Company sent me to Cali with paper logs because the new eld system hasn’t been installed yet and u guessed it I get pulled in for a level 1 inspection and get 2 HOS violations for not having a ELD mounted and not having an ELD while interstate she didn’t write me any citations or place me OOS but said if they catch me one more time with paper logs I’m done. Company said I should drive back to Phoenix without an ELD cause they probably won’t pull me in twice. 🙄

The app is only part of the product. The other part is plugged into your truck. That’s how your truck gets linked to the app.

I only know about since the part that is fixed to the truck caused my app to be non responsive. Then I had 7 days to get back to HQ to have it replaced.

Not what’s going on here. Driver hasn’t had ELD installed in their truck. Only trucks with engines manufactured before 2000 are exempt from running ELD’s. All else must have them installed, no exceptions. And mounted as well. You are still required to carry a paper log book and it is its own separate violation if you don’t have one. Reason being is if your ELD breaks or malfunctions you need to be able to keep logging your activities. In OP’s case, they would have been fine if they had an ELD and it was mounted, but it was malfunctioning so they switched to paper log book. Running on paper logs is and would’ve been fine for OP under those circumstances. However they didn’t have an ELD at all. And they were in a new enough of a truck that they were required to have one. The company was wrong to tell OP to take off in a truck that was illegal to operate and OP failed to say no I will not drive a non compliant truck. Same thing as a company asking you to drive a truck with brakes that are out of adjustment.

You can literally run in any state on paper logs and no ELD with no fines or points for 8 days out of a rolling 30 day period, so something doesn't add up.

How come no eld?... Full compliance started Dec 2019. I'm not aware of any sort of exemption for interstate trucks. I belive you are required to carry paperlogs in case of eld malfunction.

I started with this company Thursday they said they’re transitioning to a new eld and some trucks don’t have one so we have to use paper logs, this came from the safety manager.

They absolutely will pull you in twice. Your only chance is to try avoiding the scales. If you’re going to Phoenix, I’d guess you’re running across 10. Avoiding the Banning scales can be done, but it takes hours and is a real PIA. Where is your starting point in California? It might take some heavy out of route miles, and timing is key, but it is doable.

Your company doesn't care about you or your driver's license. When you lose your driver's license they lose you as a driver and they will get another one. And now you've taken on CSA points that go away when they fire you. And there's a whole bunch of people looking for work that have a CDL. You are disposable. You are meat in the seat and you are steering wheel holder. To your company you mean nothing. The only one that can protect you is you.

Yeah afaik not having an eld physically in your truck is a big nono for interstate. Paper logs are only for if it breaks, and need to get it fixed ASAP, no more than a week. Might be able to deadhead to get it put in, but Phoenix would be risky, probably dealer or something nearby. Kinda get the feeling if they were willing to send you out without it in the first place though theyre not going to want to do that.
