Neither are legal anywhere on public roadways or bikepaths. If you are looking for an emoto for motocross tracks, I recommend Spark. They even were able to compete in pro supercross this last season (not AMA).
Cannot beat this dead "ebike" enough: DO NOT RIDE AN ELECTRIC DIRT BIKE ON PUBLIC ROADS!
