5,000 lbs overweight in California. What's the penalty?

Just had a buddy call me in a panic. He is overweight 5000 lbs on the rear tandoms. Overall weight is fine. What can he expect? Fine, points, what's the penalty for this?

Depending on how high the fine is, i would hire an attorney to review the case for my chances to sue and have the shipper pay the scale fine. Something over 2,000$ is enough for me to get the case reviewed.

can you even slide enough to make a 5000 over legal? Even with trailer axles fully back and fifth wheel fully forward?

the reason everyone here is talking about sliding is because you cant slide them back much in california, in that state kingpin to the REARmost axle has to be 40 ft
three guesses how often the dot cop goes out there with tape measures or whatever but hey, people can eyeball that sort of thing within a couple feet once there familiar with this sort of thing, not rocket science. so yeah someone whos over by 5k is just gonna have to bend over.

I'm paranoid bout that shit now. Was struggling to get up hills to the nearest cat scale after picking up a loaded trailer and was cussing at the loaders. 100% sure they loaded me to the gills and was just gonna get the scale proof to turn around and get them to fix it. Late at night.
Suddenly another truck flashed at me and pointed to the side frantically so I pulled over. Set brakes. Got out to check what was wrong, started walking back, now I could see the smoke billowing from my tires and smell the burning. Ran back to my truck and undid the trailer brakes.
Nah, turns out one of my trailer brakes was stuck down, shit was apparently glowing, guy said it looked like it caught fire, someone called the fire dept. They came out and sprayed it off. Called roadside and they got it fixed after I sat there for an hour. No ticket or nothing. Never seen that shit before. Scared the fuck out of me. Just needed adjusting.
Wonder how the fuck that happened, it was a drop trailer that got loaded. How did it get there with that problem? Couldn't have right? How did it spontaneously happen? Lol.

Rust, not greased properly, the slack adjuster no longer adjusting, etc. The first 2 are more gradual failures, but the last one definitely could've been a situation where it worked fine until it didn't.

Personal experience here... embarrassment. They just make you slide the tandems and get the weight as close as possible to be road legal and your off. No points, no citation, nothing.

You really cant slide your tandems 5000 in CA. I think about 1000 is the most you can get away with legally. In the future, its better to slide your tandems in CA to make the load legal, than to hit the scales and be over 34k. The scales never lie, but the scalehouse might not be paying attention if your axles is back a few extra notches ( in CA at least)

You can't slide your tandems that far, but you can slide the cargo. Hammer down get her up to 40ish and yank on the condiments. If you don't flip your trailer you should be alright.

Yeah, I think 2 notches legally, and 4 its hard to tell so you will get away with it. Its all about the scale, and when they weigh you, thats 95% of the time when its checked

I’ve slid my axles to at least 43’a couple of times to get a legal weight in CA and gotten away with it but only because I was feeling lazy and didn’t want to take the time to adjust my load.

Use i40 and avoid the scale near mojave or use i15 to go to LA , it will close at night sometimes but if you are going to LA then you are cooked using i10

For me, 6 years ago it’s $1 dollar a pound over at the Banning scale. Company paid for it.
I was 2k over on tandems, lowboy moving trailer, so I couldn’t slide the tandems or else I would be over on bridge law.
I had to have my company bring out a second trailer, offload the weight.
It was 2 points on my record, they fell off after 2 years.
