Don't Let Goodwin & Co. Ruin Your Neighborhood

If any community is exploring for "the best in community solutions," the LAST company you should consider is Goodwin & Co.! Some 5 or so years ago, in my small home community of 97 Garden homes in East Plano, Texas, called Peachtree Village, where many of our residents are retired and living on fixed incomes, a small group of people illegitimately usurped control of our HOA Board with the direct help of Goodwin & Co., likely because they were way overly concerned about the shifting demographics of our community from a nearly all white population to an even mix of Latino, Asian, Black and white residents. Even though our original HOA documents, specifically, define our HOA as a a NON-PROFIT corporation, Goodwin & Co. came in and assisted several "Boards" since then to shift the entire focus of their duties AWAY from what the same Articles of Incorporation state is the general purpose for creating our HOA in the first place--to take care of our Common Areas (a greenbelt, the private streets our homes are located on, some auxiliary parking, a few sidewalks and some retaining walls), all of which are now in a horrible state of disrepair! Instead of spending the 10s or $1000s the HOA had collected over the years on the real needs of our community, after Goodwin & Co. took over, almost all they did on behalf of the "Board" was to mount a very aggressive and invasive (and most likely, illegal) spying campaign on our private homes in order to generate all sorts of highly subjective allegations of having committed "violations," which were then very selectively enforced, followed up by threatening letters of fines, up to $500.00. Moreover, Goodwin & Co. also charged the accused homeowners an extra $25 per letter, and if not paid by a certain date, late fees on top of that! Of course, Goodwin & Co. not only collected a handsome general service fee each month, but a sizable percentage of each fine they collected! To make matters worse, they began pushing our Board to increase our monthly dues which, had it not been for the fact we had already reached our CCR's maximum, they would have surely done so, even though the majority of our residents are struggling just to make ends meet, as food and utility prices are rising, while they are worrying about whether or not their social security checks are in jeopardy! When some of us homeowners began to realize how Goodwin & Co. was, callously and deliberately, doing all they could to extract from us for every dollar they could, all the while, we've been having to drive around ever-enlarging potholes on the small streets leading to our homes, and organized to call them to account and tried to replace the "Board" they had placed in power, they used OUR HOA funds to mount a vicious, misinformation campaign against our nominees, in order to frighten our neighbors into thinking all hell would break loose unless we re-elected the same people. But just to be sure if that didn't work, of course, Goodwin & Co. conducted the entire board election, including the ballot count, with the name of THEIR chosen "President" printed on the proxies used OUR money to pay for his campaign letter mail outs with all sorts of lies and misinformation about the opposing candidates. Of course, we're doing everything we can to hold them accountable though, so far, Goodwin & Co., who possess all of our HOA records, have blocked us from inspecting them (which is a right, not a privilege, according to Texas Property Code Law), and we need that evidence to present to Law Enforcement whom we hope will, eventually, indict them for their role as accomplices in the manipulation of our HOA and the resulting misappropriation of our funds, just so they can make a profit! It's not clear to us if there are any honest HOA management companies out there who would actually serve the interests of all the PEOPLE who live in a given community, but we have learned from bitter experience Goodwin & Co. is definitely not one of them!

At the end of the day, a lot of it depends on the competency of your board. The board is the one choosing to employ Goodwin and set the tone for what they deem acceptable. You either have to get on the board and fight to have them displaced or get people on there who are smart and aware enough to rein them in

Either get the money together and buy out the HOA spot or get families together and the majority kick the board. Also within your rights. Board doesn't have immunity to the community. This gets scary for them when they see a neighborhood BBQ starting up. Buy a projector, beam it on your likely white garage door, and set up a BBQ. Within a couple weeks you'll probably have what you need to move forward.

Easier said than done. I ran into a guy I went to HS with a few months back who was the realtor selling my neighbours home and he said the house had a 25K premium just because it wasn’t in an HOA neighbourhood.

More than worth it Or pay the 25k to buy out the board spot Or spend 250k and take the majority voting rights(easier than you might think if you have multiple families who agree with you.)

Unfortunately, our HOA also utilizes this company’s services and all this sounds very familiar. Nothing is ever done right. Repairs take forever or are never completed. The repair tickets are closed without any responses. Very frustrating and very costly.

This is because your board is lazy and just calls Goodwin and tells them to send someone instead of doing any leg work. We hire all our own contractors and just have Goodwin pay them once we’re satisfied with the work.

I don’t think our board does any of it. We actually have a Goodwin app and report the issues to them directly. They do all the work. I think it’s time for us to raise some questions.

I’m on our board,the app send messages to the board as well a Goodwin. Goodwin can’t spend your money without the boards approval period! They do have a list of preferred contractors and if you ask Goodwin to send someone they will, this is the laziest most hands off way to do it. At minimum board should be meeting with contractor to discuss expectations of work and final approval.

Why are boards using these companies anyways? I remember back in the day when an HOA was made up of neighborhood members and that was that. If there was a problem, the HOA president or board took it up with the neighbor. The board would allocate funds for certain projects or repairs. If a problem arose outside of the HOA charter, the problem would be discussed at the meetings and neighbors were actively encouraged to help come together to figure out a solution. Certainly HOAs have gotten so far out of hand it's insane, it seems there are a bunch of power hungry people making up boards nowadays, looking for any blades of grass a cm too long, a trash toter left out a day too long, etc. I kinda feel like if you can't run your own neighborhood board or volunteer adequate time, you don't get to be on the board. Or better yet, if nobody is willing to volunteer said time, then all the neighbors need to decide if they even want to keep said HOA and if they want to then they collectively need to determine how to run it themselves.
These management companies shouldn't even be a thing.

The only way to do that is to move out of any incorporated area. If you are in town, you are subject to city code.

I don't live in an HOA. I'm right in the middle of Plano. None of my friends live in an HOA. Living in an HOA neighborhood is insane... imagine paying others to oppress you and stifle your liberty. It's a safe, clean town. There is absolutely NO REASON to live in a gated or heavily regulated community unless you are afraid of everyone and everything. Just no. That is not American!

My HOA uses Goodwin and Co and so far they've been pretty chill. They came in pretty strong, but the board told them to cut it out and that was that. Talk to your board, get involved.

Although I dislike Goodwin for other reasons (I found them incompetent and lazy), almost everything you said is on your board members, not the property management company. The board can choose how aggressive to enforce the rules and how to allocate funds. I lived in a community with Goodwin a few years ago and zero fines were sent out for 2 years (COVID times). The elections and inaccessible records are a problem, though.

Our community had Goodwin and Co as HOA managers and yes they were very trigger happy with violation letters, $25 fine per every certified letter they would send and when called they would absolutely refused to wave it. Our common areas were poorly maintained ie pool etc. they were more concerned with driving around the neighborhood and doling out fines left and right.
One of the hoa meeting I went to Goodwin and Co promised us a new account manager and they would do so much better then the outgoing person. Of course absolutely nothing changed. At that same meeting they told us how our account was swimming in money and yet our dues were just raised by 5%. Our community have since gotten a new HOA management company. The jury is still out
