The company I work for MTI is shutting down tomorrow. They gave their 480 drivers + staff zero notice or severance. We were notified via EMAIL yesterday.

Absolutely insane. It sucks because I actually had an absolutely sweet route, schedule, good pay, and management largely left me alone without micromanaging.
Just blows my mind that companies want two weeks notice when you leave, but will delete their entire staff via email with no notice.
They knew this was coming, they knew they were in a financial hole, and kept everyone in the dark. I know drivers that have worked for MTI FOR TWENTY FREAKING YEARS. Look after yourself guys, don’t hold loyalty to any company.
If anyone knows of some decent pay local routes in the Tampa Bay Area, please let me know. Thanks.

If a company (even if closed) doesn’t respond to a lawsuit or appear in court, it usually results in a default judgment. This means the plaintiffs get whatever they’re asking for.
Lots of laws written about this but you have a duration of time to attempt a non-judicial settlement before proceeding to court.
The courts don’t really care about your company’s cash flow as much as they care about if the debt is real and the plaintiff can prove this with the preponderance of the evidence. Finding the defendant owes the money is step one, step 2 is more difficult when the company doesn’t exist (but it is still possible to collect). If the company is in bankruptcy, it’s actually fairly easy to add yourself as a creditor. If not going through bankruptcy then you could go after the last accounts billable or any liquidation process, but you better move fast because they are probably already expecting someone to ask for money.

There are more protections for business owners to be kept separate from the company than there are for the worker getting fired. Yea they're expecting to pay out. They're expecting to settle with banks, creditors and ir investors who get priority.
Good luck spending 5 years in court with a company that's been dead and moneyless for those years. It's almost never worth it.

Since you didn’t read my comment, I’ll say it a different way. Taking someone to civil court is two steps: judgement and collections. The collections is the harder part, and you aren’t guaranteed to get anything.
That being said, just because it’s hard doesn’t mean you shouldn’t try. I think you have to weigh your options, but it’s not like suing someone is expensive. Usually it costs less than $100 to file, and the courts will usually throw that in the damages so you get reimbursed if you win.
As far as creditors getting priority, you’ve never been to bankruptcy court and it shows. The smaller you are, the more likely you are to get exactly what you ask for in a bankruptcy hearing. It is truly unlike anything else in our society, and everyone should sit through one just to learn how it works.
Again, five years in court? Maybe if you’re trying to get millions but anything under $10k (really under $50k depending on your state) is likely to be six months to a year, and that is probably two or three court hearings. Judges hate it if the other side stonewalls the court and they will just issue default judgement after the second or third no show.
Anyways, I don’t know about you but if someone owes me $10k I’m definitely suing their asses and I don’t feel bad about it.

And finally no you do not get priority. The creditors are first, as in banks because their credit is secured by companies assets.. Then investors/ equity interest and ur at the very bottom.

there are loopholes and I'm sure their lawyers crossed those Ts or they know they will not have to pay up most likley. Company is dissolved and there are more protections to keep buainess owners separate from the business. The owners of that business have more protections from you suing them than you do for getting fired without notice. Ppl almost never find out they are fired. Some of my coworkers came from yellow. They owe one guy 20k and another guy over 40k.
If the company went bankrupt, the company has no money to pay you and our legal system is set up to have companies as essentially separate entities from the owners. So, nothing the company does can affect the owners legally. Basically, a class action lawsuit (which mostly lawyers make money in these suits, the victims get next to nothing usually) would essentially just be suing a dead person for their nonexistent assets.

Unfortunately there are loopholes for them. I used to work in the tech industry and this happens all the time. Literally every year there are last second closures. I know one loophole is as easy as keeping people on payroll, maybe paying a small severance package. People win warn act cases all the time but rarely with bigger companies. They probably had lawyers cross their Ts. I used to have to find a new job every 3 to 5 years working in tech and every time it was 100s of ppl getting fired out of the blue.

One of the main defenses to WARN Act stuff is when the company shuts down. Once you’re done, you’re done. If & when they go into bankruptcy, the bankruptcy court will treat anything from WARN as a general unsecured creditor. Among the lowest priority for repayment preferences.

When I first started driving (too many years ago) my hubby and I drove for Arrow trucking. They were a flatbed company.
Our driver manager came to us one day, and told us we needed to get out. He had the feeling something bad was coming. So, we moved companies.
Two months later, Arrow closed. No notice to anyone. The phones just got turned off, and the doors locked. There were drivers all over the country stranded under loads. Drivers were selling off tarps, chains, straps, and anything not nailed down to get the money to get home. All of the major carriers instructed their drivers to give a ride to any stranded Arrow driver they came across. It was a mess.
It sucks your company is going under. But, at least, they did the right thing and notified you.

Playing devils advocate here. I'm not OK with this as its happened to me more than once. just saying why they do this. They do this because they want you to work up until the last minute. If they announced they are closing, the company would no longer function. People would start leaving, maybe critical people, they would not be able to replace these workers. And they do this to avoid any potential issues. They found out the least hassle free way (for the company) is to lay someone off at the last minute.
When I got played off they had all the management standing in the front entrance and as people came in they either told you to go to the room on the right, or to your left. Everyone who got fired went to the room on the left. Shitty part is some ppl used a different entrance and went straight to their desk to work. then the management had to go around and find these people and tell them to go home cause they just got fired.
So yea they do this all the time with no warning and it sucks cause because now u have 500 people flooding the job market looking for the same kind of job....hope it works out for u man

Hub shut down their Birmingham terminal with absolutely no warning. The next closest terminal was in the next state over. Hub is predominantly local intermodal. 200 people can't just move 8 hours away, so yeah... It was a mass layoff.

With a contract like that. At leas it was consistent. There weren’t enough penalties to bankrupt operations. So it has to narrow down to greed. Either somebody is taking too much money? Or they will shutdown, take the money, & not pay anything out. While diverting the 30/60/90 day billing to another account. That could make somebody very rich. I do t know if the equipment is owned or leased? These large companies that go tits up. Don’t close up because thy are broke. They close because profits aren’t what they were expecting. There are ups and downs. The people running the company aren’t the same ones who started it. There is nothing personal for them. It’s all about big money for them. They don’t care for anybody else.

My FSA is always underwater from week 1 - meaning I'm making the max allowed contribution, but spending more than the max each week. So by August, I've used up my FSA funds, though I'm paying off the overage each week.
If I were to leave the company, I'd owe the balance out of my final check. Without a final check, I think I'd owe the balance to the FSA administrator. If I got screwed out of my final check like these guys, though, I suspect the FSA admin would have to wait a while.

It's cake. You're home every day, making 0.815cpm, and you just need to have all of your endorsements.
New guys are put in the "systems," basically a wild board, but it goes by quickly. It's not OTR, only regional stuff. You drive in a straight line, switch trailers with a meet guy, or build a set at a terminal and come home.
80% of routes are home daily. You gotta drive night (but less traffic) There are inside facing cameras, but they only get on you for your following distance. All of the drivers make 100-120k per/yr depending on the route.

It's gonna start happening more and more in the next year or so. Freight rates are shit, companies aren't producing near as many products as they were, people aren't spending extra money right now, which means even less consumer goods, we are in a recession and it's hurting trucking bad. There are far too many trucking companies still around from the covid boost that should have never even existed that are nothing but throat cut rate takers that should go out of business. It sucks. Reminds me of when Arrow trucking shut down. No warning, no notice, just one day fully operational, the next, bankrupt and closed. Stranded all of their drivers all over the country, most of whom were loaded. I still don't think they found all of the missing loads from that ordeal.

That’s how I lost my last trucking job, told on Friday last day would be Monday. Had me drive my truck to Florida, and that was it, I don’t live in Florida. That fucking sucks. I work for a solid regional car hauling company in Naples, a few hrs south of Tampa, we do high end cars like lambos and whatnot. Home every weekend, 1k dollar weekly minimum guarantee but usually quite a bit more than that plus tips. Not quite what you asked for 😆 but figured I'd mention it, a few of the guys I work with commute from Miami and homosassa every week, so you wouldn't be the only guy driving in

Fellow former MTI driver here. Was laid off at the end of May because MTI didn’t renew my routes contract with the post office. My Dad also worked for them and we agreed the writing was on the wall that it was only a matter of time before they went under.
The company went way downhill after the company was sold a year or two ago. Was happy to get out when I did. But feel bad for those this happened too.

I’m actually not sure. The terminal I worked out of didn’t have anything other than local runs, but our terminal only accounted for like 30% of all our drivers.
I called a twenty year veteran yesterday(nicest old dude in his 70’s) to see if he knew any details about what was happening. He was on vacation, and was completely blindsided by what was going on. I was the first to tell him…

It's possible they didn't know. They could have lost a major bid for postal service and can no longer function. It happens. Find out who is taking over service in your area. Go work for them. You may even get your route back.

Lol where Im at would be 99% because I write shit up like a bad transmission and it doesn't get fixed despite me saying that left turns can kill someone because the truck is stuck in 1st gear or goes into neutral in the middle of a turn.
I had just got yelled at for driving the truck on slicks with no tread because they never changed out my tires before despite me writing it up for a full week or tow including circling it and writing in caps lock.

401k accounts are always safe. If the company’s plan with somebody provide shuts down, the money in the account owner’s account can and should be rolled into another 401k or I think you can roll it to a Roth account too.
