I’m on workers comp for the next few months because of a car accident. Do you think DOT could still drug test me while on injury leave?

I got into an accident a couple months ago. Wasn’t my fault, but I hurt my neck upon impact. I want to smoke weed to try and help with the pain. Do you think I could still be drug tested, even though I’m on injury leave? I do have to go into the dispatch office at least once a week to check on with my boss. Do you think it’d still be okay to smoke weed when I am not even on the road?

Yes they can test you and if smoking weed is that important to you, please surrender your CDL. You do not need to be on the road.

Bro, yes.... PRESCRIPTION drugs are legal and don't cause you to lose your CDL. There is also a difference between medical marijuana and street marijuana that you clearly don't understand. They are not the same.

I told my doc I didn’t want any narcotics. I have been using a strong prescription NSAID since the accident, but I still have problems with inflammation. I used to have a medical marijuana card when I had a different condition that caused pain (prior to getting CDL) and now my doctor says go for it if marijuana has worked in the past for pain management. I don’t think my current boss would drug test me. I work at a small & local company, and my boss only drug tests when DOT requires it. I just found out today that since I am not driving at all, I am not in the DOT pool for drug testing. So I guess I got my question answered.

I could argue with you on this all day. You haven't tried enough drugs to know what you are talking about, the hardest drugs I've ever tried came from a pharmacy, I don't remember what the hell happened after taking those pills (not to mention the instant addiction I faced). Also medical marijuana is usually stronger than the street stuff. No I don't think OP should risk his CDL for some weed, but I don't think weed should risk a CDL either, especially when truckers can drink and do painkillers.

You can smoke weed when you downgrade your cdl. Until then no it's not okay and you are risking your livelihood.
