Water company is working outside mine and I have an open plan front garden, they have put their barriers up in a way in which allows public to walk across my garden and close to my car. They won't move the barriers to prevent people walking across, can I do anything? They are working here for 1 mont

Put something in place as a barrier on your own garden, - I'd buy som staks and orange netting and put it up along your boundary so that any 'path' they have created becomes a dead end. Add a 'private porperty - no access' sign if you want. Also - try contacting the water compnay direct, rather than the workers. You could potentially be liable, liability tends to be based on whether the harm someone suffers was resonably foreseable. That said, you might well have a claim agains tth awter company if they or their contractors do smething which it is foreseeable is likely to cuase you harm - I suspct that that would include damage to your garden or property by people tresspassing as a result of where they have set up their barriers. I'd take photos and write (e-mail if you can find an appropriate address) to the water copmaany, keeping copies, and expressly state that : \- you have not given permission, and do not consent to, their barriers being erected on your property or pedestrians being directed onto your property \- you belive that the set up creates a risk of damage being caused to your property (garden anda car) by people coming on to your land at their direction and will hold them responsoble for any repais or making good which may be required as a result \- as they are directing people onto your land despite you having instructed them not to do so, you will consider any harm to any thord party acting in accordance with their firections to be their responsibility They should be abl to put up a 'footpath closed' sign and direct people to walk on the opposite side of the road - is there no pavement on the other side? If there is, then I would, in you letter to the water company, expressly request that they mark things up that way - telling them what the solution should be as well as telling them of the problem increases the chances of them addressing it and also makes it harder for them to argue they were acting reasonably if anything does go wrong
