Yes you would, I've seen it happen . It's dishonesty, potentially to gain a financial advantage. It might be problematic if it's not evenly applied but it is absolutely something that can get you dismissed, potentially summarily

Yes. Dishonesty, (and lying about being sick is definitely dishonest) is definitely something you cam be disciplined for, and could be classed as gross misconduct - especially if you get paid sick leave as that means you are getting a financial benefit by lying. Where I work, there's only been one occasion in the last 15 years where someone was dismissed for gross misconduct and that was why. And bear in mind that it isn't a criminal/ legal trial, they don't have to prove beyond reasonable doubt that you lied, they just have to have a fair process and a *reasonable belief* you did. And yes. It will be very obvious. Your best bet is probably to see if you can find a colleague willing to swap or take the extra shift, and go back to your manager with that.

I think OP is more asking how could they prove it? I.e. how could their employer prove they *weren’t* sick in order to discipline/sack them? I agree that it’s obvious and probably a bad idea, but it’s not impossible that someone could be struck by a horrific vomiting bug on a day that they’d happened to request off.

They have asked for time off and they haven’t had an answer back. An employer absolutely has to give a response back to denied leave. Secondly an employee who denies leave, let alone one that denies leave without informing you is an absolutely shit employer to work for. Then it’s just down to OP as to wether they want to tolerate that BS.

They might ask for a sick note or something to prove you were actually unwell. If you're on probation, this may very well put a black mark against you. If you're past probation, you may be pulled up for it and face disciplinary. To what extent they'll throw the book at you depends how long you've worked there, general conduct and any history of sickness/non-attendance. Personally I wouldn't risk it, but if this was planned months ago then why did you not try to book this time off prior?

To be honest it depends on your job. Where I work, I know lots of people who have requested a day off, had it denied, tried and failed to find cover and then just failed to show up for work. They'd get a stern warning really.

Worked with a woman years ago who asked for time off to be in the audience of a big tv show. Got denied the time off, called in sick anyway. Got hauled into a disciplinary meeting and then denied she was at the show until her boss then showed her the footage of her in the audience. She then bleated on about being bullied for being pretty or something and got sacked anyway. So yeah you can get sacked for that kind of thing.

If you have worked there for less than 2 years then they can sack you, you can be let go for any reason within the first 2 years as long as it's not discriminatory. If you have been there more than 2 years then you have more protections, but if they believe you are lying about being ill then many employers will let you go but it will likely depend on previous record and the management.
