Ulpt girlfriend got denied for a rental application, but I was approved

So basically, my girlfriend filed bankruptcy a few years ago, and we were planning on moving into a townhome together. I qualified for it by myself, but when trying to add her to the lease, she was denied, landlord said that there would be no way to add her in the future because the results would be the same due to the bankruptcy that was two years ago, pretty much at this point I’m not really sure what to do. We are financially well qualified it’s just we’re worried about her moving in and then the landlord trying to evict us.

If you qualify by yourself its a non-issue. You're on the lease, and she isn't. You invite extra risk to yourself, in a sense, because youre the only one liable for issues now. But you would also be liable if she were on there, too. LL not gonna evict anyone over this if youre paying your bills on time & not causing problems.

I agree it should be that way, but I know for a fact that my lease explicitly says that nobody over the age of 18 can live at the residence unless they are approved to be on the lease. I can’t even have guests for longer than several days without notifying the landlord. Not a student accommodation or anything unusual, just a normal lease in Montana.
Now, do I violate that and other insane/unethical lease conditions on a near daily basis? Sure, of course, and I am in no real danger of eviction right now. Landlord needs to realize there’s a violation to evict me over it lol. But I definitely wouldn’t be allowed to have an unapproved co tenant under my lease terms.

Depending on their landlord, they might categorize his girl as an unauthorized occupant. I recently had a buddy move in, didn’t have him apply, and they found out about after a month.

Someone can be an occupant without having to be on the lease. Landlords don’t make children of tenants fill out rental applications once they turn 18. They’re just occupants.

Like the landlord is not 100% in charge of that decision. Not like it's a law prohibiting him from renting to her or anything.

Her being on the lease just legally binds her in case you skip out in paying it.
The landlord can't stop you from having whomever you want living with you. No credit check needed for that (unless that's your thing ;))

Depends on where you live.
In Ontario, They have no say unless it's an accommodation with shared space with the landlord residing there.
Otherwise, they can't legally do anything. They can illegally make your life difficult, but that is what the tribunal is for.

In the US in most areas lease agreements stipulate how long you can have guests stay there, guests as in anyone not on the lease. Usually it's like a number of days in a row or a number of days per month, and its generally not a high number.
You absolutely can get evicted for having someone live there who is not on the lease.
However, if you don't cause issues with neighbors, pay rent on time, and are a good tenant its very unlikely you would have any issues. If the landlord had issues with you it could be used as grounds for eviction however.
The other issue would be you are 100% responsible for any damage or late rent so if shit goes south she could make your life not fun.
There is no such thing as a tribunal here.

Very common lease condition where I am — no guests longer than X days, all tenants must be on lease. Do people actually get evicted over it? Generally not, as long as the rent is getting paid and there aren’t complaints from neighbors etc. but it is absolutely a lease violation and technically grounds for eviction should the landlord ever want them gone for any reason.

You can in the US. It's not uncommon for landlords to stipulate in leases than overnight guests can only stay X amount of consecutive days.

If the landlord isn't willing to work with that then find a new place because who knows what other hassles you'll have to deal with from such a shady landlord. The landlord is also incorrect because in 5 more years, the bankruptcy will disappear from her record but that is just nitpicking.

Do you need to add her to the lease? Aside from leaving you on the hook if you break up, I don't see any particular downsides of it. There's nothing unethical to do.

The reality is this depends entirely on where you are at and you are gonna have to not be lazy and actually research. Details are necessary because a private renter often has looser laws than a business and can basically get rid of you in some states for nothing, and in some states they can’t get rid of you for anything. That’s how big a difference where you are is.In general, a post I saw below is correct though, if you qualify, the landlord generally won’t care about if you have people live there as long as it’s not causing issues w/property or neighbors, the ones that have issues with that now include it in the lease, a stay length, usually 6 days. But it’s all on you. If you break up and she burns it down, it’s you. But also, if you break up, in some states , you can put her stuff in the yard

Honestly given your dating status it may be better she’s not on the lease. At least if the landlord doesn’t live adjacent to you, since he can make your life a hassle.
But the lease may have other restrictive terms that could impact you.
Look for a local tenants rights group or attorney to make sure you’re good.

Check your state rental laws and your specific contract. The bankruptcy will remain on her credit report for seven years and then she can request that it be removed.
