ULPT Request: Can I keep my damaged phone after I get sent a replacement?

Due to a manufacturer defect, I'm getting sent a replacement for my new phone I bought recently. I've been instructed to return the damaged phone once the new one arrives, but is there anything stopping me from keeping the old one too? Is there anything they can do if I don't return it? The "damaged" phone is still in usable condition and I'm thinking I could sell it or keep it as a back up.

If it's an iPhone Apple will just remotely brick it like they do when display models get stolen.
If it's an android you just need a way for the parcel or its contents to be lost in transit.

They’ll blacklist the device. Depending on the phone it could be as little as it not connecting to the cell networks, or being stuck on an Activation Lock Screen.
Also they’d bill you, or send it to your credit report.
Just all around a pointless idea.

Send it back in whatever their pre paid stuff/box is (if not, then easier)
Cut open the sellotape or similar holding box together, and put something similar weighty In there (wear gloves for this is paranoid)
They will assume it has been stolen in transit. It depends what service as some will be harder/more traceable. But if just normal post, then it happens. You have proof of postage, they have item stolen in transit.
The issue with phones is that they could potentially track it or it could go on a list if you sold it the future etc idk.

99% no you cant keep it, especially if its a manufacturing defect. They will want it back so they can inspect it and likely refurbish it for secondary sale.

Check and see what the rules are. Had mine replaced and they wanted the old one or I would be charged full price for the phone.
