I think that their choice of spikes was a very poor one. They should have been more like a bulb out. Or a four sided butt plug if you want to think of it like that, so the spikes don't plug the hole they make. That one should have been retested and the results voided.

Possession and manufacture of caltrops is illegal in California. I don't remember the episode, did they go out of state for that one?
Regardless, "proper" caltrops are made out of thick wall tubing, rather than solid rods. And a hole is drilled in each of the two tubes near the joint where they are welded together. It's not actually legal to do something illegal with the police just because they say it's ok, though less likely that the DA would bother with it.
