Company just called and told me to remove my personal dashcam immediately.

So I run a personal dashcam in my company truck strictly for my own protection and so I can have access to footage immediately in the event of an accident. My company found out and asked me to remove it for “liability” reasons, but I’ve reviewed our company handbook and there’s no such rule barring the use of personal dashcams in there. It mentions nothing about personal dashcams at all. What should I do in this situation? I wanna run my own cam but also don’t wanna be fired for insubordination.
Beneficialsensai@reddit
Because yours can make them liable.Theirs cant unless they submit it.Lawyers have fugured out ways around them.
Shallow-Thought@reddit
Ask them to clarify what they mean by liability. A dash cam running off a 12v plug doesn’t pose any risk to the truck.
My guess is they’re worried about you posting an incident on social media and messing with legal/insurance proceedings.
Moist-Ad9272@reddit (OP)
This is probably the reason tbh
Dragon_Lawyer1985@reddit
My question is, how did they find out?
Imcyberpunk@reddit
Maybe they were performing some regular maintenance and saw it
Dragon_Lawyer1985@reddit
I'm that case, my advice would be to treat the truck like you're a slip seat driver. Bring the camera with you in a bag. Sign in to work, set your camera up the same way you would a GPS, if you're doing anything that requires maintenance, or time at the terminal take it down, throw it in a backpack, and run it anyway. If they fire you for it later get a lawyer. I used to work for Prime Inc back when I first started and they don't allow firearms in their trucks,, guess what I had in the truck all 4 years I worked there.

A trebuchet?
bidkar159@reddit
A trebuchet? Cute. Let me know when it can fire more than once every business day. Catapult on the other hand has consistent output, no drama…exactly what you need when some crazy person walks up to you.
Hal-20@reddit
Listen.. we're not firing you for having the trebuchet.. or catapult... whatever tf it is.. we are a flat deck hauling company... and your whatever tf that is. Is taking half the space...

That too but as an example I ALWAYS record my phone calls, right after the recording states "this call is recorded for _ purposes" when someone answers I tell them "I am also recording this call for _ purposes.
Hal-20@reddit
One nice thing in Canada, is that any directly involved party can record voice or video(provided video is not sexual/X rated) without the other party's consent. It's only illegal if you are an uninvolved third party.. unless you are in a public space.
DFA_Wildcat@reddit
I don't bother telling them I'm recording. My recording is going to have them telling me they are recording. If it ever went to court they are going to have a difficult time convincing a judge that I was illegally recording something that they, themselves were recording.
robexib@reddit
The funny thing is that, half the time, that makes them hang up.
They'd have no reason to hang up if they're not doing anything sus.
yeChevok@reddit

Beneficial_Sock8219@reddit
Simple advice..Have an extra phone and always use it as your dashcam because your company won't know.I do youtube content about my trucking and I feel incase of any road incident,my phone recodings can help me. At end of everyday you can erase the videos for space.

Hire an Attorney or comply is about all you can do. arguing with them is pointless.
amelkov89@reddit
Don’t do it you have a right to your personal dash cam.
Quick story:
I got into an accident in Dallas where a car rear ended my trailer everything was cool we exchanged information as the officer stated at the scene and company told me to do that. Week goes by the company I was working for at the time called me telling me the guy claimed I hit him to the insurance and that they didn’t have the dash cam footage from the truck I told them no worries I have my own footage from that incident and sent it over. Even though the company had their own dash cam… I would’ve been screwed had I not had my own. Don’t trust the company to ever have your back in any scenario.
CWhisper@reddit
Clip a gopro to your hat and keep on…
timbocf@reddit
How do they even know about it?
Moist-Ad9272@reddit (OP)
I was involved in an accident and placed at fault. I submitted an appeal with our safety dept including my dashcam footage clearly showing the other person driving into me. The ruling was overturned but they asked me to remove my dashcam as a result. It’s sounding very scummy the more I think about it…
Gilgamesh2000000@reddit
I would not comply and keep all the emails. Let them fire you and then sue them for wrongful termination.
JustForkIt1111one@reddit
Are you able to cite the federal aw that guarantees you the right to run a personal dash cam in a company owned vehicle?
I would not work there for sure if I had the experience that ppl had, but I don't think there's anything you can sue for there.
Gilgamesh2000000@reddit
If someone fires you for a wrongful reason. You can sue. It’s why large corporations don’t fire anyone for bullshit. They also don’t want to pay unemployment.
NerderBirder@reddit
If OP is in a right to work state suing wouldn’t do anything. In those states anyone can be fired for any reason a company wants.
Quelix_@reddit
I think you mean at will not right to work. It's one of the few things about right to work that i like: they have to provide a reason for termination. The flip side of this that I've also had to deal with being on the company side is it is an absolute PAIN IN THE ASS to get rid of someone that needs to be fired.
JustForkIt1111one@reddit
Yeah, but the reason can be "business needs", or even "I don't like them". I've seen both.
Quelix_@reddit
And the second one would be grounds for a wrongful termination suit.
NerderBirder@reddit
Oops, you’re right. That’s what I get for not proofreading, lol. Thank you!

Gilgamesh2000000@reddit
You seem bored. You’re going to have to pay me to text to me from this point on.
Mistresshell@reddit
It’s not quite that clear cut. There must still provide a reason for the firing and there are many situations where you would have a case for wrongful termination, such as retaliation. 30 years living in Florida by the way
Quelix_@reddit
Retaliation in an at will state is VERY hard to prove. In these instances, what no one realizes, the burden of proof isn't on company, it's on the individual filing the lawsuit.
ChaseJulien@reddit
Scummy is letting them off easy. They tried to pin it on you and would have gotten away with it had you not looked out for yourself. Disgusting behaviour. Prediction, this won’t be the last time this company tries to screw you if you continue to work there. Name and shame and continue to look out for yourself.
StolenRage@reddit
Also quietly spread the word to other drivers to get a dashcam installed, yesterday.
JustForkIt1111one@reddit
This. Loudly tell all the other drivers what happened on your way out the door
timbocf@reddit
They have their own dashcam and still placed you at fault for somebody running into you? Did they even pull the footage?
Moist-Ad9272@reddit (OP)
I have a strong suspicion they didn’t. The way the police report was worded made it sound like I was at fault so that’s probably what they went off of.
pattop@reddit
Why would they not want to clear you? I mean, your accident affects them too.
AcanthocephalaNew791@reddit
Because he is replaceable with somebody that would be cheaper.
pattop@reddit
Sucks
Moist-Ad9272@reddit (OP)
That’s what I wanna know. Like bro I have evidence that can have the liability taken off of us and onto the other person. Why would you not want this??
Wavelength1335@reddit
The trucking economy is a bit of a mess right now. They might be looking for an easy excuse to thin out their driver numbers? That or your safety dept COMPLETELY dropped the ball in not pulling the footage, that came back to bite someone in the ass and that someone is now butthurt. Lots of petty childish ppl in management in this industry.

warpedoff@reddit
did they ask you or tell you to remove it, big difference
LividImagination5925@reddit
then that's the reason you should not remove your own Dashcam. you could justify that incident as a reason why you shouldn't follow their order of removing your own Dashcam
TomClem@reddit
Stick with this as the reason you won’t remove it. Had they used the video from theirs to properly defend you there might be motivation to trust them, but they lost that opportunity with the choice they made. I hope your next carrier is better.
Illustrious-Girl@reddit
How in the world are they not thanking you for having the dash cam for this?
How dare you protect yourself from false claims!
0263111771@reddit
Along with what others said, any emails they sent you saying to pull the camera after the incident you need to save.
Furthermore, i would demand to know why they did not verify the accident for themselves from their own cameras. Right there tells you they will let you burn without a second thought.
JOliverScott@reddit
So the exact reason you have it is the reason they want you to remove it?!?
grumpus_ryche@reddit
Fucking hell. This highlights exactly why you should have that camera and tell them to pound sand.
Or just hang on to that communication, say nothing more, and keep running that camera anyway.
Critical_Opening_526@reddit
"You caught us pinning blame on you. Please remove it"
1st_sailonsilvergirl@reddit
The reason is legal. Liability. The discovery process if there's a crash. Everyone responding with flippant comments doesn't understand the problems here.
The longer comments that give insightful info about discovery, and legal issues the personal dashcam introduces, those comments explain the reason.
Your employer has the right to ask you to remove the personal dashcam. Look for another job if you must, but the employer is not the problem. Any trucking company has a right to ask this. They're trying to protect themselves and you from our legal system. Rightly or wrongly. It can cut both ways.
SlothyTendecies@reddit
They could suck me off. I’ve been involved in an accident where my companies camera wasn’t working and I had no idea, but thank God I’ve always ran my own. I was found not at fault only because I HAD MY OWN. I’d turn that truck in and be on my way to a less shady company.
GenX_Leo@reddit
Find another company, they just told you they are shady with out saying it... take the hint...
Shinneman@reddit
Get the trucker gps with camera
kimagain@reddit
I suspect their insurance policy prohibits personal cameras. Your having one risks claims denial or even cancellation. I imagine that's a very big deal for them - insuring a truck fleet is undoubtedly more complex than calling up Geico to insure a camry.
Pitiful-MobileGamer@reddit
Camera would be subject to supponea in a lawsuit.
denyasis@reddit
This is correct..... If the company were to get into a lawsuit, the discovery portion is where both parties give each other their evidence (like videos). If you, a company driver, had additional evidence, you would have to turn it over.
Since it is recording made while on the clock (and potentially used for work), it can be considered a work product and under the company's ownership/responsibility.
So, using the accident example, if there was a lawsuit, the company would be required to provide your video. Failure to do so would get them in trouble with the courts.
That's where the liability comes in. It's potential evidence that the company is responsible for that they might not even know about and have no control over (for example, retention schedules).
So.... Every accident/incident you are in, you would need to provide your camera recording to the company. Taking a nom-scummy view, most companies don't want the hassle of having to track who has what personal camera and what it records and then trying to manage the video/players, etc, line up times and dates, etc.... that's the main reason they buy full on systems and ban personal devices (and should have standard across the board recording policies). It gives legal and standard method to review and release evidence with no surprises. Lawyers hate surprises.
Side note, you or your company would need to retain your accident videos.... Not sure what jurisdiction you are in, but assuming no crimes were committed (like they didn't crash into after doing a robbery), you'd be looking at 2 years and 30 days (as a rule of thumb - could be much longer depending on the jurisdiction). Once a lawsuit is filed, that time is frozen until all appeals and decisions are made. Then a different retention time might kick in. It can vary a lot from state to state.
keytiri@reddit
Yep, why my company is smart enough to avoid driver facing cams.
Gr00veChild@reddit
This is the point I really don't understand with the "protection" angle, if anything more often it shows negative evidence. My belief stands that the main reason is micromanagement.
yeChevok@reddit
Yeah, my companies insurance installed dash cams that face both ways in every truck and now they save 20% on their insurance rate. I guess it depends on the company and the safety of the drivers everybody’s trying to save money now because everything has gone up crazy.
yeChevok@reddit
Correct, thats why they want it removed. If you fall asleep and crash or on your phone. They are now legally liable if they withhold that you had a dash cam during an accident. My company went a different route and had their insurance install a dash cam that faces both ways. I asked the boss i know well there and he said they get a 20% off their insurance.
yeChevok@reddit
Im guessing they weren’t that route because prices are rising everywhere and they’re hoping to save money somewhere.

Moist-Ad9272@reddit (OP)

They meant that you would be the liability to them, if your dashcam caught audio of them asking you to do something illegal like violate HOS.
librae_vongehl@reddit
Tell them removing the camera violates the terms of service and that removing it breaches the safety contract that the company consented to by performance of employment. As per the agreement, if the company would like to breach the contract, they can buy you out for 100k usd.
If they claim they never agreed, remind them that they should had read the agreement before accepting it.
Performance is consent. Acting on the contract is as good as signing the contract.
Everyone knows that safety is the number one priority of a trucker, so the company has no plea of ignoramce.
Who are they to argue against safety, amiright?
tvieno@reddit
I hate it when people drop the "it's for liability" excuse. I always ask "liability for whom?" Take the camera down and put it up on the passenger side at the same height as the company's camera, so they can't say it is an obstruction.

Company dashcams are to protect the company, personal dashcams protect you. So by them asking you to remove it tells you everything you need to know. I run a dash cam inside my truck one on the left and right side of the truck and a rear facing on the trailer, good luck hitting me, im getting paid and my boss loves it.
Luck_Admirable@reddit
From someone in safety. The reason behind it is that it can open up the driver and the company to prosecuting attorneys. Every thing that has been recorded can be subpoenaed and used as evidence against you.
Few_Carpenter_9185@reddit
This.
The company isn't afraid the driver's personal dashcam will work, they are afraid it will fail.
If there is an inciden/crash, and if the personal dashcam was off, the OP forgot the SD card, or it just was cheap and died...
It doesn't matter if the company dashcam "recorded everything." A plaintiff or attorney in a lawsuit can claim the OP's dash cam showed something the company one didn't, and they are lying the camera just wasn't running at the time, and hid or destroyed evidence.
It doesn't even matter that the plaintiff/attorney is making shit up, and there's a 0.00001% chance the personal dashcam would have shown something the company one didn't. They're just going to use it as leverage to make OP's company look bad in court, and put pressure OP's company to settle.
Also, because of this, OP's company's insurance carrier probably is saying: "No, or we'll drop you."
Famous-Eggplant8451@reddit
And if OP camera was running and shows evidence contrary to what the company lawyers are stating you have a case. In your argument the basis is the camera wasn't working but the exact same scenario would apply if OP didn't have a dashcam.
Famous-Eggplant8451@reddit
What liability? It's recording the same thing the company cam is. The only liability I can see is the company ability to blame the driver since the driver would have no proof. Bad policy. If the company can use a dash cam the driver should be able to as well.
0263111771@reddit
I.am going off the info from the thread I responded to. Saying cameras open the driver and company up to prosecution. I assume that would mean its a liability?
0263111771@reddit

Matlovestruck@reddit
The fact that they want it removed "for liability reasons" tells you everything. That footage protects YOU, not them, and they know it. If it's not in the handbook they can't enforce it. I'd get that request in writing, ask them to send you the specific policy. Most of the time they'll back off once they realize there's nothing on paper.
Ok_Bug_6470@reddit
I would never do that, your truck while you’re on duty. Probably have to switch carriers tho. Inside cameras are a lia polity and aren’t for safety( the company ones like samsara) they’re used to populate databases and yours is messing with the contract they have that says they’ll be the only camera . They don't want you to protect yourself against them.?.?. I don't know, that's the most dumbest thing.

Never heard of this. Super weird. If i was in your shoes i would feel like if anything were to happen on the road they would want to pin it on me no matter who's at fault.
Acrobatic-Bid-3559@reddit
I would try to escalate this to somebody with at least half a brain. There's no reason for you to remove that camera

Ask for thus instruction in writing, then ask for a written copy of the liabilities arising from your dashcam and a copy of the risk assessment.
Note, they don't exist.
If they then dismiss you for "insubordination". Use these documents (or lack thereof) to sue for illegal dismissal.

Well. In a non-union company, as long as the policy created doesn't break state or federal law, they can make any policy they want at any time. You can follow it, break it loudly and get fired, or take the dash cam down when people at your company are liable to see you.
