ULPT request: incentivize an elderly squatter to leave my mother’s house

New York City. My mother, 88 has had dementia for years and has been living in her 4BR house with an 89 yo guy who has sponging off her (or really, me) for at least 10 years. He doesn’t contribute a cent to anything at all and never has. Unsurprisingly, he’s also a very difficult person.
Now we are moving my mom to managed care. I gave the guy and his three kids a 3 month heads up, which I extended to 4 months at their request. When I checked in, seeing no progress with only one month remaining, his son in law told me “he’s not leaving the house” and in so many words, to go fuck myself.
I have a lawyer working on all the things needed to eventually get him removed by marshalls but it’s going to take a long time, evidently. Of note, the house is actually owned by a trust that my wife administers. It’s not my mother’s. But it could be six months to a year and I need to sell the house to offset my mother’s care. Delay is consequential.
I know what the lawyer advises wrt legal proceedings. What are some good ULPTs *strictly within all legal boundaries* that would help make clear to him (and his three kids that have made this my problem) that staying there rent free, waiting to die, is not the right move?

Check your local housing authority as to what a landlord must legally provide. In Florida, air conditioning is not a legal requirement. I had a squatter who stopped paying rent and a neighbor who was a contractor. A/C was disconnected from the outside. Squatter moved out within a week. This was in Aug, by the way.

He’s a squatter. Not a resident. He can move out with his kids. He isn’t doing it because he likes the place and the free rent. This isn’t an electric company turning off air or elderly saving money by not turning it on. This is evicting a squatter who is being cruel too. A friend of mine got to invade her own property after her husband rented her house to friends who turned squatters. Every time she tried to go there they didn’t want to open the door until one day their teenage daughter opened a few inches the door and my friend put her foot in. “Now we’re living together “ she said.
They left after two weeks. Her husband and neighbors passed her food through the window.
You may wonder why the husband didn’t do it instead of her? Because they had a 15 yo daughter and two boys. They could alleged that the husband tried to do something to their girl while he stayed there.

Can you get them (the helpers/providers) banned from the house? At 88 there's very little chance that he doesn't have someone caring for him.
Can you rent the other rooms to college students?
Make money while annoying him out that way and they'll have a lease while he doesn't. College students aren't likely to stick around to be squatters themselves, they wanna move back home for summer usually
Can you move in or a family member and be very loud/annoying? If not yourself, aim for a night shift worker, we tend to keep weird hours and at 88, he's probably an early to bed early to rise type so the noise of a night shift worker would really bug him. But since they're on the lease and he isn't, then he can't do anything except move out. Just make sure whoever is moving in is both trustworthy and stubborn.

Tell the deadbeat that the place needs major repairs, and put him up in a fancy hotel. Act all understanding, give him some cash for groceries. Then move in change the locks and don't leave. Get the utilities in your name. Redditer your thinking is wrong on this. You posted on ULPT. Nothing you do to make him leave is unethical.

Each state has their own specific laws regarding what is allowed between tenants and landlords as well as their own timelines for court action regarding eviction or enforcement.
In general, the landlords are severely limited in action they can take against a tenant except in filing for eviction and suing for reparations or lost rental income.
They can't go cut the power or heat any time they like, even if they pay for it, nor can they take the doors off the outside of the house, or remove the windows, or the propane tank, or cut the water off, block the drain lines, cut holes in the roof, etc.
Thats all considered malicious behavior or endangerment and inappropriate for a landlord to do to a tenant.
Now... the limits of what other people can do is significantly less restricted, they just can't do it on behalf of the landlord or property owner.

YOU sign a lease with the owner, then move into the house and just be a total jerk. Loud music at all hours. Multiple cars parked in the driveway blocking their vehicles if possible. ANYTHING that is annoying? Do it. If the cops get called because of noise, generally if it can barely be heard from the outside they don’t care.

Rent your mom’ room, and any other space, to a new tenant. This new tenant will be someone you’ve hired who will make living there absolute hell. The new tenant will have a rental agreement, so if the cops are called he can prove he’s a legitimate resident.
The squatter won’t have that. And if he doesn’t have any other documents showing he lives there, his stay may be short.
But the goal is to make him leave by smelly cooking, loud noises, etc. There are actually people who do this counter-squatting for a living. Good luck!

I’ll do you one better though, my boyfriend has an Aussie who is on anxiety meds and still whines 24/7 and screams when anyone leaves the house, even when they’re coming back in five seconds and he can still see you.
He also won’t leave you alone, worms his way right next to you on the bed and couch, rakes you with his claws if you’re not paying attention to him, and literally grabs your hand away from whatever you’re doing and pulls it to him to make you pet him, and won’t stop until you do.
He’s wearing the donut of shame right now because he won’t leave a cyst on his tail alone and has no special awareness, so he regularly barrels past you and knocks you over with said donut- he also does this at the top of the stairs and just broke my favorite coffee cup that way because I was trying to leave the house and he got upset and ran out while I was in the doorway.
He’s a freaking gobbler too and will eat any food you leave out, even a box of dry uncooked pasta and raw pizza dough, and then you have to make him throw it up because it’s always really bad for him. He has a sensitive tummy too, so he’ll randomly get diarrhea for 24 hours and shit in the house, and if you’re really lucky like I was, on the fucking bed.
He and my well behaved golden leave a whole dog’s worth of fur all over the house on a weekly basis as well, and it needs to be vacuumed every day or else there will be tumble weeds rolling around the house.
And then there’s the attack cat…
We love our pets, but I don’t think that my boyfriend and I would even have to do anything in order to make this man move out lmao.

Biker heard I was having trouble collecting money from a general contractor. He offered to pay a visit to GC with me. My bro-in-law suggested I take him up on it. I took the biker up on it, he came to GC’s office with me.
He just stood with me in the lobby while I asked the receptionist about picking up a check. GC owner comes out front & stops to stare past me at biker. GC says “let me call accounts payable about your check.” 5 minutes later I left with a check.
All it cost me was buying the biker lunch.
This biker ended up renting the place from my bro-in-law for a few years after chasing the squatter out. Great tenant & good neighbor.

This actually WOULD work, except you've got to demonstrate an escalation of threatening behavior to get the restraining order. I had a roommate/LL (I was a subrenter technically? She had an agreement with the house owner) who was legitimately nuts. She became physically abuse and I got a restraining order. It was served by the police who forced her to vacate and could not return until I'd moved out.

Don't annoy the tenant(s) into leaving with stuff like loud music, smells, and such things. The tenant will leave eventually, but the house will be wrecked. Also, you or someone else will need to live there during the while process.
No, annoy them with promises instead. Know that you will need to fix up the house after they leave, even if they don't purposely damage it, so you can sell it. So, get a headstart on the renovations! Just don't finish them. Leave the cabinets on the floor, since you may need to repair the finishing. Remove the carpeting, since you will need to replace it. Tear up walls, since you may need to update the electrical to be at code. Start repainting. Remove a toilet because it has flow issues. Etc.
Be nice to the squatters, promise them that you have to do renovations to eventually sell it, so they will get to live out the rest of their time in an updated house. Tell them that you cannot wait until they leave, it takes time to fix it up real nice and you need the money as soon as they are gone. They will WANT to stay, obviously, and will put up with a lot of crap and bullshit in the hopes of a nicer house for free. But, NEVER FINISH until they are gone. Make up excuses.

I would proceed as tho you are selling the house. Clean the house out. Remove everything that could bring comfort & that doesn’t belong to him, including the furniture in his room if it was there before he moved in. Stop supplying food. Remove pots, pans, etc. Make it as uncomfortable as possible. If you have work that needs to be done on the house, have the vendors there as soon as local ordinances allow like 7am.

Disconnect the Internet and cable. Hire a packing company to pack and remove whatever your family owns all in a single day. Dishes, pictures, lamps, furniture, towels, everything that "you" own. You would need to clean out stuff anyway. Ask the attorney about turning off and removing the hot water heater, "for safety". Same with the gas stove.

How is this any different than just finding a house where the owners are away, then moving in and being like "Hey it's mine now."

No one mentioned this ever in these ULPT posts, and as an ex Airbnb super host of several properties, it is a good one: Make a listing on Airbnb...or several, like booking etc, renting out the rooms-and for CHEAP, adding that there's one occupant there to be clear. MAKE MAX rental period like 3 days by using tools. Once you have 12x people coming in and out monthly, or 24x if you rent 2 rooms...with such a zoo, they typically leave within 2 months 🧐☺️😂😂😂 Far cheaper than any lawyers, and trust me, NH where I am has some of the most absolutely ridiculous tenant protection laws in the country!

What about turning off the power, gas, and electricity? You're not their landlord, there may be no legal need to provide them with utilities. Make it miserable for them to live there.
I would shut off all the utilities and start renovations. Bring in a generator (you can rent them) for doing your work. Rip out the bathroom, demo the kitchen. Move out all the furniture.
You've got to be careful though, talk to your lawyer about what if any kind of surveillance you can put up. My father-in-law bought a house from the bank as a foreclosure and it was a similar situation as you. The squatters were legally removed eventually, but before they left they absolutely destroyed the place. I mean willful destruction. They took a slegdehammer to the toilets and tubs, ripped out all the light fixtures, ripped out copper wiring, tore cabinets off the walls and broke the doors off the ones they couldn't tear down. They smashed holes in walls, gouged the floors with what looked like a screwdriver, and basically made the biggest mess possible. My FIL got a great deal on the place because everything needed to be repaired.

I don't understand how these situations arise. If you own the house just go in there and remove them. I know there are laws protecting tenants and states have different "squatters rights" but don't they apply the same to anyone? Just go in there and start squatting yourself. First and foremost, will they keave if you pay them? You can often aue after the fact for damages, but even if not abke to cikkect this is usually cheaper and faster than any other option and they don't take an eviction on their record.
If not, call the police on them so you can document yourself as the owner and them as squatters. The cops will say it's a civil matter, so call them out for a trespasser in your home to ensure they'll show up. They are now witnesses and you have a police report to serve as proof that they were there on that day and refused to leave.
If you plan on renovating, go ahead. They arent tenants, so work around them and move their stuff out of your way. Remodel whatever you're going to remodel. Don't bother cleaning up every day. Grinders in plaster will make a space uninhabitable and might be a bit extreme, but I sure would be tempted. I'd also restore all of the doors. All at once. Somewhere off site.
Try to get them to sign a lease. Some people are dumb enough to do that. Then you can evict them as tenants, not squatters, which can be faster in many states with ridiculous laws.
Lastly, F it. Sell the house with them in it. Rental developers arent too picky if you're just going to sell it as an investment property. They'll often buy it anyway and then it's not your problem.

It's hard. Centuries of really bad and dishonest landlords made tenant rights a very sticky stake in the ground to remove quickly. I have personally, and have had friends, go through the same process. You have to have written notice to leave (the required time varies by state), then if they don’t leave file an eviction/unlawful detainer case in court, attend a hearing, and obtain a court order for removal. Only after that can law enforcement carry out the eviction if needed. It generally takes about 1 to 3 months once you include notice period + court scheduling + the sheriff/constable actually carrying it out. If contested or delayed it may be 3-6 months or more, longer if the person fights it, asks for continuances, claims a defense, or if the court is slow and backed up. In bad economies (especially during COVID), I have seen it take 8 months to a year because the courts are packed, and the sheriff isn't always there to do eviction procedures right away, and often cancels last minute with "well, didn't get to you that day, reschedule."

The key word is tenant. This IS a tenant. In fact they've lived there for 10 years, if they paid taxes or solely cared for the property they can claim squatters rights to take ownership. The more a property owner does the worse off it is when they get to court. They won't make this mistake because they've already talked to a lawyer, but others might.
No one said the OP is paying for utilities, but if they are and turn them off it's illegal. If there's no lease most places defer to considering it month to month rental after 30 days. When that's accurate, proper method is 30 day notice to evacuate and if they don't leave after 30 days you can file a legal eviction in court. In this case the lawyer has already told them this could take 6 months so it's NOT a case for default month/month agreement and is likely a squatters rights case. But regardless if someone has been living somewhere for 30 days they are a resident not a squatter.
Calling them a squatter and using illegal tactics gets you arrested, and or sued in court. I've seen it and a Google will tell you this. In NYC if a resident has been there 30 days they're a tenant. You can only evict squatters in the first 30 days.

I know what sub this is, but I want to make very clear that depending on where you live, messing with a tenant can have a worst case scenario of you losing the property entirely or going to jail. Tread carefully.
Some squatters rights are very strong and the reality is, you let him establish a 10 year residency and that has power. It should have been dealt with, with at least a lease agreement back then.
Your best bet would be some legal loophole like if the place becomes temporarily uninhabitable (through no one's fault.. wink wink) or jurisdictions where you can evict if you are going to reclaim the property for personal use, etc. but your lawyer will know best what is or isn't allowed where the house is located.

They are probably going to force you to go through the formal eviction process, and yes, this can take some considerable time.
I believe a restraining order could help, but a lawyer will know best. I don't think they are paying you anything as squatters, but just in case: whatever you do, don't collect rent from them once it's been communicated that they are expected to leave. If you are pursuing eviction, it starts the process over (takes much more time) each time you collect rent from them.
I know you said their exit needs to happen soon, but knowing the NYC process, it is best that you have a contingency plan, in case it takes 6 months to a year to get them out.) A lawyer will best advise on a realistic timeline that this has to go through eviction court.

This happened to me! In PA. A little different because my Mother died, had explicitly stated in her will that her gentleman friend could not continue to live there (long story.) He wouldn’t leave, all the beneficiaries agreed he could continue to live in the apartment year to year if he paid for apt costs. The estate lawyer started a lease, but soon we realized he wasn’t paying…and he wasn’t leaving.
Here’s my tip: It will take 3-5 months by a lawyer and it can be done 100% legally. I asked a friend who was a real estate broker to ask her team for a lawyer who specializes in ejections/evictions. You need to ask a Broker and get a recommendation, don’t look on the web. I found the perfect guy with a 100% success rating (Sadly he’s in PA, Not licensed in NY) I was skeptical, but he blew my expectations out of the water and their public defender was strong. The only crap thing that happened when the Gentleman was moving out, is that the came with his 300 pound kids and grandkids came from Camden,NJ with a UHaul and cleaned out the apartment on a Sunday. By the time the security guard who knew what was up, came on duty @ 6pm on a Sunday, then called the cops, they were already pulling out. The only things they took of value were a wonky but authentic Renoir drypoint and an Elsa Perretti Yards of Diamonds necklace. They cleaned for me (kind of.)

Just dealt with this in NYC. It took a year once formally started and council retained.
Served 90 day notice > wait 3 months > process for drafting up contract where we pay for them to leave and getting them to agree to it (they dragged ass) > they violated contract > we tried to take them to court for that (impossible, gets delayed, etc) > court dates between lawyers (getting in front of the judge / on the schedule takes a month each time, can get delayed just because they ask for it, that’s another month+ each time)…
The NYC court system is set up to be very in favor of the tenant, whether they pay or not. Your lawyer isn’t going to be as useful or thoughtful about it as you’d think, though every email will cost money. Ours made mistakes, and we paid for them. They’ll get a free lawyer (NYCHA, which is very competitive—the defense lawyer was leagues more capable than ours).
See if you can buy them out for something “reasonable” to get them out asap, don’t pay them until it’s an actual key exchange and they’re fully gone, make sure it comes with a signed contract that will stand up in court. This cost us \~30k (and was long and miserable), and sounded to be on the faster side. Legal fees, lost rent. We had to work more to cover it plus the mortgage. It was stressful.
At the end, they had been already been moved out for over a month, left a bunch of their shit, we had to pay to have it removed by the Marshall (we could have gotten a moving company to do it for less, but would have had to store it for a month, and then there’s a legal process for disposing it). Another 3k down the drain for removal, another month to wait after judge ruled in our favor and the Marshall was able to post the notice.
I think the only real ULPT’s are making them miserable at home legally. Noise, smell, etc. Don’t mess with their utilities, look up the laws. Cameras helped (we caught them smoking on the property which was against the court stipulation we all signed to get them out, for money, while they squatted and didn’t pay rent for a year). That stip that the judge signed, with points of agreement was the only legitimate legal document we had that cops would look at until we got the Marshall’s notice (they called the cops, they did things like removing the outlet covers and fire alarms and calling HPD to get violations for us… very little recourse).
We’d maybe have been better off swallowing our pride and giving them a cash deal up front to leave in a couple months (maybe $10-15k would’ve done it and saved us $15k-20k?). Who knows.

They try and return and the locks are changed. Call the police that the evicted tenants are trying to return and the police will come to oversee them gathering their items. File a restraining order. I read about a guy in CA who will move in for a fee and make people like that miserable enough to move out. CA law is so tenant friendly, that it’s incredibly difficult to get rid of squatters.

Get a person in and as soon as old mate leaves to the shop or whatever change the locks. He can call the cops but he doesn't have a lease and they do, he can get a bag of clothes and go to hos kids place, you can then put all his stuff in a uhaul and send it there too, problem solved.

I would hire the squatter hunter Flash Shelton or a similar group that has a lease and becomes a civil issue for the current tenants so they would have to take them to court. Someone who makes a mess, eats all the food, is super loud and has parties every night. It’ll get them out quick.

Cut off all of their utilities if possible. Or lock them in so they can’t get out. Or go live with them and be utterly obnoxious: naked all the time, watching scat porn and gore on the biggest tv you’ve got in the place. Leave rotting food everywhere. Stink bomb the place. I've seen squatter houses where they shut off the utilities. These people ended up shitting all over the bathroom floor after the toilet filled up. They then ended up destroying the whole inside of the house after this, ripping out all the copper. Some of these squatters have literally nothing to lose.
