Eh? I'm pretty sure Congress writes laws and the courts decide what is and is not an official act using those laws Congress has already written. I think that Congress would only get involved via impeachment, or by rewriting the law to make something an official act.

The caveat to the supreme courts immunity ruling is that the president is only immune if the issue is brought to the supreme Court and they declare that specific action was. Ergo the conservative supreme Court would not give Biden immunity and would give trump all the immunity. It's a nice cozy checkmate for them and we're kinda fucked.

Funny that exact scenario was brought up in oral arguments and Trumps attorney argued that if it was an official act immunity applied. The court agreed. The current administration just would have to call them enemies of the state for colluding with foreign powers and the commander in chief could order the strike.
