THC Vape ban, thoughts?
Posted by mushroommoo@reddit | Dallas | View on Reddit | 205 comments
I was surprised to see no one post much about this but it was weird walking into my local smoke shop and seeing everything gone including the disposable nicotine vapes!
The shop owners said a lady came in and just bought 15 vapes and plans on coming in later to wipe out even more
I hear some people saying this won’t last long? Thoughts? I’m not savvy with understanding the bills and such…
But on a good note I needed a reason to stop vaping and I can’t stand cigarettes maybe this time I will actually kick the addiction, how do y’all feel about it?
UnfortunateLamp@reddit
My rights stop where yours begin. It’s unfortunate that we live in a city and state where the majority of voters disagree with my first sentence. It’s terrifying honestly.
ninhibited@reddit
Can you explain your first sentence here? It seems like you're saying that when other people have rights it somehow takes away rights from you? Which doesn't make sense.
opheliapickles@reddit
The right to swing my fist ends where your nose begins. - some SCOTUS justice I think. It’s like smoking cigarettes. You have the right to do so, but I have the right not to be exposed to your second hand smoke.
ninhibited@reddit
Oh well I don't think you were ever allowed to smoke THC in public and you're not allowed to smoke cigarettes except in designated places so that doesn't really apply here... Or rather they've already made it so that both those rights coexist.
Southern-Salad-5071@reddit
If I have to go to a "designated area" it's already infringing.
ninhibited@reddit
Well that happens all the time for good reason, like how you're not allowed to drive a car on the sidewalk.
Nonsmokers also can't go into smoking areas without being exposed.
Smoking isn't a human right, like an innate thing you can't change or live without.
Short_Competition234@reddit
Use of tobacco products is a right, RFRA.
ninhibited@reddit
I mean yeah, just like you have the right to do the chicken dance in Walmart. I think you're getting confused on the difference between a right and a protected right. No one is saying that smoking is a protected right.
opheliapickles@reddit
My example was about cigarettes, not THC. And you could smoke them anywhere. Work, school, restaurants, airplanes, HOSPITALS.
PM-ME-UR-DARKNESS@reddit
You can't. Federal law still prevents that. What the farm bill Act did allow was the production and sale of hemp derived products. Are there people doing that still? Most likely. I've been to Houston. Should they be prevented from doing that? Sure, as long as we prevent people from smoking cigarettes in public spaces as well. Should we be telling grown adults whether or not they can smoke something that only impacts them in the privacy of their own home? No. Absolutely not.
ninhibited@reddit
Well this post is about THC and I already explained why the "my rights stop where yours begin" argument from the original comment was a) irrelevant to THC vapes and b) to address your example has been made irrelevant with CURRENT regulations on tobacco.
opheliapickles@reddit
I was giving an example of my rights end where yours begin bc you didn’t get it. JFC. Is this post about swinging fist at ppl?!
bananabob23@reddit
Your explanation was very clear, they’re just wanting to argue and be correct it seems…
ninhibited@reddit
Yeah I got kinda aggro sorry, after you explained it though (thank you) I was trying to point out that the secondhand smoke thing is not really the same thing as when people buy THC vapes... When you defended your example it just seemed like you were doubling down that it was the same.
Burnmycar@reddit
RIP Geek Bars, and next may be cigarettes. What’s fucking next?
Southern-Salad-5071@reddit
Then go kill yourself, you healthnut asshole. If more weak ass people like were gone, I could still have my vape. I bust my ass working 2 fucking jobs. I have VERY few things that I can even enjoy and everytime I turn around somebody else is trying to fuck with me. My kids are going 2 be 18 soon and I'm going to kill myself once they're grown. People like you are why I'm going to kill myself. Congratulations, murderer.
drummerguy79@reddit
I always heard it as “your rights end where mine begin”.

I'm just glad it's not an all out ban. I don't drink, my vape is how I unwind at the end of the day. Just switching to wax once I use up my last pen. Better for the environment anyways!
sherdog12345@reddit
Is wax still legal?
dukejcdc@reddit
It is! Pretty much everything but prefilled vape pens is still legal
sherdog12345@reddit
What is wax? Does it have an odor?
Assume a vaper who sneaks it around. Is wax trouble and asking to get caught?
dukejcdc@reddit
I like wax, it still smells but it doesn't linger at all. Easy to carry and blend in so it's not too sus
whinybear22@reddit
You can still easily buy them from online vendors outside of Texas. The ban only prevents TX companies from selling them.
gizzledos@reddit
Not anymore.
Suspicious_Job7436@reddit
Do you know what websites we could order from?
dan1361@reddit
Wax is healthier for you anyway! You can vape herb too, if that's an interest.
You getting an e-rig or use glass?
dukejcdc@reddit
E-rig, Been looking at the puffco pivot. I had a puffco a few years ago that did well for me
BootyGangPastor@reddit
puffco is so overpriced for what you get. buy a yocan pocket or phaser ace 2. full sized rig go for the dr dabber
Freejak33@reddit
mine broke within 2 months. was cool while it lasted lol
BootyGangPastor@reddit
which? the puffco?
Freejak33@reddit
yeah, the nice one too,. like a typical stoner its jujst sitting around and i never sent it in.
BootyGangPastor@reddit
it probably just needs a new chamber, i’ve heard those go out pretty often. like $45 i think
jwptexas@reddit
Puffco and some 710 labs 👌
BootyGangPastor@reddit
both overrated and overpriced af lmao there’s better quality rosin and e rigs for better prices trust fam
WhirledNews@reddit
Ok… so what are they?
BootyGangPastor@reddit
as far as rosin goes, there’s better small batch rosin on the oklahoma market for much better prices than 710. personally i’ve been enjoying the new drop from basketz and zen cowboy. as far as e rigs goes, it depends what you want. for full size rigs the dr dabber switch 2 is top of the line, for portability the new yocan black pocket looks like a killer, ill be picking one up soon since ive heard good things.
WhirledNews@reddit
Cool, thanks for the info.
jwptexas@reddit
I just use my puffco plus and the 710 labs is about the best I can find around here
dan1361@reddit
In that price range, the Pivot is gas. Super flavorful hits. I think I saw Retro Revolution off Greenville had some last time I was in there. I know 710 Vapor has them too. The water pipe adapter is worth it, if you already have glass. Makes it rip way harder at home.

Update on this as of 7:20 pm. The public health committee chair “sees no path forward for the thc bill and will not meet tonight”
This doesnt mean they dont meet tomorrow or the next day or the next though. Now is not the time to get complacent.

Your post was removed because it violated our Rule 1, just for reference.
starsfan26@reddit
Vapes I got from CO and CA were so much better it made me worry what was going into ones made locally. So for me, it’s not a significant loss.
On principle, I think all these prohibition efforts are beyond dumb.
noncongruent@reddit
The whole reason marijuana was criminalized in the first place was to give mainly Black people felonies so that they couldn't vote. Hell, the whole excluding felons from voting thing was also created specifically to strip Black voting rights. It wasn't illegal to vote as a felon for over a century in this country.
normanboulder@reddit
Thats not really true, it wasn't all about race. Look into William Rabdolph Hurst. It was mainly $ and greed.
urbangentlman@reddit
It was a large part. Harry anslinger (?) was head of some three letter and said that stuff would make the black people play their devil music and make the Mexican man stare at the white woman twice
cappy1223@reddit
Yes, and looking back they'll probably teach that Harvard was brainwashing students, and that's why the national guard was brought in to take over the school.

psychokillahbot@reddit
The National Guard was not deployed to, nor did it take over, Harvard.
PM-ME-UR-DARKNESS@reddit
He did that to drum up funding. Though he probably was racist too.
Suspicious-Pea-7481@reddit
It's not illegal to vote as a felon in Texas.
BaneTubman@reddit
Truth isn't allowed here if it doesn't align with the woke left
Suspicious-Pea-7481@reddit
I am literally speaking the truth. I don't understand why being downvoted lol I AM a felon myself, and I vote. 🤷🏼♀️
noncongruent@reddit
Only after completing the full terms of their sentence, including paying any fines due, and finishing parole with no violations. Get convicted of a minor marijuana offense, plea out to five years, with three years of probation, and a fine of $2,000 and you can't vote until the fifth year and paying the fine. Most people with felonies on their records are too busying trying to survive in a country that doesn't think that felons deserve jobs or a roof over their head to vote. There's also the issue that man Black people, after seeing what was done to Crystal Mason, decide to just not vote, voluntarily ceding their voting rights.
Suspicious-Pea-7481@reddit
I'm a 40-year-old convicted felon back in college can't get a job barely roof over my head but you best believe I vote!
noncongruent@reddit
I'm glad to hear that! I personally think that nobody should lose the right to vote, ever.
Ymd404@reddit
Or the right to work and live after you've completed your punishment. But here the punished continue to be punished after they've completed their time.
noncongruent@reddit
Our society sure seems to be spending an inordinate amount of effort to create and ensure the continuation of second class citizens.
Ikoikobythefio@reddit
It was a whole lot more than that. Cannabis was termed "marijuana" for a reason....and it wasn't black people
SpecialMud6084@reddit
Not to mention free labor for the state!
ResponsibilityBest43@reddit
Almost none of the vapes being sold in the TX shops had any THC or THCA.. because state law dictates that any product with over 0.3% total THC (∆9-THC + 0.877*THCA) is illegal. The shitty ones were typically mostly Delta-8.. the decent ones were mostly HHC. Some of the products the shops sell are marketed as THCA but when you get a look at the COA, 99% of the time there's not any THCA at all. The synthetic cannabinoids are rampant and undermine the integrity of the cannabis industry.. which is why Cali, Oregon, Washington, and Colorado have banned them.
BraveStyles@reddit
Vapes you got from Colorado and California are THC based aka Delta 9, ours contains no THC or 0.3% (or less).
Otherwise all deltas are already available within the plant itself just at smaller quantities. They remove delta 9 via the same methods used in CA and CO distillate production.
EpicGamingGuru@reddit
Laws can be rewritten altered and or removed depending on the circumstances. Texas is one of those states that basically takes away all that and forces the public to effectively outright illegalize or legalize whatever they see fit. (Most signed legal documents are not even publicly disclosed unless already put into law). Which honestly that needs to stop. It should be by the people for the people regardless of what state.
To make matters worse they've done this already around three times. Abortion, Illegal use of construction funds and of course their hardass stance against anything marijuana involved.
Texas has also lost a majority of money because of the lack of funds flowing through these shops. It was estimated to be more than 28 million dollars per year in sales for smoke shops alone. THCA or Nicotine otherwise. Despite these shops paying their fair share of taxes and of course affecting economic growth and we'll being of it's public citizens. Texas decided to go out the pointless route as usual.
EtchASketchNovelist@reddit
It's dumb, just like all the other laws the big government Republicans have enacted. Cigarettes are still here, but vapes are gone? I know folks who are quitting smoking, using vapes to gradually wind down their dependency and this distraction makes it harder.
Nothing like that "all natural" technique of breathing legit fire combustion shitstorm into your lungs! Glad we're healthy again! Lol
If you ask me, the real solution is to ban smoking for anyone born after a certain year.
biggustittus@reddit
You can still buy nicotine vapes. Just not pre filled imported vapes that no one has any clue what’s inside it. It’s a national health risk considering 1 in 4 high schoolers are vaping.
FollowingNo4648@reddit
Im still puffing on my THC vape I got from Jersey visiting my parents. Way better than the Texas stuff, and they deliver.

I think that it’s kind of ridiculous to make something legal, allow businesses to invest millions of dollars in the industry, realize there are idiots out there who think THC gummies are okay to eat by the bagful and give to your kids and pets, then make it all illegal and require all these businesses, growers, suppliers, and shops to retool. If somebody left their bottle of opioids out and their kid got into them, they would blame the parent, not the opioids.
On the plus side, there is still medical marijuana in Texas that is legal and allows for THC just not in flower form.
fureinku@reddit
Meh, it made it easier to get, or variants/derivatives, but a ban wont make it impossible. weed has always been illegal here and we got a handful of years of “legal” stuff, itll just go back to the way it was before where you just gotta know someone.
ImReflexess@reddit
Just buy it online and have it shipped directly to your mailbox. No risk of being pulled over then.
arlenroy@reddit
I just saw an ad for Cheech and Chongs company, vapes, gummies, and seltzers. Ships to all 50 states except 1, like Montana or Wyoming. Granted, their vapes are $50, little pricey, but if you're in a state where you can't get anything, then its better than nothing. Can't smoke a joint on your porch while listening to Radiolab, but you can go to Applebee's and drink 14 $2 Long Island iced teas then attempt to drive home 5 times over the legal limit and hit a bus full of nuns and impoverished children from Albania causing the driver to lose control plunging off the 635 interchange killing everyone on board. This country is ridiculous.

Just gotta know someone, and hope you’re not unlucky enough to be pulled over and arrested on your way home.
It happens everyday in DFW, and possession of a THC oil cartridge very similar to what was just banned will make you a convicted felon.
TemporaryRespond4076@reddit
Not true. Tarrant County DA won’t prosecute anything under six ounces
FaxxMaxxer@reddit
You’re simply wrong.
They prosecute any amount of THC oil possession over .3%. Look it up. It’s a well known thing.
TemporaryRespond4076@reddit
Find one case
FaxxMaxxer@reddit
Here’s alaw firm that specializes in these exact cases, and outlines Tarrant County’s published policies on how THC oil is hand
Homey-Airport-Int@reddit
It's a criminal defense firm. They "specialize" in first offense DWI, multiple/repreat DWI, Marjuana/THC products, intent to distribute, retail theft/shoplifting, burglary/trespassing, assault & family violence.
So a stretch to suggest they specialize in THC oil cases.
TemporaryRespond4076@reddit
You still couldn’t find one case?
McKMatt1970@reddit
Felon??? What are you smoking? It’s a traffic ticket at worst
FaxxMaxxer@reddit
Your ignorance of the law isn’t gonna be a viable defense if you get caught, so do yourself a favor and take 5 seconds to google it and educate yourself.
It’s a well known and established fact that it’s a felony in the whole state of TX, and Tarrant County isn’t gonna cut you a break on this.
bullgod1964@reddit
That's why when I am bringing back flower from Colorado or New Mexico or Montana. I only bring flower. Too risky for any kind of concentrates
texashempnews@reddit
People want access to safe products. Not to buy a sack off some dude in the CVS parking lot.
Homey-Airport-Int@reddit
I mean it's really not that hard to find safe product. Weed being plant matter and not a powder makes contamination rare. You can literally tell the quality by sight alone.
BootyGangPastor@reddit
find a better plug then, i’d trust my dude w my life lmao
khaotickk@reddit
It's not just as easy as finding a better plug. People have lives, shouldn't rely on finding sketchy cartel members to get a buzz or entrapment by an undercover cop.
TemporaryRespond4076@reddit
You think Dallas is undercover entrapping vape buyers?
I can guarantee DPD isn’t busting anyone for buying half ounces and vapes
Chava22611@reddit
Dallas pd never really even care they were really after bigger stuff than a person with a thc pen , even tho it was a felony. But come to smaller cities Rockwall, Richardson, Plano and specially Garland. Bet your ass they gonna lock you up ,tow your car and go beyond that to seizure your money. Im talking this from personal experience. And I think you can have up to 3 oz before it becomes a felony where you can simply get a ticket if your lucky with what city you in
texashempnews@reddit
They definitely are and will likely ramp it up even more now that this vape ban has passed.
BootyGangPastor@reddit
sketchy cartel members lmao we literally border a fucking med state dude. go find someone with a med card, you people are so helpless. weed was illegal for many, many years before this and we managed just fine.

I'm sorry but the products you find in sketchy gas stations should not be considered "safe." People think these things are regulated, they're not. Maybe the company will post lab reports, maybe not. But when they do, almost 90% of the time it doesn't match with what's written on the package.
texashempnews@reddit
I agree. This is why Texas Hemp advocates have been pushing for sensible regulations since 2018. Instead, they have to police themselves, which is why you see bad actors (like those in gas stations) selling products that have 0 testing.
Instead, Dan Patrick & Charles Perry refuse to listen to the 79% of Texans that want regulated access to these products — and are pushing an all out ban no matter what. This is why there was no compromise and Dan Patrick ended the 2nd session last night via sine die.
If you are a consumer, I highly recommend you research companies and the product they are selling prior to consumption. Find a trusted vendor with reliable COAs, and stick with them.
As a result of Dan Patrick stubbornness, he has actually made things less safe for Texans, allowing these “gas stations” to still sell these unregulated products.
So if he really cares about protecting us, why doesnt he listen and pass regulations instead of bans? Its because he doesnt, and he wants to push his beliefs (and im sure his lobbyists beliefs) onto veterans, farmers, and every day hard working Texans.
This is not Dan Patrick’s state. This is OUR state.

Personally, I am so sick of hearing we need to ban everything to save "the little children" from getting it. Dan Patrick seems to be a control freak that says, it's my way or no way. I applauded Greg Abbott for vetoeing the first ban on Hemp earlier. The only way that I gave up smoking cigarettes 4 years ago was switching to nicotine vapes. Now I don't have the right to purchase them! I can still buy cigarettes though. Big PAC money. I am an adult, not a minor, but the State of Texas does not care. If kids want illicit drugs they will find them, if they want alcohol, cigarettes, weed, they will get it! Regulate- Not Ban adults from exercising their freedom. Ban the kids from eating sugar and fat --that will kill them faster than nicotine or THC.

TheBungoStrays@reddit
There was an article talking about how business owners aren't happy with this bc the law clearly only made SELLING them INSIDE of texas illegal. It is not illegal to buy them, possess them, nor is it illegal for sellers to ship them to you. So you can easily still buy them - you just have to buy from out of state online. However the new medical marijuana law does include being able to get THC vapes so I'm assuming the dispensaries from that program will be able to dispense them there (with valid medical diagnoses ofc).
brobradh77@reddit

pianistafj@reddit
If I had to guess, TX is either expecting its own push for legalization or federal legalization is expected to pick up. Probably within one to two years.
Why? First, they hastily banned THCa vapes that got overturned. Now, they’ve banned them again including nicotine vapes (imports iirc). During this process they gathered info on the entire sector so they could properly value its potential. These bans now are to squeeze out the small shops that solely rely on these products, so when legalization comes they can let all their cronies in first and buy up all the allotted stores/licenses. This is resetting the market and driving anyone that uses vapes to cigarettes making good on Philip Morris’s 1.9 Bn “donation.” Ironically, the state should expect upwards of 6 Bn in annual cannabis revenue alone if legalized.
Open-Bed-1933@reddit
This right here. Most of those shops are owned by Indians and such in my part of the state so this definitely tracks.
DigitalDemon75038@reddit
Well there was HB 46 that just took effect, open the doors for some and close the doors for others

It’s sucks because I was using it for my lower back pain!
MysteryMooseMan@reddit
Look up Modern Herb Co uncut live resin THCa vapes, I can vouch they work great and aren't made with any solvents which is a huge plus. Ordered mine online
TheBungoStrays@reddit
Chronic pain was added to the expanded medical marijuana program. It was supposed to fully launch Sept 1 bc the law went into effect then but I think they are still working on stuff. I think now they are saying Oct 1. Drs have to register and they expanded dispensaries from 3 to 12 and are allowing satellites to operate from those 12. And the they will have a system that sounds pretty similar to how controlled rxs are tracked - where the dispensary can look up the Rx and what all has been dispensed and where and from whom.
Pale-Succotash441@reddit
Lazurus Naturals online has some really good tincture options that are great for back pain

Anyone have a plug for pens? My guys stopped, not cause of this or anything the just don’t get pens like that anymore
Good_Science_3176@reddit
Crazy how bans push people to quit faster than any PSA ever did, forced detox mode unlocked.
JadedRaisin6199@reddit
Is there any online store that ship THC products to Tx?
NazgulGinger917@reddit
Government has no business banning things proven to not have immediate health complications.
rgg40@reddit
I read they are trying to work out a compromise, not a total ban, but strict regulation. And if they do pass a ban, it wouldn’t go into effect until January 1, would it?
dan1361@reddit
That's for all THC. This is just disposable vapes currently. That could change tonight. We'll see.
FriendlySeekerSarah@reddit
They’re done now, it’s all on Twitter.
dan1361@reddit
THCa still legal from what I can tell. Woo.
FriendlySeekerSarah@reddit
Yes it is for now. It is highly likely it will become federally illegal in the next two years thought.
Moderately high risk of federal prohibition—especially via FY2026 spending or Farm Bill revisions that redefine “hemp” to exclude THC derivatives.
A bipartisan coalition got the Senate Appropriations Committee to vote 27-0 to ban most hemp-derived THC products, so it was a unanimous vote and there is very little pushback from legislators on either side about closing that loophole at a federal level. Many of the supporters are THC advocates, but they advocate for legal THC regulation federally and/or, in most cases, to leave it to the states to decide individually.
So there aren’t really any experts that see THC derivatives or altnoids staying legal much longer. Better than being gone right now though!
But good news
FriendlySeekerSarah@reddit
It’s over for this session officially now. No ban no regulation.

No, they are working on a total ban tonight. I posted it earlier and the mods nuked it

Tbh getting a delta 9 (regular weed THC) is safer than the shit they put into these THCa vapes. There are so many variants like THC-o, thc-p, thc-x that have never been studied being put in.
I’m not saying all are like this but the gas station/ sketchy places have some either straight boof or these random chemicals.
BootyGangPastor@reddit
the problem is thca by definition can’t be turned into distillate, so they gotta fill em with random ass altnoids and fake terps to be “legal” because if they decarbed it it would just be D9, and if they don’t THCa is essentially just crystals
high_everyone@reddit
Texans deserve better than the unregulated THCa carts sold in smoke shops. Most are just THCa derived distillate with botanical terps added afterwards.
Look into vaping flower or concentrates.
As an 8 year THC cart smoker, I walked away from them completely earlier this year. I don’t miss them. The high achievable from them is mediocre and not as effective as say like smoking rosin in a vaporizer.
I did the best I could to make sure my carts were from clean and legal state sources but you honestly cannot avoid distillate carts in any market and the ones sold here were always of lower quality than what I was getting from legal markets. Be glad they’re gone and vape something better and more effective.
BootyGangPastor@reddit
most of em aren’t even that, they’re typically 90% delta 8 or HHC. which is cool, other than the fact that the labels always say “super mega strong 99% thca live diamonds”
BlackStarCorona@reddit
I haven’t used it in a long time, but for me the thought process is anyone over the age of 21 who can buy alcohol should be able to buy weed. I do think it’s dumb to have wacky flavors of vale pens like tropical banana blast or whatever.
I also think it should be taxed like in other states where it’s recreational.
BootyGangPastor@reddit
i’m a grown adult, if i want to vape tropical banana blast i should be able to. i say as i’m filling my vape with blue slushie flavored juice lmao

Closest shops are 5.5-7 hours away in New Mexico depending on traffic. An early Saturday gets you there and back at a reasonable time.
rgg40@reddit
Or New Mexico
croissantzzz@reddit
Vapes aren’t regulated anyhow. I say good riddance
ayyoogunsofboom@reddit
Sucks cause i used to be able to walk to the plug now i gotta get it through a coworker who brings from CO
Ok_Statistician643@reddit
I get mine in AZ and ship it to myself. I buy several months worth at a time
Sticky_Gravity@reddit
Doesn’t matter tbh. Black market will do its thing like it always has. If you struggle about the ban, you need a better vendor.
BCMBCG@reddit
Cannabinoid vapes are now illegal to sell. If you get your hands on one as a consumer, nothing has changed regarding personal possession. Retailers also can’t sell stuff that can be construed as marketed towards children, so flavored vape products are also limited.
As always when we pass laws, everyone is scrambling to figure out how the fine details will work out in reality. Cautious retailers are probably clearing their shelves to limit their exposure to prosecution
