5070 Stuck In Gen 5 X4 Lanes Pcie

I have a B760m-cx Motherboard with a i9 14900f and a 5070 with 32gb ram and 1 nvme m.2 ssd, my 5070 is in the Top PCIE Slot and I go to run GPU-Z and i run a render test, it says its only running Gen 5 X4 Lanes under load.
Ive been through all my BIOS and updated it.
GPU is fully seated W/ Power Cable
No Limitations/Restrictions
I'm at a loss here, i stream and game as well.

It could be your M.2 SSD lane sharing with the GPU's PCIE slot. Check the specs and see if those two slots share lanes. Try moving your SSD to the lower M2_2 slot.
You motherboard isn't ideal for your 14900F CPU. It has a weak VRM, which will likely throttle your CPU's performance, especially under heavy CPU load.
If your CPU is under performing, upgrading to a Z790 motherboard would be ideal and would also solve the PCIE lane sharing issue.

This motherboard has no sharing settings in the bios at all and says it shouldnt. and i know the motherboard came with it prebuilt, i know i need a knew one and there are others with boards like mine or exact same ones with the same issue. i guess it may be something to do with the boards and the new 50 series.

I didn't look up the motherboard, so it's certainly possible lane sharing isn't the problem.
Have you checked for a firmware update for your GPU, it says 5060, but works for all 5000 series GPUS: https://nvidia.custhelp.com/app/answers/detail/a_id/5665

That very strange, since your mother boards manual lists two types of pcie slots: x16 5.0 and x1 4.0. It doesn't have any slots wired for x4. https://www.asrock.com/MB/Intel/B760M-CX/index.us.asp
Try moving the ssd to another m.2 and make sure there isn't anything obstructing the pins on the x16 slot.
