Make passing a field sobriety test a get out of jail free card.

so currently legally theres no reason to ever take a FST because lots of sober people fail and even if you pass tge cops can just demand a breathalizer so my idea is if you pass a FST you are ALWAYS free to go (even if for shits and giggles you take a breathalizer and blow a .25) this does two things
incentivises people to actually TAKE a FST
deincentivies cops from GIVING Field Sobriety tests

Only applies to DWI, DUI ect (driving in an altered mental state) and the card lasts 12 hours

Nobody can pass a FST, it's designed so that you fail. I was a juror on a DUI case and the cop demonstrated the balance test for us -- he lost his balance.

It should be federal law that all FSTs should just be the cop getting into your passenger seat and making you do a mini driver's test.

This is crazy because it doesn’t take into account many ways someone can be intoxicated. Just because you blow no alcohol doesn’t mean you’re not on weed, LSD, shrooms.
So you might literally get a case where someone blows no alcohol, gets off, drives away, rams into 3 people while high on LSD, and then it comes out that the cops had this person pulled over and let them go because that’s the law.

Though am I wrong in thinking it incourages people who are drunk (drunks are short sighted) from taking a FST if the alternative (a breath test) they KNOW they will fail
But they think they MIGHT JUST pass a FST (which saves time and money for the test machine and time for the officer)
With the caveat being every once in a while a super drunk will pass and the cops have to let him go

Oh wait I had misread this a little bit, FST in lieu of breath test. I kind of lumped it all in in my mind.
Interesting. Well, of course I don’t think it should be implemented, but I feel it is less bad of an idea. If you’re able to fool an officer who already suspects you of being intoxicated…

First of all this is crazy ideas. Second of all, what point are you trying to make? If they pass the test and blow zero while high on LSD the cop still has no reasonable suspicion to arrest them.
