Got fired from XPO they want $10k back?

Hi I was a student under contract for 2 years. They fired me, and now they’re asking me to pay for 10k back. However the method of payment is super sketchy. They only want it via check or money order and it has to be sent through USPS.
Did anyone experience this? I can’t find answers anywhere

You signed a contract, expecting employment.
They signed a contract, to train you, and you give them your time.
They breached the contract, by terminating you, therefore by extension they also terminated the repayment contract.

It's a female driver (based on what I've read here) but that not withstanding, it appears to be retaliation from her not physically doing mechanical repairs, which she is not trained/capable/willing to do.
They hired a driver, and if they needed skills beyond that, they should have said so.
I'm not saying what's posted here is 100%, there's multiple versions and then there's the truth. We don't know the "whole truth"

Being a driver means doing minor mechanical repairs such as fuses, bulbs, and maintenance items like putting air in the tires when needed. If you're not willing to get your hands dirty while doing the job, then just quit completely. You're just a draining the system and making the industry look bad.

Not on a company truck. Only thing a driver should be doing is checking and maintaining fluid levels, tire pressure and changing the fuel filter. Everything else needs to go to the companies roadside

Because it's part of their generation. Get off your assumptions and read the words for what they are, not what you want them to be. They're getting into the job thinking it's going to be easy money just driving all day, and it's a lot more to it than that. She is complaining about having to do light mechanical stuff that should be common knowledge for every single driver on the road. Stuff that is taught to them in cdl class. If not, their class failed them and shouldn't be a class at all.

I don’t know what school you went to, but I wasn’t taught to change my fuel filter. I’ve been a company driver as well and I’ve NEVER had to do anything besides basic pre trip/post trip stuff ole tire pressure, fluids. Who’s telling you to change a fuel filter on a company truck?? As an Owner Op I do alot to cut my costs but I would never have my Employee touching that type of stuff. You know exactly what you were referring to writing that comment.

I went to roadmaster they only teach you how to pass the state test and they were open and honest about that from the beginning. My first job was with TMC and our driver trainers teach you that in your 1 month training to change the filter. We do alot of jobsite driving and it gets dirty quite often. I lost engine power and got stuck in thr mountains one night and it would have taken forever for roadside to get to me lol. It's not a hard process and only takes about 10 minutes if you got a cup to drain the diesel into.

I think it's well known TMC is just different lmao. But I appreciated them because I dnt think I would have learned how to drive as well as I did from any other starter company tbh. XPO l does have a list of things drivers can/should repair. I've replaced mud flaps, lights and fuses. Along w all the basic pressure checks and fluid topping off that's needed. I

6 months in is more than enough time to expect them to know those basics. Those are things that should be known about their personal vehicle by that point, and they're the same concept able to be applied/transferred over to cmv's.

I agree to, in theory. I don't work on or drive trucks but I work on industrial equipment. The operators are expected to be able to address minor stops, but that's kinda looked past it their competent enough with keeping their other stuff responsibilities in order. Lots of dudes don't even know how to stop the machines properly but if they ensure we're running good product they've at least hit the minimum

I've worked corporate before I was a trucker. I got sign-in bonus, relocation allowance or whatever the company fronts to entice an employee (CDL training falls under this)
I've left those jobs before 2yrs were over, and while I was not fired, I never repaid those monies. They didn't do shit about it.
Now with trucking, they took a risk and trained this person. Unfortunately this arrangement was "not a good fit", and the company chose to separate. It's their loss to eat, not the terminated persons responsibility. Sadly, truckers are so brainwashed and fearful that they simply bend over and take it. These companies know it, and they shove it in balls deep, in the ass, Everytime 😂

Yep. All these contracts will state when you'd owe them money for ending employment. XPO is a billion dollar company. Their contracts aren't gonna be vague or open to interpretation.
The only thing you can do is fight if you fit into that category or not, and that's best left to an employment lawyer.

That’s the problem with having a carrier train you. I got my Cdl for a couple thousand from an actual school. I wouldn’t pay it. Yes your credit will take a hit, welcome to trucking. I had a 780 credit score before I started. Now, I’m down to low 600s. Trucking beats you up. When times are good it’s great. Boy when times get tough it’s terrible.

Not really. Worked for FedEx Freight for 6 years, and the amount of people that came in, got their CDL and bounced was pretty significant. FedEx wanted their money back, but never went after anyone.

If you dont mind a credit score hit, Roehl transport fired me right before my contract ended and they asked for 8k in 30 days i refused and ignored them they put it on my credit report for collections under a lawyer called Lockhart and Morrison, 6 years later I disputed it saying I never agreed to pay that lawyer any money and they removed it 🤷🏻♂️

They cut my miles when I had a out 105-110k out of the 120k. I told my FM "I get my miles next week or I'm done." XPO is a global company. They have a team of lawyers who write these contracts. I think its a waste of time trying to take them on unless you're going for wrongful termination. These LTL companies hate paying those so they document everything before termination. If you can't pay it, let it go to collections, then settle for 10 or 20% of the 10k.

Ha. I worked for a global corporation who's lawyers were always messing up. Every time I pointed it out they had to redo whatever it was. I was right every time. Don't let their lawyers scare you.
As for the collections angle, once a collection company contacts you, or sues you, demand the contract that shows they're owners of the debt. Plenty of appellate case law they have to produce it. Bring it up when they send the letter warning of suit.

You may not have a case. Have a lawyer read the contract before you pay XPO anything. If your termination falls outside the terms of the contract, you may not owe anything. If it is in the terms of the contract you may owe the entire 10k or a prorated amount. XPO won't tell the truth, only a lawyer will be able to tell you. A few hundred for the lawyer to review the contract is far better than 10k

Reading your other comments re: possible retaliation… you don’t want a “pro bono” lawyer, you want a lawyer that’s going to take the case on contingency. Essentially, you pay nothing unless they collect $$.
Nobody’s going to review the contract for you alone for free, unless you’re a very good friend or family member of the lawyer.
But you may have an employment claim. Talk to an employment discrimination plaintiffs attorney.

I've never heard of such a thing. Have you actually heard of this happening. I've never heard of somebody putting a lien against a license. I know they can put a lien against property if they get a court order in judgment or you haven't disputed it. But I've never heard of anybody putting a lien against your license. I don't even know how that would work. Would they disqualify your license until your lien was paid off? It doesn't seem possible.
And have you ever heard of anyone blocking your cdl? How would they block your CDL?

I’m getting a lawyer currently because it was definitely due to retaliation. I’m a woman and I was getting harassed by one of the managers. I reported him to HR and a month later I got fired for “violating policy” their reasoning was complaints from the manager I reported, and for calling road service on blown air lines. Apparently fixing the lines is a DSR responsibility, but during class they didn’t teach us mechanical skills outside of pre-trip. They also didn’t require mechanical skills in the job description.

I looked at him and said, did we just become best friends? He said damn right we did. He then pushed his desk to the wall and I said, no fucking way bro. And we both just went a little nuts for a few minutes, totally forgetting that we were in a corporate office. At some point we noticed someone at the door and immediately switched back to normal human. He told me Id hear from them.. Fast forward a few weeks, his boss calls, asks me to come in. They wanted to know how I got the courage show my true colors without fear… I just said, fuck it yolo. Next thing you know they called a company meeting and asked me to demonstrate my courage. So now the whole company is super tight knit and it’s just amazing. If you feel like an attack helicopter, be the most badassest attack helicopter you can be

You don't pay anything while doing the CDL program with XPO, I actually got paid during my time in the driving school at the dockworker rate.
So extrapolate 40 hrs/WK at 21+/hr while also using their equipment for 7 weeks and the 10k number suddenly isn't super crazy.

That's all fine, I just don't think the XPO deal is unfair having done it. A guaranteed home daily job with paid training is hard to complain about. They were upfront about the costs so everyone involved knows the deal. They also do the hazmat training to get that endorsement so just another added benefit.

UK trucker here, I’ve seen similar stories where a company pays for an employee to obtain their HGV license and require them to sign a contract stating that if they leave the company within a 2 year period they are legally required to repay the cost, (amount decreases by certain £ every month so, for example, if you left after a year you’d have to pay 50%.) However, to my knowledge this doesn’t apply if they choose to terminate your contract unless you commit serious gross misconduct, that’s how it works in UK but my best advice would be to dig out the contract you signed and find out exactly where you stand legally.

Don’t pay them. It will cost them more to fight you legally. Just move on. Many of these companies threaten truckers with these type of contracts. Only few actually send it to creditors. Even then, who cares. It’ll eventually fall off the way time flies. I have a credit score of a 760 by the way.

There is 100% verbiage in the contract that stipulates the company can recoup the money they paid to put a driver through school/training etc. Source- I work in OPS at XPO.

Law is law, but these companies will do everything they can to get their money. There’s no way a judge will approve their demand for payment or wage garnishment. They’ll try to scare you into collecting payments, but simply don’t. If they fired you, they can’t expect anything.

Ima say this. Inwas under contract with Pam Transport for 2 years. I broke the contract after 4 months for low pay. They sent it to a collections company which then put it on my credit for 7 years. If you dont care about it its no biggie. I never paid 1 cent of the 8000 they wanted after i left the company. Just let it take its toll and keep on trucking.

If he went through xpos training then paying back the money for the training is part of the consequences for not completing that contract. Although I would look at the fine print because I don't feel they should be able to request that money if they are the ones breaching the contract by firing him. Otherwise it's ok do this training that cost us 10k to teach the whole class. Then just fire one and recoup your loses

Its clearly stated in those company sponsored schools that if you quit or get fired with cause during a certain time period then you are liable to pay them for the schooling, that amount being clearly stated in the contract that you signed.

How long ago did you receive the letter? I’m not an expert but that sounds sketchy to get such short notice for payment, that’s scam territory where you try to rush someone into payment. Typically they would give you like 90 days or something

Most companies only require 1 year of service to repay the cost of school, which is typically valued at around $5,000. So 1) 10k is way above a standard charge and 2) the cost should already be paid in full. You really need to contact an attorney regarding this and DO NOT GIVE THEM ANY MONEY. Any payment you give them acknowledges that you agree that it’s a valid debt.

I would check first clauses in your contract and see what it says about getting fired. I would also post whatever it says in the “law” sub and ask them for how sound legally it is. Depending on what you got fired for, and what the folks in the law sub say, I might tell them if they hold me liable, I will sue them in small claims court for the money back. Then get something in writing saying they are forgiving the debt.
Might be worth it to pay an attorney $1k for a consultation and a threatening letter from an attorney to get it cleared then to pay the $10k to release you from the debt. You can ask them that in the law sub too.

You might look into getting your training paid by the state. I live in Ohio and went through Ohio Means Jobs. Granted, I had to get a job using my cdl or pay back the money, but it was a job anywhere . Didn't have to be a specific company

Do not pay. Request reason for termination, an invoice for training and Wait for a proper legit request of payment. They already know you don’t have the funds or the wouldn’t have put you under contract for 2yrs. Collect your contract. Get a copy of the supposed price for the training class from the Training School your progress reports and the reason of non completion. To dispute the claim. Write a letter of dispute against the fees. That’s their problem, they took the risk! It sounds like a scam. They Should have allowed you to complete the training. Unless you clearly obviously failed in every aspect of your training course.

They taught you how to drive and obtain your CDL and obtain Haz-Mat, tanker, and doubles/triples endorsement, with a contract you must drive for them for 2 years to “pay” for the training. You signed a contract. They need drivers yet they fired you, making it impossible for you to fulfill your obligation.

With these "Return of Service" clauses, I was under the impression that if you left, e.g. resigned, then you had to pay. However, if the company chose to end your employment then they were liable for the costs.

Signing a 2 year contract is wild. Hire an attorney and have them read over your contract. I went through swift academy and they wouldn’t hire me after I signed the contract. Never paid them. They sued me and I countersued and the contract I signed is what won me my case. Actually won some money from swift too. Banned from them tho. Contract was poorly written. So maybe hire an attorney and try your luck

I have a common first and last name. Hire Right returned a background check that wasn’t me. I live in Georgia. The background check belonged to a guy a different race currently serving a sentence in TEXAS department of corrections for beating his wife. Swift swore me up and down it was correct but wouldn’t tell me how I’m in Atlanta but supposed to be in prison in Texas and a different race and age. Got sent home on the bus. I appealed the background check with hire right and won the appeal but swift never apologized or tried to make things right so I never paid them over the years and one day I got served with a lawsuit. I lawyered up and won due to the contract having a lot of inconsistencies. Swift ended up having to pay me a settlement. wasn’t large but i was happy to have it and a free cdl. So basically they’ll accept ANYBODY to their schools but getting hired is a separate process. After all that I’m banned from ALL swift owned companies which is cool. Wasn’t looking that way ever again anyway.

Generally, XPO, and similar companies, provide training and only require the pro-rata amount back depending upon the amount of time remaining on your contract (i.e. $5000 tuition, you work 6 months out of the 12 month contract and you will owe $2500. ($5,000/12)*6=$2500 )
That said, it appears that you probably had a $4000 12 month tuition agreement or an $8000 24 month agreement and quit/termed 1 or two months early and now owe $300ish.
Make sure you get the information regarding their claim in writing and either pay it or don’t and possibly face the consequences.

Former XPO driver here. I also did the program like you and it was always known that you'd have to pay back the months left in the contract. So if you only worked a year of your contract, you'd owe $416x12=4992. $416 is the monthly breakdown of 10k. Reading your prior comments though, I'd definitely lawyer up. Fixing airlines isn't a DSR responsibility.

Hmmm could be valid depending on the method. Money order is common in the trucking industry. Slowly but surely getting phased out but when you go to school with a company Knight, Swift, CR England, and in your case XPO, they’ll typically put you in what’s called a Non-Compete.
A Non-Compete is a legally binding contract that they’ll pay for your schooling and hire you on upon graduation or completion of the course. My contract was 1 year with CR England and I left within 3 weeks. They’ll report it to your credit but luckily for me I disputed it on my credit during Covid and get it wiped out completely😁 (don’t recommend this nor nearly impossible now everyone back in the office)
Company schools don’t get talked about how much they rip you off and they’re typically double than a third party school — whole nother conversation. Depending how long you worked there pause there should be a remaining balance not the full 10k unless you were terminated right after completing the course.
Hopefully it wasn’t for safety reasons because it will be tough getting something else with less than 2 years experience and already a termination. If it was for something else, a recruiter may work with you but will ultimately be up to the safety and hiring board (typically the senior guys they run it by)
