Legal limit for a cdl holder is .04, not .08. Also, doesn't matter if your in a CV or your own personal vehicle. As long as you have a cdl, it's. 04.

Maybe it varies by state but just looking across a couple that is incorrect. Its .04 while driving a commercial vehicle, .08 in personal vehicle regardless of license.

The FMCSA has established 0.04% as the blood alcohol concentration (BAC) level at or above which a CDL commercial motor vehicle operator who is required to have a CDL, and is operating a commercial motor vehicle, is deemed to be driving under the influence of alcohol and subject to the disqualification sanctions in the Federal regulations. Most States have established a BAC level of .08% as the level at or above which a person operating a non-commercial motor vehicle is deemed to be driving under the influence of alcohol. Sanctions for alcohol-related driving violations may affect the driver's qualification and eligibility for both commercial and non-commercial licenses.

Idk friend, you might be interpreting that wrong. FMCSA standards are not state mandated, they are federal. I don't see anywhere in your "proof" that disproved what I originally stated.

There are various law firm articles that show interpretation the law better than I. But in FL for example, there is a seperate statute on DUI for commercial vehicles. The statute for personal vehicles does not reference CDL holders.
One such law firm interpretation:
Personal vehicles: The standard 0.08% BAC limit applies. However, a DUI conviction still impacts CDL eligibility.

In fact, even without blowing any detectable amount, the officer can put you oos for 24 hours if he "reasonably suspects" that you are under the influence of any drugs or alcohol
