Who's at fault

As I was preparing to back my rig into my spot, I noticed a pickup driving past in front of me, about 400 feet away, which didn’t seem like a problem. However, I didn't realize that the pickup had made a U-turn and was now driving behind my Rig as I was backing up. Fortunately, I was regularly checking my mirrors and caught sight of the pickup just inches away from my DOT bumper. If the pickup had been hit, who would have been at fault?

This. The driver is always at fault unless it is deemed to be un-preventable. If the truck was behind you and parked, you would be running into a stationary object. The professional driver is supposed to be aware of everything around them, especially while performing a backing maneuver. That's part of the reason this job sucks sometimes.

If you had your hazards on and were backing up at the time, 4 wheeler would of been at fault. It’s common sense to never drive behind a semi backing up.

Nope, you hit it while backing you’re at fault. If the area is open to the public you need a spotter and even then it is still the driver’s responsibility to back the vehicle safely and without damaging another vehicle.

Prob be ruled preventable, because our system doesn’t have much common sense.
I had this exact scenario happen, only it was a contractor pulling a trailer. Zoomed behind me at an angle during a backup.
Fortunately, he knew it was his bad, damage was not terrible on an already banged up trailer, and so we shook hands and called it a day.
But in most cases, backing will be considered preventable.

To my knowledge, DOT doesn't look at accidents as at-fault/not at fault when it comes to CMVs; it's preventable or non-preventable. As much as I hate to say it, you'd have a hard time proving that an accident like that was not preventable.

Depends on the state. If both vehicles are moving, the person who didn’t fallow the right-of-way is at fault. How far back from the spot were you when you say him? It sounds like her would be at fault if you were already moving.

It would be his fault. They never seem to want to wait 20 seconds for us to back up. Same with other trucks that speed through truck stops.
