Talked to the President, Terry this morning and heās refuses to acknowledge the $1000 in missing payments, including detentions, missing mileage pay and toll reimbursements and getting layover pay for these 2 days waiting since the customer doesnāt want to open for business. He says heās not responsible for the weather.
He threatened to say that I stole the load, when I told him that Iāll be leaving it at the truck stop. He said he doesnāt care if I go home, then immediately hung up to end the phone call.

This is why I strongly support hourly pay for truckers. Vast majority of pay in Australia is just hourly and it fixes so many of these issues. Any delays, breakdowns, bad weather? Doesn't matter, you get paid by the hour.

At my second job I was paid $200/day no matter what I did (and I was happy with that (yes, it was quite a while ago (2012-2014))). Daily pay is roughly equivalent to hourly pay.

American trucking is all about exploitation. Only a few companies do hourly but they all benefit from not paying for most of the work a trucker is responsible for. We all make a deal with the devil to do this job. We all have blood on our hands

It always seems to me that they put in all these extra rules and random stuff that you have to comply with to try and take cents away from you, If you look at the big picture if they scrapped all that and just pay you a day rate or an hourly they could get rid of a lot of overhead / extra people who go through the pay and everything and look at this stuff and save money.
It's why I'm against red tape for things like Social Security payments Because most of the time the extra checks that they make you go through cost more money Then they save. I find this works with businesses and goverments.
TLDR: The amount of extra shit someone goes through to save A dollar usually ends up costing $10

probably because itās hard to predict the damages it might cause. For example, we know itāll snow and weāll have ice on the roads and we can be careful about it but we donāt know how many trees or utility poles will break or how many accidents will happen - all of which can start a chain reaction.

Predict the damages? You look at previous instances where similar weather patterns caused damage and extrapolate from there. Its very simple science.

Not returning the truck to company property is easily argued as abandonment/theft and leaves you up Schittās creek if the company wants to fuck you for house money which they will.

There need to be more laws on the books to help protect truckers like you. I was scammed out of over 3k doing OTR from a sham foreign trucking company. Somehow they were able to still run a business in the states.

Look into filing a workman's lien on the tractor and trailer. Lock it up somewhere safe, file the lien, then let them know you aren't playing and want your damn money.

O/O take the rate they take, kinda the opposite of a union. There is a union like gentlemen's agreement to not run cheap freight but a) everybody probably does it in a tight spot b) plenty of O/Os have no idea what cheap freight is because they're grossly underestimating their TRUE operating cost. They think shit after I pay for diesel I'm getting $1/mi. Oops, ya bankrupt.

If the boss files a false police claim saying the trailer has been stolen, when he's on record with the last person who moved it saying "dont leave it there or I'll report it as stolen"....

That really just depends what the asshole tells the cops and what the cops choose to believe.
I almost got arrested for a stolen trailer when I worked for Covenant years ago. I was told to go recover one of our trailers from a customer we no longer had. So I did, when on my way back they called and said the trailer had been reported stolen and that I needed to fill out a recovery report with the local PD. So I stopped at a nearby truck stop and waited for the cop to show up. I told him what was told to me, explained where I found the trailer, the condition it was in and all that. I was driving a Covenant truck, pulling a Covenant trailer and this asshole wasn't believing me that I wasn't the one who stole the trailer. Even after showing him all the messages on my phone and permanently tethered Qualcomm.
To make matters worse, we were both having trouble getting ahold of the security department. So finally I called in like I had been in a fatality accident to get highest priority and was like "look, I'm about to get arrested for doing exactly what you asked me to do, so you better explain to this cop right this second that I didn't steal this trailer."

If does suddenly pull his head out of his ass, make sure you've got pictures of where you left the truck. How much fuel it's got (trailer too if it's a refer), and just a video of a walk around of the whole truck and engine in the tractor.

Ask someone in HR: This is the most important thing you can do. If it were me, I would recommend making a delivery and asking if you could take it back, or at least have them tell you how much theyāre going to charge you to get it back. A lot of these people are scumbags. They made sure to full loaded freight rates for special service rates with a fuel search chart to go get the truck. They may charge you to get someone from the Home terminal to the truck, and then back. Itās also far more difficult to get a job driving for someone else if they report it. Insurance carriers are scumbags too, and will charge you more for insurance, even if you get your own authority.
You donāt wanna waste the time to drive it back for free, and your best bet is to do something that would cause him to fire you a parked truck. You compose pictures of the truck 2X, true social, and every other social media site, tag him, and the company, and their customers. Just donāt lie, and only say things Ā that are approval. You can also contact a law firm to send him a letter requesting payment for what they agreed to pay. Regardless of what you do, do not lie, do not disparage his character, do not threaten, make sure that you cannot be charged with extortion.
