I got hit by a car and the old man took full fault his insurance opened a claim and got me my personal property damage settlement for $5k even tho my e bike was $6k and $2k in mods that he destroyed. I broke my wrist found disc fragments in my neck did CT,MRI and X-ray. Ortho , PT and PTSD therapy was scheduled to me by the ER. I had a worse accident last year broke my femur and have titanium rod and screws in my leg. Anyone know how much I could see for the personal bodily settlement could be? I know it’ll take few months but I alr got lowballed for my property check. Just want to know what the 2nd check could look like

$5k payment for something that was a total of $8k brand new is pretty reasonable. The value of pretty much everything tanks the moment it goes from brand new to used.

I disagree, you should be made whole. If the bike cost 8k to replace that is what your are owed. I would settle for nothing less. As others have suggested get a good lawyer.

A lawyer is going to cost more than the $8k a brand new bike would. I know reddit posts like to jump right to ‘time to call a lawyer’ for absolutely everything but it’s not worth the money a lot of the time. A typical lawyer in a moderate cost of living area would require a $5-10k retainer just to take the case. That ‘good lawyer’ you think they should hire? Easily $15k. Again, that’s just the retainer, not the full cost of having representation.
None of it even matters because it’s unlikely any lawyer would take a small potatoes case like this, let alone a ‘good lawyer’. Maybe some lawyer who just opened their practice or has a history of losing cases and who can’t get any other clients would take it but most would just tell you to let it go, it’s not worth the time or money, or that it’s something that should be handled in small claims court.
They’ll also tell you that you’re not going to get the cost of a brand new bike, you’ll get the cost of what was damaged and that was a used bike. That’s just how it works. It’s the same if your bike was ruined by you, yourself and you filed a claim against your own insurance. They’ll pay out the value of the used bike, not the cost of a brand new replacement. To get brand new replacement value you would have to take out special, much more expensive, insurance that will cover a new replacement.
Think about it this way: let’s say you accidentally rear ended someone. It’s a really old junker kind of car, let’s say a Toyota Camry from 1997 with 240,000 miles on it with lots of things needing repairs and all kinds of dents and scratches with worn out tires. Worth maybe $1000 at the absolute most. It’s no longer drivable and repairs will be $3000. The owner says you owe them $28,000. You say but that car was only worth $1000! They say yeah, but it cost me $26k when I bought it and I put $2k into upgrades! Would you pay them the $28k? Does that make any sense? How do you think a judge would rule if they went and got a ‘good lawyer’ and took you to court? The answer, of course, is that no matter good of lawyer they had you would still only owe them the $1000 the wrecked car was worth at the time you hit it because that’s how liability works.

never ever deal with an insurance company on your own for settlements; that way leads to low payout. for "vehicles" they use a "blue book" value and then only give like 50% of that. If they already paid and you accepted, then that part is done. What you need is an injury lawyer to help with the rest.

I too am recovering from an e bike injury that resulted in getting titanium hardware + screws installed in my leg. I'm nervous about recovery. It's going well, and I'm told I'll be able to walk normally, and pedal my bike again. I've met older people who have had a similar experience with getting titanium hardware in their leg, and they seemed to walk fine. How does your leg feel now, a year later? Does it bother you often? You're able to pedal your e bike? Does it hurt after pedaling for a while or is your body used to the hardware?

You should be fine. It takes a 3 - 6 months to fully heal but after that, you shouldn't notice it at all. I wouldn't risk getting on a bike before the 6 months though, even if you feel good. Only because there is always a risk of a fall or God forbid, getting hit and you want everything to be rock solid if it happens.
I have had a 4" plate and seven screws in my fibula for almost 20 years now.

You could get 3-5 times medical costs on your own, or as much as 6-8 times with good lawyers, who will take more than half. You’ll likely be left with less than you could get on your own. Until you sign for the amount that you think is fair, you can always tell them that you’ll get a lawyer if you don’t get what you feel comfortable settling for.

When the woman ran over me with her pickup truck (no, really) I thought my medical insurance had it covered (I didn’t get any bills);the driver’s insurance company sent an agent to my house and bought me a new bike and clothes.
About 15 months later I started getting notices from insurance companies: “if you collect anything, it’s ours!” This went on for months.
Finally, imagining Repo Man breaking into my garage to take my new bike, I contacted an attorney. He took the load off of me and secured a settlement for “treble damages”: all medical was reimbursed (one third), the attorney got paid (one third) and my wife & I took a vacation.

Insurance companies purpose are to make money for their investors, as in, to collect as much as possible and to pay out the least amount possible. You do not have to accept their offer and can and should get more. Get a lawyer . They take a big percentage, but they’ll get you a ton more than insurance will offer
