First check app permissions on company apps. Second the eld device might have ability. Start with a company app. If installed check permissions.
If you have 2 devices and I think all Truckers need 2 devices. Turn off the device with app while using the other device. Also monitor app usage of data as that'll tell you. As to on board end all you can do is run loud obnoxious music near the mcrophone. Get a small device with bass and run it near the end device below the hearing you need but near anything looking like a microphone on said tablet or Qualcomm. Both have microphone ports. You could just run a vibrating device near it also.
But if outside the truck it's more likely the company app. But to prove it. Set them up. Say you heard so and so is going to start doing pranks like liquid ass on door handles soon. Make sure to wipe all handles before using them. Then do that visibly near dispatch. You need say it'll be a prank of course and not you doing it.
Ad to the routing your eld is the narcissist or the truck itself is. Both give real time data and can flag you for routes.
Again start with company app permissions. Then if microphone enabled please disable it.

Don’t know for sure if it will work, and I’m not familiar with the cab of a truck. However if you’re able to take or turn off anything that transmits radio signal switch to an empty am station and listen for a “pulse” you’ll have to do this first with a vehicle that you know isn’t eavesdropping.
If the gps is constant you’ll pick that up and won’t know unless you can hear 2 pulses. Hope you get it sorted man.

It probably says that because they did not install a microphone in the truck to listen to you. It's a shitty way of saying, "We didn't install a microphone... But the dashcam has one built into it... We just didn't take the time to disable it specifically."
As a 20-year veteran truck driver who drove for a government agency for most of that time, they are listening. Now I'm working for another government agency in transportation but not a driver all the time, I'm in charge of the video monitoring for passenger carrying vehicles, which includes a dashcam with driver facing cam, and several other cameras inside the passenger compartment and outside the vehicle. All of those cameras have microphones built in, and the system records them with the video. My specific department doesn't care about what anyone is saying on the video, but whomever requests and gets a video pull approved, might.
Obviously, that type of thing varies by company, but it is most definitely how they know what you're saying without having to install a stand-alone mic specifically. They also have alerts they can set to know if you took a certain route or a geofence for when you are in an area they dont want you. Some systems just send an alert to the company, and some will save and send videos along with the alert. It depends on which system they are using. All the dashcam systems have a built-in GPS to them.

Honestly think it’s just paranoia. Nobody has time to just sit there and listen to hours and hours and hours of your audio just to see if you say something. It’s likely just a coincidence that some of these things are happening at the same time. They do probably have the truck gps tracked and can see where you drive. You may not be doing as good of a job at cheating your logs as you think you are and they noticed it.

I called my dispatchers and the company every filthy thing you could think of and spoke directly to the camera knowing they could hear me, telling them I knew, and cussed them a blue streak even talking about their mothers and their sex life with animals. I wanted them to listen and meet me in the parking lot ready to go when I got back. Nothing. But I also know that Im a union employee and they cant use cameras or microphones for discipline infractions so tough shit for them; fuckem. The funny thing is if I said anything like that in front of them it would be insubordination and a termination offense but then you go before the board and you get a second chance you cant be fired for a first offense unless its overt like wrecking the truck, stealing or fighting.

I worked in the place of fleet manager for the better part of 2 years. Each driver had a front/rear camera with microphones. Everyone was told that we don't watch and don't listen, it's strictly for accidents/emergencies. That was a straight up lie. It would take about 3-4 seconds for me to sync up with any drivers camera and I could watch. All the managers did it, they all talked about it. Since then, I've driven for 0 companies with cameras and I'll never manage again.

If you have a driver facing camera I always assume those motherfuckers have audio. Even if they say “They have a microphone but we disabled it” yeah bulllllshit. I have had this EXACT similar thing happen to me a few weeks ago. I was bitching to a coworker (this truck is just a regular company pickup) about a dude that works in our office about a very specific issue from a month ago and we get out of the truck for lunch and not 10 minutes later I get an email from this dickhead about the exact thing we were talking about, but my crewlead swears they have no audio, but of course I figure out the office dillweed is the one that reviews camera footage for infractions.
Those cameras have audio and I’ll die on this hill.

I’d say test your theory with something they wouldn’t know unless they heard it. Maybe talk to your friend about having trouble sleeping and see if they try and pull you for a sleep study or something. If they’re breaching not only policy but the law (in some states both parties must be aware of recordings) then yes, you should be able to file suit as long as you have evidence.

And same with running logs, typically there’s someone (usually the same one who reviews footage of cams) will review logs as well and can probably tell the difference between gps switching from driving to on duty not driving mean while your logs say otherwise.

Not a trucking company, but the school bus company I worked for said the same thing: “we have driver facing cameras, they have a mic, but we disabled that”
Then months later an accident happened and we got to see the footage as a PSA in a mandatory meeting. They blurred the face and any other identifying markers of the bus, but not that that helped anything, everybody knew exactly who it was. But they didn’t remove the audio from the footage. You could hear everything. And while nothing ‘compromising’ was in the audio. It did compromise their promise, which was in the handbook, of having the mics turned off.

yes to audio, possibly hidden video but probably not, but where they are really able to get you is via your phone, especially larger companies.
for your phone to get singled out they would need a reason, but it's not at all difficult nowadays with a little bit of money (which larger companies already have invested for recovery/brand security).
essentially if there is a need (there always is) and someone's got the money and the network, there are plenty of professionals able to gain access to someone's phone. the extremely large corporations like walmart, fedex, ups etc. would already have these people on payroll. legal or not is beyond irrelevant, your phone's security can be breached a hundred different ways, especially if you're using your company's proprietary software, in fact, it is probably even vaguely indicated within the user agreement in such a way that can protect them in the event of successful attribution on your part.
you can actually download the pdf or copy/paste the user agreement to the company software and upload it to chatgpt (the free version works). ask the bot if there are any vague indications of device monitoring via the software, or what could potentially lead to a privacy breach, and what the company's policy/liability is.
chatbots are really good at reading these kinds of word-puzzle documents and delivering it to you in simple language. it works in seconds.

Employers typically don't want to go down that rabbit hole, so they'll always have some kind of justification, regardless of how bogus it is.

My company says they don’t have driver facing cameras or mics. My first trip solo for them (during 90 day probationary period) I ran over a cola bottle in the road so pulled over emergency stop at on ramp. I heard a voice as I got back in the truck cab, “everything okay?” I replied yes. Never before had I noticed the micro tiny speakers on each inside panel of the windshield area. Needless to say, now I know there’s no privacy in this rig. My ELD is on a tablet. I cover the tablet camera with tape but the mic on tablet still works. Screw it. Let them hear me sing off key.

Ya, I guess it's unclear from the story in the post. I just assumed they tested it by simply talking about cheating logs but not actually cheating logs. If they were cheating logs then it's easy to see GPS movement that shouldn't be there.

I’m local and have forward facing cameras so they can just log on my camera and see where I am. On top of that at the end of my route I have to print out a shift report for keeping track of how much bulk propane, gas, diesel, etc I delivered that day. Right at the bottom of the shift report it says attempted gps reads( usually 100+ in 8 hr shift) and then confirmed gps reads ( usually 30-40) so ya big brother is always watching and tracking me.

So either the company can see from GPS (and probably tolls) you’re driving a road they asked you not to. And they can also see your logbooks don’t line up to your GPS
Or they’ve got recording devices not only on the inside of the truck but also on the outside that can somehow isolate just your voice over all other noise and are paying people to listen to not only you but also every other driver - and it would have to be all the time because they don’t know when you would or wouldn’t be talking to someone. So they’re paying another full time wage just to be able to make hints to you they know you’re doing stuff you shouldn’t be?

Even had one of the office girls bragging about pulling up a particular driver’s camera just to listen to what they were talking about on the phone or whatever. They had cameras with audio in the drivers lounge and outside and all around the yard. They were really bad about snooping and spying. A few of us went to the HR lady about it and she was pissed. After that, they still did it though so a bunch of us quit. Screw them

All company trucks have gps my company has them set to a geotabbed area so when I go there it sends an alert hey storm warning or crime etc so they could do the same for themselves for restricted roads as for listening if you have any cameras the can watch them any time they say they can't but they are able to at any point ive seen it on multiple occasions with different companies hell I had one where we would shoot shit in the office and pull up cab cams to see how they were doing( local delivery job) if they needed help and such but its part of the safety I guess so 100% cam probably caught you or you just ain't that slick my guy

The GPS will tell what roads you are taking. They can set a geofence to notify them if they want to set it for those roads they don't want you on.
As far as listening to you in the cab, it's their truck. They can do as they please. It's just like the cameras at the terminal. Until your company name is on the door you gotta deal with whatever company you work for and what they want to do with their stuff. The LTL company Saia will tell you all about cab recorders. They gotta watch what they talk about in the cab all the time.

The cameras def record audio. Was in orientation where we reviewed driver footage and we could hear the truck and what the driver was saying. What you say in the truck can absolutely be used against you, even if the company misunderstands or misinterprets.

As far as cooking the books that's easy if you run ELDs because the company clearly doesn't trust you or your buddy so they pay special attention to everything you do. However you did say it was a hypothetical conversation and that you didn't actually do it (I think) so occams razor.

Its often quicker and easier to call you and ask your ETA than it is to log into the portal, go to the truck list, find your truck, load the position history and figure out where you are so they can figure out when you'll be getting there.
But if they want to, they can most definitely see where your truck is, where its been and exactly which route you took to get there.
So if you take a route they don't want to take, they will know without needing any kind of listening device in the truck.
Also, most ELD software will produce a report that shows them every time a driver made an edit to their logs. They can see the edit itself and what was changed and what it was before you changed it. And so can the DOT if they look at your logs. Again no listening device needed, they can see that easily on their end.

There's a certain Mega carrier that does the listening part and other driver's know it. They are very heavy on surveillance for whatever reason.
Locating you and what routes you take is not surprising; that's a norm but the eavesdropping is another matter.
The mega I worked for claimed they had outward facing cameras (which they did) and claimed that they are able to see in the can but the reflection of the windshield.
I did quite a bit of driving in the dark to know that, that wasn't the case; suspected they actually had a camera that was on you, tested it out and got a phone call an hour later asking me if everything is ok.
I had the camera covered after that.

If they do, in certain states, it has to be explicitly stated. Certain states have two-party consent laws meaning they can’t covertly record you and use it legally without you knowing about it. Maybe internally they can use it, but if they try to fire you over something you said, and they never informed you in writing about your audio being recorded, you could fight it.

My company also has driver facing cameras and I always talk mad shit about my dispatcher and other office people with a buddy who has the same dispatcher. We call him Daniel the Penis Head in our calls and we have yet to get called out for it. I’m pretty sure there’s no audio on ours and if there is maybe they haven’t monitored any of our footages while we’re talking about any of the office staff.

Sure as shit lytx drive cams have audio pickups, along with stealth recording settings. These cameras also have a stupid rudimentary A.I. to read speed limit signs inconsistently, and other infractions.

I’m the safety guy for a trucking company, and to just clarify one point, the cab of a truck doesn’t have an expectation of privacy. It’s a workplace.
I know it feels private, but while you’re driving you’re working and it’s not private, it’s work.
Sleeper cabs make that difficult to draw the line. Our cameras only turn on while you’re driving. Also you have a curtain to pull across the sleeping area.

GPS for sure. Last company I worked for had them on everything. Trucks, trailers, had a handheld that could be tracked. Even when it's turned off I'm sure. The find my device kinda thing. Have heard some forward facing cameras have audio capabilities.

had a company telling me not to text when driving, even though it was them I was texting to reply to them spamming me
at first i didn't think anything of it since the truck didn't have a camera hooked up except on the front bumper
but after a few weeks one of the managers said something personal they shouldn't have known anything about as I hadn't discussed it with anyone at all. that's when I realized they were 100% spying on me, poked around the tablet for installed software and found some monitoring software.
after some research I confirmed they were using the tablet. I put electrical tape on the camera and mic after that and quit shortly after.

Ours definitely have audio. I swear those guys listen to me. Ill be talking to my wife and be like "wierd its x o clock and I gavnt dispatched a pickup yet. Then 10 seconds later a pick up comes through. The thing is though I know them dispatchers don't have time to be listening to all of us drivers so I've just convinced its coincidence.

If your trucks have GPS tracking or the like (and in this day and age, they probably do), then that's really all they need to nail you on those issues. If they've got specific roads flagged as Do Not Use, then it's likely fairly trivial for them to get reports when a GPS'd unit uses them. Playing games with your logs is another thing they can match against... If they're calling you in on this then they're likely doing it as a "soft" warning. Nothing official, nothing explicit, but a kind of "heads up, we see you there" kind of a thing.
It's also likely they're working to build up a list of policy violations, logging it down so if they have to go down that road, it won't just be a case of "get out" but "you violated policy X on date A, B, C, and D. You violated policy Y on dates 2, 15, and 21" so that they've got their asses covered.
