a perfect case first.” Under STAA, missing that 180-day deadline can destroy the federal retaliation claim entirely even if the underlying safety complaint was legitimate.
TLDR: If it’s within 180 days of your termination, report it to OSHA to begin your case against being fired in retaliation for refusing to operate unsafe equipment!

The missing pin is for the auto adjuster. Basically the slack adjuster would still work the brakes but it wouldn't auto adjust so you'd have to constantly be readjusting them. Either it was installed wrong and fell out or someone forgot to reinstall it after servicing it.

The small pin actuates the auto slack, without it you pretty much have a manual slack adjuster. Still a violation but wouldn't count as an inoperable.

I just started at a small company a couple months ago and have found several trailers with similarly thin and cracked brake shoes. I record it in DVIR and put them OOS every time. I've even had to bicker with the trailer shop to get them repaired, and I still have no reason to believe my company has ever even considered firing me for it. If that's the reason you were fired, it is 100% wrongful termination and could be worth speaking to a lawyer about, especially if you have written record of it. However, you say it was a few weeks after..did anything else happen in the meantime?

For clarification my boss did end up fixing all of the trailer brake shoes because I refused to drive other wise. The first photo is after everything is fixed and the last photo you can see the automatic slack adjuster missing pin.

That pin runs the ratchet in the slack to automatically adjust the brakes. You can still manually set the brake. It's not unsafe to drive, you just have to manually adjust the brake. Before we had automatic slack adjusters we had to set out brakes manually all the time. The biggest issue was guys who spun them up the wrong way, completely backing off the brakes at a brake check at the top of a hill. Lots of deaths resulted in that era. I'd 100% set it up and run it if I was somewhere I couldn't get a new slack, then change it out as soon as I could. Of course DOT might say otherwise but physically there is no danger.

You got fired because there is nothing wrong with those brakes. For everybody saying there’s a missing pin… WHERE? The hole where you guys are thinking a pin goes is actually just a hole…. When is the last time you guys installed a pair of brake shoes? Brake shoes are a free floating design. They’re retained merely with clips and springs.
You got fired because you opened your mouth over an imaginary problem.
You can open your mouth to the Fmcsa But when you do that, the company will just get a statement from the mechanic stating that everything was fine and that you are unqualified to make a statement as you are not a mechanic.
They’ll probably also end up making a statement on that website where companies put reviews about drivers. And make it help for you to get another job because you open your mouth about things that you are not qualified to open your mouth about and delay delivery. And no company wants to deal with that.
Don’t open your mouth unless you’re 100% sure something is fucked up. lol

There is a missing pin in the slack adjuster on the third picture.
I thought the same thing you did, that hole is there to hold the roller in place until the main spring is attached. Then the roller is held in place by force and that hole is no longer needed.
The missing pin in the third picture is an issue however.

No, it’s not. That picture. The third one. Is the Axel on the opposite side of the trailer. The pin is blocked by that one part of the suspension perch that is welded to the axle. It is not visible in the picture. It is blocked.

Nevermind I won't circle it because I can't post pictures here. But I have been a mechanic for 15+ years. The pin that adjusts the slack out of the brakes is not connected on that slack adjuster. You can even see the adjustment arm of the slack adjuster hanging where it should be lined up with a pin connecting it to the brake chamber.

Bro the missing pin in the 3 picture is the pin that actually adjusts and takes the slack out of the shoes. So yes, the missing pin in the third picture is an issue. It's behind the clevis pin on the slack adjuster. It's a different size.... I'll circle it in red if you can't find it.

The photo of the missing pin on that pall design slack adjuster means it, the slack adjuster, won't automatically ratchet into position, given they were manually adjusted at the moment the shoes were installed, and eventually the pall end will fall out of the slack adjuster and the shoes will stray further and further from the drum.
That's just one style of slack adjuster and you'll find some other designs that only have a single pin at the bottom but have a small rod that aligns them at the top. That rod is necessary for the same reason on that more early design.

That isn't a missing pin... That's where the little ears of the roller clip in to hold it while I connect the springs to the upper shoe to put pressure on those rollers. It has nothing to do with safety and is in no way dangerous.
The other side however is clearly misadjusted. You should not have a gap between the drum and shoe unless the brakes are released.

The fact you’re asking “What does this pin mean” is both very good and very bad. I’ll let you puzzle out how both can be true.
Now that you’re fired, if you intend to pursue any action you’ll need rock solid proof that your state requires automatic adjustors foe the specific route you were told to take. You will need the text of the law. I’m concerned you’ll find that such may not be the case.

Way it was explained to me during an inspection, if the vehicle is equipped with a feature, and that feature is present, then it must be fully operational and free of defects.
So if you have 4 brake chambers, 3 have slack adjusters property installed and then 1 that’s defective.. that’s a fail.
