There's no strict guidelines for proportionality assessment.
So investigators ask for strike assessments and legal reviews, and Israel provides them, and it shows that there was a militant.
The ICC has given arrest warrants for Netanyahu and Gallant, so the UN does think they're guilty of war crimes, where war crimes are essentially related to excessive civilian harm related to military advantage.
But the ICJ likely won't rule that it's a genocide, because of the legal paper trail suggesting it's legitimately a war against Hamas, with civilian deaths exactly what is expected from urban warfare, rather than a specific intent to destroy Palestinians, of which there are still 2.3 million in Gaza, more than when the war started.

To my knowledge,
Hamas claims 57k civilians killed. IDF claims 21k militants killed. And about 1k dead IDF soldiers in Gaza.
The number of Hamas militants was estimated at 30-40k.
So I don't doubt the numbers are fudged. But they're about what is expected for a legitimate war against terrorists embedded in civilian population.
1000 IDF are dead because they encountered militants. It's not higher, because Israel drops bombs instead of risking soldiers when they can. But I'm saying they do it all with proportionality assessments. So at least in my view, it's unlikely they will get a genocide conviction, because the numbers are what is expected.
You can have your claim that the IDF numbers are wrong. You can call me a genocide apologist. I can say Hamas numbers are wrong. I can call you a terrorist sympathiser. But none of that matters. The ICJ decides, based on evidence presented.

Even if we take the IDF at their word that they were targeting a high-level terrorist, why did they have to fire the drone at that exact moment, while he was apparently right next to a clinic filled with pregnant women and children? What, are we supposed to believe the drone operator didn’t know exactly where they were shooting, and exactly what might happen if they did?
I feel like I’m losing my mind when over and over again they keep making this same excuse, which still wouldn’t justify their actions even if it were true, and the entire world - aside from the aid workers and journalists risking their lives - is doing nothing.

The IDF is too cowardly and incompetent to be expected to get one starving dude out of a crowd of starving children. They roll into Gaza inside their armoured vehicles to stay protected from sniper fire, but then a dude runs up and throws a satchel charge down the hatch. They've bombed everything so there's loads of rubble to hide in and it's hard to see out the armoured vehicles so a Palestinian resistance fighter can just run up climb on top. If that's what just one fighter can do think about how many IDF fighters a Palestinian could kill when he has dozens of children armed with bread to back him up.

FYI, they killed a bunch of civilians in line for aid, to get ONE suspected Hamas terrorist.
This is technically illegal as the target has to be "worth it and require immediate action". No reasonable person would say killing a bunch of kids looking for aid, is worth it for a single former combatant. The USA never did this. When we'd kill civilians it was always for high value targets where we had no other window of opportunity. It would go through legal reviews and multiple people would have to sign off on it. Most of the time, however, if it was just an Iraqi terrorist around a bunch of civilians, we'd be forced to just let them go and hope for a better time, because killing a bunch of people for a random ass single terrorist would be a war crime.

This applies to both America and Israel. The Israeli government dehumanized Palestinians to the point of quite literally caring about animal rights more than the rights of their biggest religious minority (I saw a Gaza dog rescue video done by an IDF soldier. This isn’t even funny.)
America dehumanizes immigrants and Latinos in the same way. Portraying them as poor, dangerous, “Alien”. As a non American, I was shocked when I first learned about the term “Illegal Alien” because of the sheer absurdity of that term. But now I know that it’s very much deliberate because they don’t want you to see them as people. Just an evil entity that should be removed.
