ULPT request: getting fired for performance soon, could I apply any brakes?
Posted by a203040@reddit | UnethicalLifeProTips | View on Reddit | 49 comments
I’ve been invited to an HR meeting to evaluate my Performance Improvement Plan (PIP) results. I contested both the PIP and the probable results, so I will most likely be terminated. Would it make sense to call in sick, request a leave of absence, or anything else? Open to all ideas.

When this happened at a large company I used to work for many times people would get their Doctor to write them up for medical leave due to stress and mental health issues. It usually worked like a charm because the person would leave, come back. then repeat the process as soon as they were eligible. One person did it so many times they quit writing her up, and when she applied to transfer to another state her current boss gave her a glowing recommendation and she got the transfer. She would up being put in PIP again a couple of years later and off on leave she went. She had a lovely house with a pool and spent her days chilling by the pool. I think the company eventually got to the point they were afraid if they fired her something bad would happen to her.

Im a supervisor and this is what my employee did.
I caught him sleeping on the job, he went out of his way to hide. Had a blanket, pillow, eye mask and everything.
I also caught him working on his own company on my time dude hade a small business
He had a history of issues, awful employee. The day I caught him sleeping he to his doc and applied for a loa and short term disability. Got a few months paid off. But the day he returned I fired him, he claimed retaliation for his loa but the his documented history made that an easy argument.
I like having loa and disability benefits but fuck people like that who take advantage and potentially ruin for all the people who really need it.

I have a coworker similar to that, where they are such a squeaky wheel and rule shark that everyone is hesitant to retaliate on the chance he pulls out some dumb obscure ruling that allows him to sue.

You do realize which sub you're in, right?
bucknuts89@reddit
Shit, I'm about to apply for a LOA soon just because I read this
UserNameChecksOut86@reddit
Have your tried not being a piece of shit and actually fixing yourself and taking accountability?
Fearless_Log_8225@reddit
Go see a psych doctor (NP) or whatever, tell them you’re depressed and need a FMLA form signed so you can stay home from work for 12 weeks, file for short term disability, ???? , profit.
snow-raven7@reddit
Where is the venerated piss disc?
HeyHo_LetsThrowRA@reddit
In the envelope with the FMLA hard copies.

Pick up something heavy on the floor that is related to your work and throw out your back.

I did this unknowingly and i realized 2 years late that it was a work injury and i could have gotten time off/compensation for my medical bills. 😭😭😭

You know when I was a young man the age of like 20 I worked in a poultry plant in a room where I would stack boxes of frozen chicken on wood pallets and a forklift would take it away. The line never stopped and sometimes it took 2 ppl and extra pallets around the line to keep up.
We had two stacks of empty pallets on each side of us so when they took the full one we would replace it with empty.
There was a night it was stacked about 4 pallets above my head and way higher than normal.
I stood on a little step ladder (2 steps all it had) and grabbed the top and jerked on it (lul) to pull it down and it was on a upside down pallet and got stuck but only after about 10 inches of movement and I really fucked my back hard.
That night I went home maybe an hour later but feared retaliation and punishment because it was a pretty shitty job and the company really sucked and high high turn over. So I told them I was just unwell and went home took pain pills I had from dentist appointment back then my dentist gave me a pile he didn't give a fuck so I had a bunch left over for months.
To this day almost 20 years later my back is absolutely fucked and I wish I had mentioned it then because years later someone got hurt from a stack of pallets being high sued the company won and the company made very strict rules about stack height.

Get on FMLA for job protection and SDI. Depends on how conservative the company is in terms of risk because if the pip results have already been evaluated and they’ve already decided to fire you, then they can legally still do it.
clintnorth@reddit
Maybe stop sucking at your job bro
DoctorDownvotesDelux@reddit
Or maybe stop making the job suck
SpecialEmployee5882@reddit
May be to late for a loa, you would probably be terminated by the time you get in to see a doctor and get all the paperwork submitted.
You could just call in sick and start burning up any sick time/pto you have (assuming you won't get that paid out upon seperatipn)
Sounds like its game over though

We could prob give all sorts of ideas if we knew wht the job was or what industry were talking abt.... but you didnt give us anything to work with not even a timeline

Aquire a sample of your bosses piss and put some piss discs somewhere that would inconvenience YOU. Then blame your boss for harassing you, demand a DNA test on the piss to prove he did it to you.

You should have been documenting everything for months if you wanted to win this fight. It's over, move on.

Talk to an employment lawyer. The details of the situation might present some leverage.

Send out a company wide email "on accident"...
"Hey Bill, I've been reading up on Unions lately and I think they'd be really great for our job. It would be good to have the protections they offer. Ill be reaching out to a union rep soon and see if they'll work for us."

That's brilliant

I would start sending out resumes.
If you really to stay employed at your current job, you would have asked weeks ago, "How can I pass my performance improvement plan, without working any harder st my job?"
By missing the pip meeting you're just delaying the inevitable.
BoredBSEE@reddit
However, that IS the request. OP wants to delay the inevitable.
Jourbonne@reddit
Unethical? Have you seen fight club? The scene where “Jack” attacks himself to make it look like his boss physically assaulted him is highly unethical.

Getting drunk and coming in would help.
Embarrassed_Flan_869@reddit
Dude, it's over. Pushing off the inevitable.
Unless you want to go nuclear and hire a lawyer and file a harassment suit. You wouldn't likely win but you could make everyone's life more difficult.
Or, when in the meeting, shit your pants.
breakfastbarf@reddit
Bonus points if they have to throw away the chair
FlowerComfortable889@reddit
Definitely shit your pants while bombarding everybody else with piss disks. This is the only answer
Convenientjellybean@reddit
If is certain just use up all you sick leave and don’t do any handover
But it’s it certain?
APuckerLipsNow@reddit
File a grievance per your employee handbook. That will make them unable to fire you until it is settled, and should guarantee unemployment compensation.
StrikeSea7638@reddit
No.. those won't stop you. Being an alcoholic would prevent them from firing you for now.
FreezedPeachNow@reddit
Go out on FMLA

Show up drunk or high and tell them you have a problem and need rehab
