You really don't see the problem with that sentence? Why would an even remotely intelligent murderer choose a judge when they could simply avoid trial entirely?
One of the first questions that anyone worth listening to will consider is "assume that sadists will attempt to game the system. how would they try to do so, and what measures are there against their success?"

They work to keep you free, so long as you go along with the proper legal proceedings. Your question is no different than asking:
"Why doesn't everyone move to a country where murder is legal? That way, you know that the government will never lock you up in case you commit murder."
"Doesn't arresting your own citizens tarnish a government's reputation? Who would want to live in a country where your own government might put you in jail?"

The market, as in people's aggregate preferences. Since most people are not murderers, they demand that murderers be found out and prosecuted.

That's not market, that's one-size-fits-all, common denominator chosen by the majority and imposed on all regardless of consent. A market would allow each person to choose their own justice system that works best for them. That being said, I'm of the opinion that justice is one of the few things that is not better handled by markets, and one of the rare functions that the government should actually have

Nope. There is no majority vote. Each person chooses their own security provider. Governments don't do anything well, and important things like security should be the last thing we entrust to them.

If there is no majority vote, how is the majority decision (i.e. murder is bad and can be prosecuted) reached? Where does the power come from that makes something illegal and enforceable? If everyone is able to buy into their own security regime, what is the basis of the overarching rules by which they all must abide, and what consequences occur if those rules are broken, and who enforces those rules?

What stops the defendant from continously denying the authority of the proposed judges? Given how there is no body to determine who is and who isnt a judge, a defendant will never see court if he doesnt want to.

Quick question. Who is the authority that gives authoritativeness? How do they implement said authority? What stops a gang from acting as a private defense org? Or really just any single income source funding them and making a private army?
