Based on the body language, this big ol friend was genuinely curious about the boat and the people on it. While yes, you shouldn't touch wild animals even if they come up to you [lookin at you, manatees], this whale was very obviously being friendly and inquisitive!
TLDR, if the several ton behemoth didn't want to be there, it wouldn't have been there.

This is why TV companies like BBC have just invented a camera that looks like dung and can roll up to elephants and drop little bits of dung mini cameras in place. We don't want elephants to think we are their 'friends' because 'we' as a species, are not. Whale tours are simply not good for whales. Why do you ask what should they do? Like we have a right to visit animals that we slaughter and eat, and use as products?
What you should do is pay money towards marine charities that are trying to restore marine biology and animals. You may have seen, also, nature photographers also follow the code. Even when a seal pup is crawling up to their boots and looking desperate for a stroke... The photographer refrains and simply films it. This is what we should do.
Conservation and preservation of nature requires that we leave things alone and don't get involved. Animals are not to be used as entertainment and every whale that you teach to come close to humans is a much more vulnerable whale. They are already under great duress and attack thanks to the increasing noise we are making in their home environment and pollution as well as killing.
Wild animals that get too comfortable around humans are at higher risk of injury by boat strike, or by malicious people. Look up famous examples of friendly wild cetaceans, a lot of those stories end badly.
