Correct. Basically the only alcoholic beverages on a CMV that's on duty must be a shipment/cargo area.
No stopping at the store and grabbing one on the way to parking it. I'm not sure but I think it might be acceptable while your parked overnight but basically only while you're at the truck stop. It should be discarded before going back on duty.
No alcohol within 4 hours before going back on duty and you should never go on duty with any alcohol at all still in your system.

I used to go up to northern Wisconsin a lot and they had beer up there that I couldn't get in Tennessee. I would buy two or three cases, wrap them in big black garbage bags and put them in my side box behind everything else. Never had a problem but also never got inspected that way.

Note that none of this is legal advisory or council, as I am not a lawyer. I am though someone who looked deeply into the individual cases I could find when I got my CDL.
I wish it weren’t the case, but federally (DOT) we aren’t allowed to have alcohol at all in the truck, even in the sleeper. Technically, not even supposed to drink if we are sleeping in the truck that night either. If a cop just so happens to witness you drinking before entry, bringing alcohol into the truck, or simply leaving a bar and going back to your truck; they now now have reasonable suspicion to detain you for an investigation and possibly arrest you.
Thankfully, most officers are not so uptight that we can still be full OTR and enjoy a drink on our 34. They do have the legal right to stop you if they witness it, or if it is reported to them.
If you are on duty, or pulled over/in for inspection while on duty, you are a commercial driver that cannot refuse questions. This stands even waiting for a lawyer.
If you are off duty, and have no intention of returning to duty until your break is completed, you do retain your rights as someone of civilian nature, to a degree. Our intoxication tests are still commercially regulated, and we can technically be made to park for 24 hours.
Note that entering the driver side of the cab while intoxicated can be immediately considered DUI by the police. To mitigate this risk, entering through the passenger side, even though they can still detain you, will not allow them to stamp it immediately as DUI. If they do so, it can be battled out in court and better argued there was no intent to drive while intoxicated.
In your sleeper, it has been legally defined as a driver’s home (not extension of). If the curtains are closed, with nothing visibly/audibly wrong between both cab and sleeper, then they are not legally allowed to open the sleeper compartment. Doing so without stating probable cause can lead to a department and officer(s) being investigated and sued for invasion of a home owner’s rights.
Legally, there is still a lot of grey areas. Such as state extensions of an officer’s power, and if you do open a case where your legal protections as a driver have been violated, there’s a chance you enter the forefront of a state’s overreach investigation, increasing the length of your case by a couple years.

The only thing I would note is this mainly applies to OOs. Company drivers have a 99.9% chance that you’d be breaking company policy having any alcohol in the truck regardless if it’s under PC. If anyone were to want to use their truck to pick up beer on the way home you want to make 100% sure all your bases are covered. You have to be eligible to use PC, you have to have a receipt to prove that you purchased the alcohol outside of working hours and that you haven't been on the drive line or on-duty line since purchasing the alcohol. It's just better to avoid it at all.

So that's not actually how the legal burden of proof works. Their burden of proof is to prove that the driver had alcohol in your truck and that they were operating the vehicle at the same time. Since the driver wouldn't be denying those facts the burden does fall on the driver to prove that they were in compliance with the exception.
Since the state only has to prove beyond a reasonable doubt that a law was broken anytime you're appealing to a legal exception to a law the legal burden of proof falls to you as the defendant to prove that the exception applies to you.

A good rule of thumb if you want to drink is to do so on your home time. If you're on a 34 and will absolutely complete your 34 a trip to the bar should be relatively safe as well. I add a rule that I will not drink anytime I have to drive any vehicle; if I go to the bar/club or if I go to a drinking party I take an Uber.

That's also not true; when you're in a personal vehicle the legal limit is the same for CDL holders and non CDL holders. BAC limits are based on the vehicle classification not on the license held by the driver, but officers are significantly less likely to be lenient to CDL holders especially for DUIs. Also it's especially not worth the risk because the consequences of a DUI are higher for a driver than they are for other professions because our license is our meal ticket.

I think it's important to understand the law especially when it comes to how the law intersects with your profession. I try and make it a point to understand the consequences of as many hypothetical actions as possible even if I would never take an action.
When it comes to the way exceptions to laws work I applied legal principles I learned when learning how self defense laws function in preparation for getting a handgun. The way legal limit laws work is just something I learned when getting my CDL.
One important thing to keep in mind is while vehicle classifications are standard across the US the definition of commercial vehicle is not. Some states include pickup trucks with company logos that are used for commercial endeavors in that list so even if you're driving one of those for personal use state laws around commercial vehicles may apply.
One thing I will reiterate is as a driver your license is how you make your money. Drunk driving is probably the most common and most easily avoidable way drivers lose their job, and drunk driving in a personal vehicle will impact your career. Best practice is to avoid mixing alcohol and all vehicles.

Depends on where you are parked and if you are drinking or not. Where you park can determine if you are in control of the vehicle or not. For example, if you park in a parking spot at a truck stop you're fine but on the side of the road, not so much. If you are in control of the vehicle or a cop and judge might agree that you are, you can't drink it all.

You can have alcohol in the truck while not on duty or driving and you can drink as long as you aren't in control of the vehicle, your blood alcohol will be zero before you drive, and you won't be driving for at least 4 hours. You cannot process alcohol while on duty or driving.

You can drink in your break in the sleeper, granting you follow the law around consumption, duty status, and when you resume driving.
You'll need to remove all empties and un-drunk bottles, even sealed ones, from the truck before taking off too.
The law says you can't carry it, but you can drink, just need to return to duty sober no less than 8 hours later.
Most companies have a no go at all policy for it.

I hate that they’re using Sober to mean “not drunk or drinking at this very moment”. Being a Sober person myself, it means never drinking and never, ever being drunk again, period. And there’s a world of difference between the two, even if the term is still accurate enough for a headline. That means no alcohol at all in the truck, I would never think to even transport closed/unopened beer into my truck while on duty for future off duty time. There is simply way too much assessed risk.

No. We(truck drivers) are in a federally regulated job where the 4th Amendment doesn't apply(United States v. Salcido Gonzalez). Which is why we get ticketed for not stopping at scale houses for inspections. And in California(I'm sure every other state has their own version) it can be considered a misdemeanor for not stopping

You already know it's going to be an issue though. I'm all for descheduling. However, these companies don't want to take on even more liability, and law enforce doesn't want to deal with even more fuck ups because someone was driving way above their threshold.
Pretty much the same as alcohol, which is why you can still be randomly pulled for a breathalyzer while on duty.
I'd love to see it legal. There are more reasons for them not to than perceived benefits in the eyes of FMCSA though.

Has nothing to do with need and everything to do with being treated like a fucking adult capable of making adult decisions. A grown as man should be allowed to have the option of having an adult beverage when he is not working.
I rarely drink. And spend much more time in the office and shop than I do driving. But when I do drive, if I want to order a margaritas with the fajitas for dinner its no ones business except mine. And there is nothing wrong with it.

I remember I used to take a couple beers with me when I worked at a farm where both ends of my route had me on site. It's like a little village, those guys were my family, so I liked to have good time at the end of the week. I'm also paranoid though so I kept them up in the wiring for the sleeper cabin lights 😂
Warm, yes. Stupid, yeah. Not paying $40 for a trip to the liquor store to buy $10 of beer on my reset was a strong motivator.
Funny thing is, and I wasn't the first driver in the truck, when I decided on my stash spot I found a Bible with a social security card in it that was 100% not the guy who job I took over for!

While legal, I know a guy who knocks a minimum of 3 to 4 beers back every night before hitting the bunk. He wasn't on duty during, of course, but this is like borderline alcoholism in my opinion. Hopefully he gets help.
