That's a nonsense argument. To be honest with you, i'm as far on the no-optimism bus as everyone else, but your employer can't prohibit you from drinking on your off time. They CAN, however, prohibit weed, which is what a lot of people want to be over with.
I want them to pick a side, either ban drivers from using alcohol, weed, and cigarettes or reclasify weed to fit in with alcohol and cigarettes.

Ah I see what you mean. Yeah that's a good point, however there's no good test (currently) to prove you where smoking off the clock, besides circumstantial stuff.

Yes there is, its called a mouth swab, the DOT gave it the OK in 2023. It can detect recent use between 8-12 hours of last use, but they still use piss tests.

It is possible but probably not right away.
Schedule III means it is a legit medicine and if a doctor approves a driver to use it then there is a case to go before a court with.
A lot of drivers have tested positive and lost their CDLs. I wonder if recertification will be easier now.

DOT drug testing only is for Schedule I & II. To continue testing after reclassification, they would have to "carve out" an explicit rule for the very narrow and specific continuation to test for the Sch. III MJ.

The Problem: Current DOT authority is tied to HHS Mandatory Guidelines, which only authorize testing for Schedule I and II substances. Moving marijuana to Schedule III could technically strip the DOT of its legal authority to test for it.
The Solution: Industry groups, including the American Trucking Associations (ATA) and the National Drug & Alcohol Screening Association (NDASA), are pushing for a "safety carve-out" to explicitly preserve the DOT's testing authority regardless of the drug's schedule.

Even then why would they do that when urine tests are fully legal and “reliable” and already working in their system? The dot is scared of doing anything with marijuana and avoiding it until the very last second that they can get away with it

It has not. There is still not enough research of Marijuana/ THC to come up with technological devices to show whether the THC in your system is residual or currently causing impairment. Until there is, even if DOT can't or doesn't test for THC, companies most likely will.

The DOT will never allow a CDL holder in a safety sensitive function to ingest THC legally. We can wish, pray, hope and dream all we want. No way they ever let it happen.

People really don’t see optimism with this. I personally think it’s going to pave the way. If marijuana is rescheduled to Schedule III, it would no longer be treated as a drug with “no accepted medical use,” which is the main reason the DOT currently bans it outright. Schedule III status puts it in the same category as other prescription medications that truck drivers are already allowed to use with medical approval, as long as they aren’t impaired while driving. That alone weakens the legal foundation for a blanket prohibition. While it wouldn’t instantly make marijuana legal for truck drivers, it would create strong pressure for the DOT and FMCSA to update their rule likely moving toward a model similar to other medications, where use is regulated, prescribed, and evaluated based on impairment rather than simple presence in a drug test.

I don’t think the pressure would be strong enough for them to change the laws. They’re already so lazy and stubborn as it is, one of the most unfair systems that the working class has to deal with is the dot. They don’t care for even changing piss tests when it got passed for saliva testing back in 2023, they’re dragging their toes on everything related to marijuana prolonging it as long as possible. Their goal is to not be liable for anything, doesn’t matter if it makes drivers’ lives better or more fair.
It would take an act of God and votes in congress before weed ever becomes allowed and I don’t see that happening in the next 3-5 years at all unfortunately

You can drink a few beers off the clock at night and then be perfectly sober blowing a 0.00 on the breathalyzer the next morning. I don’t think anyone is asking to be able to smoke and drive a truck at the same time. Just to be able to smoke when they aren’t working and not get punished for it.
