I think the reason that it’s possible is because only Colt makes a gun called the “ar15”, if you buy one from Palmetto state armory it’s a PA15, if you get one from smith and Wesson it’s MP15, and those are different guns.

Recent AWBs like ILs and WA (to my knowledge) banned ARs by name along with any derivatives. People have been able to get fixed mag Dark Storm ARs, but actual stripped lowers have been completely banned. Even things that are not regulated, like "ranch rifles" (MCX Regulator, SCR, etc) are very hard to come by due to vague language defining what a "barrel shroud" is, which has led to a lot of FFLs refusing transfers to keep their license.

I don’t really want to elaborate because marylands gun laws are stupid and I’ll probably mess something up- but essentially MD banned ar-15s including copycat weapons, but also wrote in an exception for a particular colt ar15 with a heavy barrel (the argument I believe being that it was more of a sporting rifle than an “assault” weapon). The exception also allows for copycats of that particular colt ar15- the law is currently interpreted/enforced as any ar15 is legal as a copy as long as it has a barrel marked as or advertised as having a heavy barrel or HBAR. I think there’s some other loophole with ar pistols as well but I’m not as familiar with that.

AR-15s and "Copycat Weapons" are banned explicitly by statute.

Maryland law has an explicit carve out for the "Colt AR-15 Sporter H-BAR rifle" in order to protect shooting sports (i.e. NRA High Power). This allows Marylanders to buy AR-15s as long as they have an HBAR.

Maryland defines HBAR as being advertised as or stamped "HBAR". They do not have a formal diameter that determines if a barrel is an HBAR or not.

The reason you can still get SOME ARs in MD is because of specific wording and carve outs.

Basically, they banned the Colt AR15 and all “clones”.

Thing is, in their argument to ban, they justified by claiming AR15s had “no hunting or sporting purpose”. (BS for msny reasons, but thats what they used).

Gun rights advocates called them out, by showing the numbers on how prolific the Colt AR15 “HBAR Sporter” is in national marksmanship matches.

The ban still passed, but the “compromise” was an exemption for the HBAR sporter. (And its “clones”)

End result:

Regular ARs banned.

ARs marked or marketed as having a heavy barrel are accepted as match rifles, and exempt from the ban.

ARs which CANNOT swap parts with a Colt AR-15 are not considered “clones” and are not banned by the colt rule. (piston ARs, ARs not in 5.56/.223, SOME ARs with mono builds) (but they are still subject to the festure test and by name ban list)

AR pistols are “pistols” and are not subject to the AR ban at all, as it only addresses rifles.
