Questions About The NFA process
Back in 2001, hypothetically if a person was a juvenile in California, and got into some trouble, and was charged with what would have been a felon if they were an adult (2nd degree burglary). they went to juvenile court and was adjudicated as a minor and was made a ward of the court, they were sent to a group home and spent 2 years there until they turned 18, graduated high school and the program in 2004. They were sent back to court and the case was dropped and records were ordered sealed and destroyed, or so they thought.
2005 they bought their first firearms in California, never delayed or denied, a total of 10 times waited the mandatory 15 day waiting period and nothing. This was assuming records were sealed and destroyed.
No finger prints were ever taken during the original case.
This Person attempted to become a foster parent in 2020, CPS did a background check and the record popped up. After some investigation they found out that they record had not been sealed and destroyed due to an error in the system. The person petitions the the court to again seal and destroy the record, goes before a juvenile judge and is granted the petition. This person has a copy of the court order signed by a judge.
September 2020 they move out of California to a state in the midwest, after the first week of living in the midwest, they attempt to buy a firearm and get delayed, they take home the firearm 3 days later due to the 3 day rule. a year later they go to buy another firearm and is instantly approved, there guess about the first purchase is because they hadn't been fully established in the new state. they go on to buy more then 7 more firearms with no issue and even have thier CCW.
This person has done multiple FBI CJIS fingerprint based background check that come back with NO RECORDS LOCATED. They did a CA DOJ fingerprint based background check that does not show the case in question.
They have never attempted to buy an NFA item, so their question is
If in fact there were no fingerprints taken, this person has passed probably 20 or so NICS checks, multiple FBI CJIS fingerprint based RAP sheet reports with no records showing and a CA DOJ fingerprint based background check without the case in question. Considering that the FBI completes the NFA background check for the ATF.
What are the chances of this old juvenile record showing on an NFA/ATF background check?
