By virtue of the authority vested in the Secretary of the Department of Homeland Security (Secretary), including the Homeland Security Act of 2002, and delegated to the Director of U.S. Immigration and Customs Enforcement (ICE) in Department of Homeland Security Delegation 7030.2, Delegation of Authority to the Assistant Secretary for U.S. Immigration and Customs Enforcement (Nov. 13, 2004), to enforce United States immigration and customs laws, and subject to my oversight, direction and guidance, I hereby designate the Executive Associate Director for Enforcement and Removal Operations (EAD for ERO) as a customs officer as defined in 19 U.S.C. § 140 I (i) for the following specific purposes: ( 1) as set forth in 19 U.S.C. § 1589a, to: execute and serve any order, warrant, subpoena, summons, or other process issued under the authority of the United States; and make an arrest without a warrant for any offense against the United States committed in the officer's presence or for a felony, cognizable under the laws of the United States, committed outside the officer's presence if the officer has reasonable grounds to believe that the person to be arrested has committed or is committing a felony; and (2) as set forth in 42 U .S.C. § 268(b ), and by virtue of his status as a customs officer, to aid in the enforcement of quarantine rules and regulations as authorized and directed by the Director of the Centers for Disease Control and Prevention of the Department of Health and Human Services. This delegation does not extend to any other authorities afforded to customs officers by statutes or regulations, and the delegated authorities must comply with the requirements of the Purpose Statute, 31 U .S.C. § 130 l (a). The powers, authorities, responsibilities, and functions delegated herein may be re-delegated in writing by the EAD for ERO to appropriate subordinate officials of ICE and may be successively redelegated to other officers or employees of ICE qualified to exercise the authority within ERO. The Authority to re-delegate this authority may not be exercised by any officer or employee below the level of Field Office Director.

Don't forget that they already got a bill passed that allows law enforcement to take guns from "mentally unstable" people, before they actually get diagnosed as mentally unstable, and then they are allowed to keep said guns for 2 weeks while waiting for a judge look at the case and decide if you can have your guns back, or if he is going to order you to pay out of pocket to for a therapist to say you are not mentally unstable (maybe) ... And then you have to wait for the judge to reexamine your case, if they can find the time, and then you will have to file the paperwork with the police to get your guns back.

It's terrifying what they are collecting. My concern is that it's not accurate at all. Both of the hospitals in the mid-size City I live in can't even keep their own records straight half the time, switching records systems? They recently lost some of their data and a lot of it didn't even switch over so a lot of patients are upset.

Ok, it took me a minute to parse some of this and connect the dots. This order basically transfers the statutory authority of a Customs Agent to the acting Executive Associate Director of ICE ERO, Kenneth Genalo, who in turn may re-delegate this authority to others.
This statutory authority also allows broader enforcement actions that do not require judicial oversight.
Customs Agents are generally able to gain entry into/on vessels, vehicles, and real property without the need of a signed warrant (if within the 100 mile border enforcement zone that most people in the US live in). This is basically a document that combines the enforcement abilities of both CBP personnel and ICE ERO agents. Both agents are allowed through statutes to circumvent specific 4th Amendment protections if within a certain geographic zone. Couple that with the access afforded by coordinating with CDC/HHS as an additional enforcement action, this is basically a document that says "Fuck you" to the rule of law, as it allows the EAD of ERO to re-delegate this authority as he sees fit. Below is the bio for the the Executive Associate Director for Enforcement Removal Operations, Kenneth Genalo.
Mr. Genalo Prior to serving as ERO's acting executive associate director, Mr. Genalo served as the ERO New York City field office director. In that role, he maintained operational responsibility for the five boroughs of New York City and Long Island, and seven upstate counties in New York. He also oversaw a workforce of 369 full-time employees and contractors spread between the ERO New York City field office and several satellite offices, and he directed operations at one Intergovernmental Service Agreement facility. Mr. Genalo has held numerous leadership positions within ERO, including the serving as the acting field office director for the ERO El Paso field offices and as the deputy field office director in the New York City and Newark field offices. He’s also served as an assistant field office director, supervisory detention and deportation officer, deportation officer, supervisory senior immigration inspector, senior immigration inspector, immigration inspector and Special Response Team deputy commander.
This is essentially a deputizing action writ large. Back in the late 1770's the prime driving factor in the Declaration of Independence was actually the British Writs of Assistance, which is essentially what this statutory document reinvents. Holy shit licking fuck, someone with a Machiavellian bent did some real thinking on how to get shit done. I'm almost impressed with how slick that is.

Customs Agents can enter "private land" within 25 miles of the border zone, but may not enter a private residence without a warrant or consent. Hard and fast rule. If a homeowner says fuck off, they are required to come back with a warrant. Plain and simple.
It depends on the use case for the delegated authority, the place or thing being searched. ICE ERO operates under self-assigned warrants that ostensibly name the target of the warrant but from what I can find the agents have detained people not on the warrant during round-up operations, but only in public areas. For instance, a hospital may employee undocumented people that work behind the scenes in areas or places that the general public cannot gain ready access to. If an ICE ERO agent asks for permission from someone who "controls access to the area" to gain entry into the area the person asked can deny them. If the agent is denied access they SHOULD NOT attempt to force their way into the area, but in reality they most likely would attempt to bully that person for access. I've been working on getting this information out to people but it's tough.
Customs agents have broad statutory authority to search cars, buses, trains, boats, and in some cases real property (if in public purview like a bus or train station, but not somewhere the general public is not allowed free access) if within the 100 mile border zone. This authority does not require a signed warrant, only reasonable suspicion/probable cause for the search or seizure. Customs agents are only allowed to ask about certain immigration questions, but in doing so they are trained to elicit information about a whole lot of other things.
Safety at this point is just an illusion. The chances of this escalating are nearly certain.

No, this order isn't about appropriations. The next committee meeting on appropriations for DHS is scheduled for may 20th. There was several rounds of budget terminations and redirects from HHS but that data is pretty hard to get on short notice. It is all controlled by the OMB, which is now firmly controlled by Russel Vought, who makes getting data out real difficult. I think you mentioning Maggie Hassan, she is a ranking member of the Homeland committee. She is really sharp, knows her shit, and isn't easily intimidated. She came to a talk I gave a few years ago about Critical Infrastructure resiliency. She asked good questions, and was able to ask a few I threw back to her.

It's not a law per say, it's an addendum to established CFR. The CFR is basically the "rulebook" for how the govt "does law" and an agency (in this case DHS) writes the addendum and it is then filed. Some require public comment periods, some are regulatory only, and some are enforcement actions. It is normally not used to assfuck the rule of law bloody but this isn't normal times.

I missed the second question. An order like this one does not require any preceding step. Executive agencies are given carte blanche to write their rules under the CFR assuming that the order itself is supported by previous statutes. There are some limits to it however, because agencies are either regulatory by nature, or are enforcement by nature. If a regulatory agency tried to enforce something it would be illegal. Usually enforcement agencies don't write regulatory actions, but under this administration the rules were changed via the OMB to allow it.

Realistically there isn't. You can thank DOGE for that. Under normal circumstances the Office of Information and Regulatory Affairs could enact an halt on the adoption of the order. The OIRA was deleted/dissolved and it's statuatory authorities were absorbed under the Office of Management and Budget (OMB). The OMB is now headed by Russel Vought.
I commented somewhere else about how elegantly they played this coup. It was very well done. Very methodical, deliberate, and lasting. It's real bad.

Customs officials at the airport can arrest people without a warrant because for example if they find someone smuggling guns, there isn't time to draw up a warrant.

Following up on my concern about the expansion of powers delegated to ERO officers (see linked post).
If you combine this with the Executive Order Project Homecoming directing the hiring of 20,000 DHS officers (translating to an increase in ERO officers). What you have if a massive enforcement agency that can
(1) arrest with no warrants,
(2) based on "reasonable suspicious", and not just for immigration offenses.
(3) all through all the USA, not just point of entry,
(4) by deputized "other individuals"?
What can a reasonable law-abiding citizen do about this massive and unlimited power-grab?

It is a new method for ERO agents to be given more flexibility in arresting people. An ICE ERO action actually doesn't require a signed warrant from a judge, just internal review by an ICE agent. They were previously limited to arresting only those on the signed not-warrant, now if they suspect someone has committed, is committing, or about to commit a felony they have statutory authority to detain/arrest that person. Also, it gives blanket authority to enforce CDC/HHS quarantine protocols, which actually already existed in some form but this allows the detaining individuals under the guise of public health. (My comment about RFK is pure conjecture as I am not that up to date on CDC/HHS current enforcement actionability.)

The difference was that it was under Homeland Security, technically under TSA, but Health could only be used during a crisis such as COVID or a bio attack.
Now all they need is to claim someone appears sick or got an infected paper cut on their medical records to say well know you're detained. Side note these are all administrative warrants as such no judge.
It is a MASSIVE POWER GRAB.

Historically CDC was restrained by public health emergency declarations. I will have to look back into previous outbreaks but I do recall that several people were medically quarantined at Port of entry during the ebola outbreak in 2013/2014. I think CBP caught the patients at entry based on travel visas and entry documents. That medical screening is pretty standard tho, difference now is that public health declarations and pandemic tracking have been gutted and enforcement has shifted to ICE rather than CBP, which are both part of HSI umbrella orgs.

So, "customs officers" had these powers only at "point of entry" / border crossings like 1. arrest with no warrant, 2. enforce quarantines, 3. other things mentioned in the long text :-)
Now, the ERO officers, can have these "custom officer" powers (no warrant arrests/enforce quarantines/other) in all the USA, not just the points of entry? (if delegated by their superiors)

My take, our crappy gov’t issued (Chinese as it happens) COVID vents hit EOL and we bought and just received 2 new Draegers. Thankfully PO done and paid for early in the year so no increased tariffs. Could be same elsewhere or hospitals anticipating this + price increases and getting ahead of inflation. Draeger makes their vents on demand so there’s no stockpile anywhere in the US as far as I know, but you would know better possibly.
