ULPT Request: Someone please tell me how to get my money back…

So I ordered a phone that was supposed to be brand new but it wasn’t. I talked to the guy who sold it to me about it not being brand new and he told me to send it back.
I sent it back via FedEx and FedEx lost it. Now the guy says I don’t get my money back if he doesn’t get his phone, which I understand.
I didn’t put any insurance on it because I’ve never had a problem with shipping before.
The phone cost over $1k so what do I do now to get my money back?

you always have the option of issuing a chargeback for the phone transaction, however you likely won't win it.
in any case, you'll need to provide proof.

You *could* chargeback since you received a different item than described.
But it's going to be really hard to win that as you have now lost the evidence and the seller made a good faith effort to remedy.
Could sue fedex, I guess. Best of luck.

FedEx default coverage is not traditional insurance but a limitation of liability that covers up to $100 per shipment for loss or damage at no extra charge. You can claim $100 for the lost shipment. That's it. Buy insurance next time.

Chargeback fedex ? Corporations have entire teams in charge of keeping documentation and following the book specifically to avoid losing a chargeback claim. This sucks, don’t get me wrong but fedex loosing packages is so infrequent that without proof (eg insurance/tracking) it is essentially your word against the billion dollar corporation that has a 99% track record of not loosing packages

Nope, not a chance. You can't charge back the seller when it's FedEx that lost your phone.
Always insure your packages for their actual value.

You need to take it up with FedEx since they allegedly lost it. They have tracking info for all of their shipments so they should be able to track down orders on their end.
Pretty sure they have insurance on their deliveries, so you should come out pretty well.

Yeah, I did contact FedEx and they said they have no clue where it is.
She also said I had to pay for insurance. Since I didn’t pay for insurance then I get nothing back.

Tell them they lost your item and you want it replaced, otherwise small claims your local fedex for the amount lost.
