I’m so tired of this song and dance. It would be a real shame if we stoners in Texas could organize a huge boycott of all alcohol and tobacco sales until weed is put on a referendum for us voters to decide if it should be legal. There are other factors at play, but those two lobbies are essentially paying the state off to keep it illegal. Our voices should matter more.

Alcohol yes but not Big Tobacco, they are salivating for the day it’s “fully legal”. They already own farms that grow leafy matter. Machines that chop that leafy matter up and roll it into smokable form. Then they box millions per day and have a distribution network that drives them to every convenience store in the world daily. On top of all that they can operate fine while losing billions of dollars until they put all the small guys out of business. Big Tobacco is who will bring weed to the masses.

Totally agree. But, involving them in an organized effort to get weed on a ballot may force their hand. Hurting their bottom line is the only language they understand. I think Philip Morris paid 1.9B to TX last year. If they want it legalized then they should start lobbying for it, or lobbying harder in states that have legalized cannabis.

This suggestion will take until November to truly enact, but one step each of us with eligibility to vote in Texas can take is to vote out Dan Patrick in the general election by electing the Democrat who comes out on top in the May runoff. Danny Boy is the block for a great deal of sensible legislation, including on matters related to cannabis.

When the ban came down they removed all the vapes. But then brands created little syringes that were legal. Basically you could buy the syringe with the liquid in it and then an empty vape and fill it yourself. Which somehow was legal. Also just so you know there are tons of Delta 9 THC products at your local liquor store. From 10mg drinks to 100mg bottles. Little shots for single quick use. These are all still legal and will be for at least til November. I work for one of these beverage companies and we currently have people in Washington trying to get the November ban rolled back. They dont like the synthetic THC because its basically just sprayed on to the products you buy at smoke shops and there is no way to know how much you are actually getting per time you use. With the drinks it is very much regulated and easy to dose out. Beer and alcohol are hurting bad because these drinks are taking over. So much so that now the alcohol companies are jumping on board rather than fight it. Money talks. We'll see but im willing to bet THC is here to stay in one form or another.

It's completely legal for Texas to ban products like this. The federal government didn't mandate states to allow alt cannabinoids, that was always a loophole in the 2018 Farm Bill. States can ban (certain) consumer goods as they please. Another example is California. California banned the sale of alt-cannabinoids such as THC-A because unlicensed dispensaries (like gas stations) were selling them. We can even take another substances such as liquor as an example. The 21st amendment didn't force states to allow sale of liquor, it merely just repealed the 18th amendment, which banned them on a federal level. There are technically still dry counties in this country.

The state of Texas legalized hemp in 2019 after the 2018 farm bill, they used the same 0.3% thc by weight as the federal laws allows. There was no change to this legislation, THCa remains legal to possess as long as its labled in its original packaging. The governor can not unilaterally change, amend, or revoke existing laws. The only thing they can do is go after the licensing terms. And federal law says that no state, tribal territory or federal government can interfere with legal hemp products including raw hemp flower. Abbots EO is illegal and the DSHS has no authority to over ride federal and state legislation that exists.

I’m not 100% sure since I’m not a lawyer but in the original iteration of the law it was still legal because it only banned Texas licensed businesses from manufacturing, distributing or selling within Texas.
So in typical Texas fashion we literally only hurt our local businesses.
That said many of these companies may choose to stop shipping to Texas because they may not want to get in trouble.
