How’d he manage to get a DUI in Texas?
Virtual-Lobster1566@reddit
Because some of my people (immigrants) are still out here thinking like they’re untouchable and making idiotic decisions. Driving under the influence and it pisses me off. What does this woman want? Does she want compassion, yes we feel bad anyone died because of the shooter especially the people being targeted by ice. But you leave us at odds when we find out your husband was out here recklessly driving under the influence putting others at risk. It’s the kind of shit that pisses me off giving us bad rep. I’ve seen many illegals do that shit even now. Don’t be surprised when you find yourself under ice custody, how can we even fight for your release with a DUi?
I’ll bring up another point, what happens when a racist cop picks you up and falsely incriminates you of DUi or Ice puts DUI under your file lying? Can that and does that even happen
Content_Protection47@reddit
Man, are you ok? You’re speaking for other people like someone elected you their spokesperson. DUIs don’t have a race, everyone ethnicity has alcoholics who make bad decisions.

Go to an immigration subreddit and search DUI, many people comment about getting DUI and they are clowned by the users.
This is not the time to be getting DUI or DWI as an immigrant person.
If you're an immigrant you would know about the animosity towards immigrants who keep getting DWI.
gelhardt@reddit
when is it ever the time to get a DUI as any type of person???
OutrageousQuantity12@reddit
I was asking that because he was 31 and a DUI is a charge only given to minors in the state of Texas
James-the-Bond-one@reddit
What is the charge for those older than 18?
Virtual-Lobster1566@reddit
Thank you for pointing this out. You’re correct. it could be an old charge or the article writing incorrect information.

Probably by driving without realizing how much he'd had to drink? Texas, like most states, set the BAC percentage at .08 in order to avoid losing federal highway funds. In any case, a DWI isn't just cause to make a baby an orphan, and before you argue that if it wasn't for the shooter the baby wouldn't be an orphan, deporting him to some third-world country would make the baby an orphan since she wouldn't have her father in her life. Also, the baby will become homeless with her mom because it's highly unlikely that the mother will be able to keep the house that they just bought.
The way it could have been worked out, should have been worked out, is that the father would get his day in court on the DWI charge, and maybe it turned out the BAC testing machine was malfunctioning and he wasn't even drunk, or maybe he gets the same outcome that so many Americans get on a first-time DWI charge, which is no jail time or a felony record. In those cases the baby wouldn't be a homeless orphan, or stripped from the mom by the state and given to some white family somewhere, never to know who her mom and dad were. ICE did their part to ruin at least five lives here, and ICE supporters cheer that family's destruction with glee and self-righteousness. One wonders who the real humans are here.

I was asking how he got a DUI, a charge given exclusively to minors in Texas, not saying he deserved to be killed.
beyondstarsanddreams@reddit
Since when is a DUI given exclusively to minors? DUI is under the influence, DWI is while intoxicated and the nuance applies to BAC. Additionally, a DUI could be given for being under influence of drugs other than alcohol.

"The difference is that a person can be charged with DUI if there is any amount of an impairing agent in the driver’s system OR if they are underage."
This is what it says. It does not say it is exclusively for underaged people. As with most states that I've lived in that have two separate classifications of alcohol or drug related driving offenses, it is a matter of BAC. Yes a minor automatically gets a DUI is the are found to have alcohol in their system, but adults can also get a DUI charged if they are pulled over and have a BAC level that falls below the DWI amount of .08.
In other states I've lived in there were specific BACs for a DUI, such as above .05 but below .08, and also any amount of alcohol for someone who is underaged since it's illegal for them to be drinking at all.
I'm assuming this person was pulled over but had a BAC lower than .08. Doesn't sound like it was a mistake in the article.

Actually there isn’t even a DUI charge in the Texas penal code, that lawyer’s website was just wrong. Man, don’t you look silly defending a non existent criminal charge
NicevilleWaterCo@reddit
Well if someone needs a DWI/DUI lawyer, I probably wouldn't recommend choosing that guy then.

TIL age is a factor.
noncongruent@reddit (OP)
I suspect the article author used DUI instead of DWI, being unaware of the fact that in Texas law those are two different things. In many if not most states the terms DUI and DWI are casually treated as teh same thing. The article stated he was brought here at age 14 and was married for ten, and was 31 when he was killed. It's obvious that he wasn't charged with a DUI, so the author made a simple and understandable error when writing the article.
