A felony conviction usually comes with prison time. And he's not a superstar. He's an undrafted player with a history of injuries. That makes him easily replaceable.
I think this could harm his career. I could be wrong.

Technically no gummies are not a controlled substance thanks to not only the federal farm bill but also the fact that Texas allows the sell of edibles in stores. This is a literal open and shut slam dunk case especially considering that most DAs around Dallas and in Dallas don’t really charge based on personal usage.

I mean, and please don’t take this the wrong way, but it’s very easy to google these things. THC gummies are considered a controlled substance if they have more than .03% delta 9 THC. The problem is that there is not a field test to determine the type of THC, just the amount of THC in the product. Whether or not you get charged or sentenced is up to the judge and DA, but you will be arrested if you have THC gummies on your person. Especially if you’re driving with them

Exactly, it’s a grey area that most cops don’t have time to deal with so if they catch you with gummies or a pen, they’ll likely arrest you for possession. Especially if you’re driving and while using it

the pens were legal. BUT if you vape them it converts the THCa over the legal amount of THC. so... those stay at home. not on the road. It's legal but do you want to spend 10K on a lawyer? burn a joint and don't carry evidence. stay safe!

There’s a difference between delta 8 and actual THC gummies, but yes if you are caught with them it is a felony. It’s why Texas is trying to ban all THC products because it’s hard for cops to know the difference unless you have the original packaging

Once again, you’re taking a risk by driving around with it because you likely will not be given the benefit of a doubt when they find it on you. Especially if you’re high while driving and have it in your possession.

Edited my comment, but there are no current field tests that can determine whether something is delta 8 or actual weed. The packaging is the only thing that would help you in this case. The only test they have is to determine the amount of THC in a product but not what kind of THC

Exactly. I get the downvotes because REAL WEED SHOULD LEGAL IN TEXAS. But it isn’t and the laws are not on your side if you have these things in your possession. I’m just trying to help people realize that just because you can go to a store and buy it doesn’t mean you can’t be arrested for it because cops do not care about whether it’s Delta 8 or real THC because they have to deal with uncooperative people all day every day

Most people don’t realize that THC in a pen gummies is a felony in Texas. Even the ones you buy at smoke shops. We have handled cases where the person still had the pen wrapper that shows the compound that purports to follow state law but the police still charge them with felony PCS. The pen is then sent to a lab to test. It’s a horrible part of state law that is murky and the police are not using discretion. We have a lot of kids being arrested at school with vapes and getting charged with felonies. Obviously they shouldn’t have them but rather than a school disciplinary action it turns into a criminal case. Parents are horrified when they find out.

Even after the arrest people call us and say things like "this is an open and shut case right?" and we have to explain to them its going to take 6-9 months to fix and we have to treat it just like every other felony PCS which is expensive and takes a lot of work. Also depends on which prosecutor lands your case. Some treat THC like we do as something legal in a ton of states and others treat it the same way they treat hard drugs. The state created a mess with these laws and regular people are paying the price.
