Shooting at a drone is against federal law, even the officer says this. 18 U.S.C. § 32 makes it illegal to intentionally damage, destroy, or disable an aircraft. This includes shooting down a drone with a firearm, crossbow, pellet gun, or by throwing rocks, The penalties for shooting down a drone include a fine of up to $250,000 and imprisonment for up to 20 years. Depending on the state, it can also be a state crime..

We live in a DFW suburb and have had delivery from Walmart for maybe 2 years. It's through Wing. Kids love getting candy delivered by a drone.
View on Reddit #37096794

autobot12349876@reddit

How much does it cost for delivery? I’m also in dfw but still can’t get drone delivery even though I’m less than 5 miles away
View on Reddit #37101066

Pythias1@reddit

They recently (2 months ago, I think) migrated from the Wing App to the Walmart app, and since then I haven't ordered once. It was buried under multiple menus in the Walmart app, not quick or easy like the Wing App had been. With the wing App I'm 100% sure it was just the in-store price with no delivery fee at all. We abused that like you wouldn't believe. Anything we could get droned, we would. I'm sure they were doing it cheap for the same reasons lots of startups charge unprofitable prices at first. I just found it in the Walmart app again, and it looks like they're charging an absolutely stupid delivery fee now. $20. The page says ..."flown to you in 30 minutes for $19.99", and then shows all the stuff you can order. Certainly looks like a $20 delivery fee. Also, 30 minutes is crap too. It used to be about 10. 7-8 minutes to load the drone and then a timer starts when it takes off. Takes two minutes to get here after liftoff. Now I'm a little salty. I was hoping this would catch on with a small delivery fee and the very fast delivery. With this price and a 30 minute wait, it's doomed.
View on Reddit #37105829

autobot12349876@reddit

Thank you for your input. Yeh I don’t see how drone shipping can be profitable for low cost items. Even if it is an emergency I’d rather drive than pay $20 shipping for $5 worth of groceries. Plus it’s just ripe for kids to abuse the hell out of it 😄

Pythias1@reddit

It's pretty cool, tbh. They zoom over the neighborhood all day and you can kinda hear them, but it's not intrusive. Very load when they get lower right above you to make the delivery though. They hover at maybe 50ft and lower the package to the ground on a cable, and even at that height you're getting loads of wind in your face. They have a weight limit greater than 28oz, because you can order a 28oz can of tomatoes. The limit seems to be close to 48oz, because when you go above that you're guaranteed two drones! When family come to visit with more kids, we order like 10 pints of ice cream and they'll send that in 4 drones usually. They conga-line in a pretty neat way. When you queue up multiple loads.

He doesn't have to deny it. Once they mirandize him, he could say something like, I'd like to consult an attorney to better understand this situation first. You can be cordial with the officers while not answering questions.
View on Reddit #37096780

IusedToButNowIdont@reddit

True. But I don't see what a lawyer advice would be besides be apologetic and declare yourself guilty. In this case, the fact he did it immediately without council will probably help him to the eyes of the judge/prosecutor. Even the cop praised him. It helped on my eyes. Leniency is the only thing that can help him.
View on Reddit #37097978

astonishingmonkey@reddit

This idea is so so so so wrong. The court and the prosecutor cannot punish or look unfavorably upon a person invoking their constitutional RIGHTS to counsel or silence during a criminal investigation. (Consult a lawyer in your area if you have questions about this.) I’m a lawyer (not yours. And, again, see above.) But, I may or may not have been a prosecutor and may or may not know criminal defense attorneys. Yes, invoking your rights to counsel and silence may lead to an arrest on suspicion of crime… but… notice how this guy gave up all this info and… STILL GOT ARRESTED on suspicion of a crime lol. The mindset in the comment above puts people in very bad situations probably 10-1 as it helps them. (Not a real stat, just generalizing.) Again, I’m not your lawyer. Consult with attorneys in your jurisdiction—but, know your rights and safely, respectfully insist they be respected.
View on Reddit #37098876

airwx@reddit

Are you sure you are replying to the right person? I said you can request a lawyer nicely and the cops won't care, as in, the cops will continue to treat you the same whether you invoke your rights or not, they just won't question you if you do invoke your rights. Then you can talk to your lawyer about ramifications and possible plea agreements.

View on Reddit #37100627

It doesn't look bad on you to just say you want to speak to a lawyer to get an understanding of things, the cops truly don't mind as long as you are cooperative and there isn't any information they need right at that moment. Once you talk to a lawyer, you can still give your full story to the prosecutor up front and likely get a deal or leniency. The prosecutor will still see that you were cooperative with the officers and not being evasive.
View on Reddit #37098271

IusedToButNowIdont@reddit

I'm not saying it would look bad. I'm just saying his honesty didn't disclose nothing they didn't know already, so he gain those points and didn't lost much. In any other case, I agree he should talk to a lawyer first.
View on Reddit #37098546

airwx@reddit

I get what you are saying. I guess I just feel it's best to consult an attorney first to know all possible ramifications of confessing and possibly accepting a plea deal for a confession. I just don't think there is a big difference in your , I don't know, 'compliance level', for lack of a better term, if you confess to the officer or the prosecutor, but only the prosecutor can offer you deals.
View on Reddit #37098869

sablerock7@reddit

You don’t need your rights to be read in order to stfu. They can use statements against you before Miranda. The cops need to prove the case , you not talking doesn’t make you presumed guilty. Of course, don’t shoot drones.

That said, I do kind of feel for the guy. Yes, shooting at the drone is reckless and dangerous. View on Reddit #37099321

He needed to shut up from the very first second he came outside. In fact, his wife needed to shut up. “Is your husband home?” “Can I take a message for him and have him get back to you?” I’d even venture as far as to say if you discharge a firearm illegally outside your home it might be worth going to stay with your kid for a couple days so you aren’t home when they come knocking and have a little warning to get that lawyer.

Police are very good at making people feel like they’re talking their way out of something while they’re actually making it worse. Like that whole thing about how long it took to walk in the house, unlock the safe, get the gun, walk back outside to say can you believe how long that drone was loitering when in actuality he’s describing his intent and how many chances he had to reconsider his actions before shooting.

What a POS. He probably considers himself a responsible gun owner who even uses a safe and then turns around to discharge a firearm in the air in a residential area. That’s reckless. Was he afraid for his life? Nope. He suspected it was a neighbor getting some footage to share online or a grad party present. Better get the gun! Then while he stupidly talked and incriminated himself the entire time he finally ends up in hand cuffs. He went peacefully without resisting and as such the cops were naturally gentle with him and he jokes “I can’t breathe”. Just because this guy was the right color and had the right batch of cops to handle him doesn’t mean others will get the same treatment. Police brutality is real as white privilege. On a side note from my prospective the cops seemed very professional and in this case don’t seem to fit in to the ACAB stereotype. To me it sounded like the laugh followed by a uggh/sigh after his joke put a bad taste even in their mouth. The guy cuffing didn’t look amused. I can only imagine how it felt to actively get support from some reckless moron with a gun while you’re just trying to take him to jail.

Was there a notice put out to residents of drones now flying over doing drop offs? A drone above your house and you have no reason why it's there could be a very scary situation same as somebody trying to break into your house.
View on Reddit #37098194

Familiar-Secretary25@reddit

If you’re that scared of a drone then call the police and report it. There is NEVER a good reason to shoot into the air.

Stepping out to talk to the cop. = First mistake Reading of Miranda Rights = STFU Swore Statement = You're in a butt ton of trouble You see more cops and, a Detective is now on scene. = Straight to Jail at 16mins "I'm going to have to find a real good defense lawyer." = You cooked, too late Honesty is not the best policy!! CALL A LAWYER Note: I'm not saying what he did was cool, not at all. Shooting at a drone with a real gun is dumb and reckless... but my gawd give your defense attorney something to work with!

Maybe I’m as dumb as this guy, but doesn’t the Castle Doctrine give him some leeway here? Given his age, maybe he genuinely had no idea what that thing was flying above his house, on his property. Doesn’t he have a right to defend his property? Say he did know it was a drone. With all these tech advancements, and what drones can be used for (espionage, spotters), I could genuinely see somebody being afraid of a drone on their property and thinking lethal force is reasonable. Does this drones have Walmart markings on them? Is it made expressly clear that they are delivering packages? Is this murky territory that we haven’t figured out yet?

But WAS it over his property? By husband own testimony he was near the back of his house, looking over his roofline toward the front. Chances are it was delivering a package to a house across the street and he just THOUGHT it was closer.

Fly4Foodcali@reddit

Castle Doctrine, is a big fat nope! At no point was he in any danger. There's a big difference from being outside your home and an intruder breaking into your home. The only leeway given will be for his brutal honesty, and if no one died then it will probably be a Fine and some community service.

This is what we call “privilege”. The cops know that they’re there for a jackass who fires a weapon into the air in a neighboring without regard for where the round will land, and they let him put his hands in and out of his pockets, behind his back, allow him to hustle off behind the house. If this was anything other than an old rich white guy, I’m afraid this would have gone very differently, especially the moment he put his hand in his pocket. Thankfully no one was murdered by police *or* by this reckless boomer.

There is exactly one circumstance in which you can lawfully discharge a firearm in a residential neighborhood: to prevent imminent physical bodily injury or death to yourself or another. That is it. That. Is. It. Shooting at a drone is… not it.

Good. These people need to get over the idea they can just shoot down a drone cause they don’t like it. They are aircraft, and the FAA will treat them as such. Good way to end up in Destination Fucked.

Geez. I had gained some sympathy for him figuring he’s just genuinely dumb and ignorant of the severity of shooting at things in the air. But then he goes with the “I can’t breathe” mocking at the end and I think he must just genuinely be a terrible human being. Regardless of your politics clearly someone being suffocated to death is a tragedy and doesn’t deserve to be mocked.

I had some sympathy for him, old guy who probably doesn’t fully appreciate modern technology, got a bit spooked by a drone buzzing round his house and is being honest with the police - to his detriment. But that all disappeared when he made the ‘I can’t breathe, I can’t breathe’ comment (at 19.35s).
