Is my manager allowed to make me pay for drive offs at work?

so yeah I work at a petrol station and my manager is trying to make me pay for a £63 drive off? not sure if this is the right place to ask but I’m wondering if this is even legal? he’s a COMOP commission based manager so there’s not many people above him in the chain of command. I feel like he’s just going to deduct it from my wages. I feel kinda helpless lol can anyone offer advice?

I was a Texaco manager back in the early 2000's in Kent. No, he cannot make you pay for drive-offs. It's illegal to hold your wages because of criminal activity you had no part in. £63 isn't even a lot of petrol these days in some stations. Back in my day, it was a fucktonne of money, with the typical drive off filling up a water butt or industrial plastic container in the back of a van. If you can afford to lose the job (and petrol stations are always advertising for staff), inform him you will be taking this to tribunal if he witholds your wages. Petrol stations always prosecute drive-offs and will get their money back from the registered keeper of the vehicle. It doesn't matter what the internal policy is, or what document you may or may not have signed to say this is ok, you cannot legally agree to something illegal, which makes any such policy moot.

He said he’s deducting my wages and he will refund me until the police refund him. We have to report NMOP in our group chat as soon as they happen, so I was on my phone reporting it when the drive off happened so he’s claiming it’s my fault!

No, that's not the way it works. Deductions like this are illegal - he cannot do it, regardless of what he says. If he makes a deduction, he is opening himself up to a huge tribunal claim, and HMRC scrutiny if any such deduction takes you under minimum wage for that shift.

Deducting the money from my shift compared to nmw would leave me with £27 a shift where I should be getting £96 a shift so yeah it’s definitely under nmw. I get paid tomorrow so I guess I’ll see wether it’s time to take it further

TBH at this stage you just have to consider leaving. Even if your paycheck comes out that you are still making NMW for the hours you've worked with the deduction, this isn't the only time this is going to come up. There are two options: 1. What he does is legal and therefor he will keep doing this every single time somebody drives off. 2. What he does is illegal which means he is an employer who tries to break the law in order to save money. He will continue to break laws you are unaware of existing. And your rights as an employee will continually be violated, even if you are unaware of it. There is no way to ensure your boss is doing everything by the book. Way too much happens behind the scenes that you don't have access too. So if you notice laws being violated at your detriment chances are they are doing the same thing behind closed doors, either because they don't understand the laws/your rights or because they do but don't care as long as you don't realise and there are no consequences. Either way you can't work for someone who you can't ensure is doing the bare minimum they owe you for your work.

HR aren't your friend, they are the company, and going to the authorities about the company is not how to make friends with them, and their boss can make their life miserable. Time to update your CV OP. You don't kick off about it before you've found one. You don't tell them you're going to kick off. You don't mention it to your colleagues. You just quietly find another job and then kick off about it at the same time you tell them you're leaving.

Yeah the issue with these types of things is that it's like catching your friend trying to steal from you. You can catch them in the moment, call them out and tell them off. But chances are they will attempt to do so again. And you can keep an eye on them. But chances are if they see an opportunity they will take it. So if you hang around with them long enough, it is likely they will steal from you again. Keeping a vigilant eye on them will deter them. But it is no guarantee. And it certainly isn't a solution. Best thing you can do for yourself is not hang out with that friend in order to cut off their opportunities.

If he does, demand an explanation for the deduction in writing. Give him 24 hours to give this to you. Hopefully he will be enough of a moron to provide it. When he does, hang him out to dry with it. Don't allow him to tell you you can't have it in writing. Make a scene about it if he refuses. This is an illegal deduction, plain and simple. It doesn't matter, as I said above, if you agreed to it or not. Legally you are incapable of giving consent to an illegal act, even if you sign to say it's ok.

Absolutely correct. I recently won a tribunal in another NMW case (but won't give any more details as they are appealing). The judge was scathing and added a multiplier to our losses. And if this is the same srilankan petrol station owner I worked for, I won a tribunal against him too, although that wasn't a NMW case.

I used to work in a petrol station. The CCTV was basically rubbish, it didn't get a clear image of cars at the front so cars at the back or motorbikes we had no chance. The policy was to write down registration numbers before authorising fuel but in reality you cannot do that, serve customers and do stock.

When I worked at a Texaco 15 years ago, we had eight pumps and a few cameras and for whatever reason, there was no camera on Pump 8. So it’s definitely possible, you just need to know the petrol station..

Our shop gets a lot of robberies tbh for a small petrol station and a LOT of drive offs. I live in Birmingham so you can imagine. But there wasn’t really a consequence until our new manager came in, he makes us report everything instantly. The police prolly sick of us lmao

The only way any employer can take a deduction from an employee is if they pay a bonus and deduct from that. It is illegal to take any money from an employees wages for anything like losses or damages. An employee can always volunteer payment for something that is their fault but I would always recommend against that in normal circumstances.

No, it's legal under certain circumstances. One of these circumstances is if it's written into the employee's contract. https://www.acas.org.uk/deductions-from-pay-and-wages However, even if it's written into the contract, deductions for lost stock (which is effectively what this is) cannot amount to more than 10% of the employee's gross pay.

If taken all at once? Maybe, but probably not. OP is on £12 an hour at 20 years old, which means so long as he's worked 19 hours across his current pay period, the deduction will keep them above minimum. OP seems to be working 8 hour shifts, so thats only 3 shifts. It'd be more likely to go over the 10% threshold, but even then, OP needs to only work 53 hours for it to be under 10% of their wage, unlikely if OP is being paid weekly for sure, but entirely possible if OP is being paid every two weeks, or very doable if OP is being paid monthly. But even then, if OP did drop below minimum from the deduction being taken all at once, if it's in the contract that such deductions can be taken, it could be split between multiple wages. Again.. all assuming that this is definitely clarified in OPs contract. IF it is not, then it is an entirely moot point. Deductions of this nature need to be explicitely spelled out in the contract to be legal.

There's a world of difference between an unexplained till / stock shortfall and customer theft unless the employer can prove the employee was an accessory to the theft. How long have you worked there? Bear in mind if it is under 2 years you can be dismissed without them giving a reason. As such it might be better letting them make the illegal deduction then if they fire you after you can claim automatic unfair dismissal. You have even stronger protection if the deduction takes you below min wage.

Problem is, the correct escalation is to first raise a formal grievance with the company. Until you've done that you're not likely to get anywhere legally. Also, the phrase 'escalate to the appropriate authorities' rather than explicitly naming who you'll go to next just makes you look like you don't know what you're talking about. We were basically told we had to write registration numbers down, due to having bad CCTV. If you had a registration number and a crime reference number, there was no disciplinary. But it was basically impossible to write down every registration number and do everything else.

It wouldn't just be considered against the shift, it'd be against the whole wage packet it's deducted from. E.g. if NMW is £1000 per month, and you earn £1025, they could deduct up to £25 per month without getting into trouble for it, but to deduct £26 would get them into trouble. In the first instance you need to check your contact to see if there is a clause allowing the employer to recoup losses from you - there may well be. It would've been over the space of 12 months which in my town is actually quite infrequently ( rough area especially at the time) this was about 5-6 years ago minimum But it was a home bargains in my local town centre ( before they moved to a bigger premises) The problem is our town doesn't have a police station natively ( or a hospital) so unless there happens to be 1-2 cop patrolling the town/ coming from another call out by chance they will have to come from a town 20 mins away So you can't stall them if you tried cus they will be long gone If they did stab you it's the same 20 mins drive at least for an ambulance to appear So there's literally nothing you can do except keep calm empty the till, and hope that the town security have been alerted so they can try and catch them on every CCTV camera they might pass

The results show that, firstly, the GMB union has expressed an opinion on the matter and it could be in your interest to consider joining them in case of future problems with your 'Jack the lad' manager. Secondly, I've skimmed the (old) Google Groups entry and get the impression that, depending on your contract, it might be legitimate for your employer to dock a certain proportion of your pay. Again: get some advice from the knowledgeable and experienced Citizens Advice. Keep your contract of employment handy and be prepared for a bit of a delay before they answer. Good luck!

Mileage claims are expenses, not wages, and therefore not subject to tax or national insurance. If you're paid below the HMRC approved rate for mileage, you can make a claim for the tax element on the difference. In the scenario, you should be paid for all 12 hours if paid hourly, or if salaried then it should even put across the hours - I did stock auditing years ago where they would regularly put is on two sites per day with a fair travel distance for 3 weeks, then final week of the month was single sites with less travelling so that our average hours meant no overtime claims (this was salaried) The mileage claim is completely outside of payroll and PAYE unless it's paid above the approved rates

It's very rare that this is ever legal even if contracts allow for it, especially if this puts you under the national minimum wage. You can contact ACAS and the employment tribunal about unlawful deductions from your wages, and HMRC if you're being paid below NMW. Bear in mind that if you've worked for less than two years continuously the manager can just dismiss you for no reason, so be prepared for that. If the deduction goes ahead and they rob you of £63. Go in on the following shift, take £63 worth of goods, walk straight back out, go home and turn your phone off for a day or two. Plod won't show up for a stolen Range Rover recorded during daylight with clearly identifiable suspects with file pics all captured on 1080 quality CCTV, they won't trouble you for three boxes of Mars Bars. What's the protocol for drive offs? Did you follow it? I don't see how you could possibly stop someone from driving off with a tankful of fuel. So there could be a procedure to follow after such an incident e.g press this button, followed by that button, and fill in a form (witness statement). I don't see why you should have to pay...unless you didn't follow the protocol.

I was an attendant at a couple of different petrol station sites (with the same franchise owner) during my time at Uni The first time I had a drive off, I was still being trained by another attendant. I terrified we were going to have to pay for the loss. my colleague told me - in quite graphic language - not to be so silly, That's the owners problem and How were we supposed to stop them anyway. You must have procedures for this sort of thing. \[If not, that's the owners fault, right there\] you follow all the procedures, to the best of your ability and training..... and that's the end of your responsibility
