California's tread depth regulations - why the discrepancy between legislation & inspection manual?

I notice that the state legislation for California specifies that for light vehicles, the tread depth must be at least 1/32", but it does NOT state that the measurements are to be taken in the major grooves, which implies that an inspector could decide to measure the shallower, secondary grooves.
Contrast this to the B.A.R inspection manual, which specifies 2/32", ALSO not specifying major grooves.
Does anyone know what's actually done, in practice, by the inspection stations & CHP etc?
