Got a lady teacher friend who’s on her well earned foreign holidays at a place renowned for its toplessness. I jokingly commented about it and she informed she would not be partaking as ‘she didn’t want to lose her job.’
Is this real? Can a school sack you for this?

All the teachers I know either don't have social media accounts or if they do, have the account name that isn't identifiable as being them.
This avoids the risk of any inappropriate pictures being seen by their colleagues or pupils.

About 15 years ago when I was in secondary school, in the early days of social media, we found our French teacher’s MySpace page, and found a photo of him passed out drunk with ‘c**t’ written in his head. We all had a lot more respect for him after that image was shared around.

I have friends who are lawyers and accountants fairly senior potions and they have safe for work social media (because everybody is expected to have a presence) and their real one where they're less concerned to be seen in indiscreet behaviour. I always find this stuff so odd. She’s not at the beach in a work capacity. Her job is one part of her life, she is her own person living her life and has hobbies and interests. Your job isn’t your whole life and personality. Wtf does it have to with Johnny’s mum if she wants to go topless, on a beach, in her own damn time? She’s hardly running a drug cartel outside of school hours, she’s tanning her baps. There’s always such a double standard. One minute boobs are natural and we shouldn’t sexualise them and tell women to cover up when they’re breastfeeding as it’s a natural part of life. I know someone who was a part time teacher, and she had met a friend for lunch and had an alcohol free beer. A parent saw her and complained. The teacher got a verbal warning, and all of the part time teachers were told that being seen drinking anything that could look alcoholic on their days off would be a disciplinary offence. This was also the school that gave all part time teachers "trapped time" lI did 2.5 days, but it was spread over 6 days with unpaid hours interspersed with paid time. They openly disliked part timers, as evidenced by the first story.

My mum was a piano teacher and I used to dread her running into someone she knew at the supermarket or in town when I was with her - which nearly always happened. Because she loved to stop and talk and talk.. and talk. Soooo many people knew her - old pupils who had grown up and old parents of pupils. It seemed everyone knew her and wanted to catch up and share all the gossip and oh my gosh I could never go anywhere with her without her running into someone. Legally, you can take a picture of anyone in public, but would sharing a topless picture of someone and sharing it with the intent to embarras them change that? Still be difficult to fire someone for acting perfectly legally when in their own time but wouldn't be much fun for them staying at that school.

Technically yes, but public indecency is still a thing. That’s why nudists and naturists tend to stick to designated areas.
Sure you have to prove it was intended to be distressing but 99% of the time if you’re in public, you’re expected to be clothed.
Not that any of this is relevant to OPs post. I was stating that it’s weird for someone to approach their kids teacher at the beach if they are nude. Because that’s inappropriate on the parents behalf. The teacher isn’t doing anything wrong. The parent by taking them to the beach isn’t doing anything wrong. But the parent actively choosing to engage past maybe an acknowledgment (a nod or wave) is because that’s putting the teacher in a very uncomfortable position.

Some student being one of the crowd, who takes a sneaky photo and then shares it around the school, well that's different (despite it being ridiculous unfair). Now there are rumours that she posed for it, or had a holiday romance with the kid etc and obviously such pictures would attract a lot of interest by teens looking to take her down a peg and parents who are "concerned" etc.
Then before long it is causing so much disruption and hassle and someone starts to question the judgement (or morality) of the teacher and how fit they are to teach as a role model. All based on half truths and presumption more than anything else.

Teachers have a lot of influence over kids and need to have the confidence of all the parents (of every flavour) and like it or not a good portion of them would be insanely judgemental of topless unbathing, sex work, being on a fetish website and 101 other things. Anything assocaited with being "an adult" that isn't entirely "middle class & wholesome" is likely to give a lot of them "the ick".
Given that reality, the problems that come from not bowing to that pressure are very real and can be significantly disruptive. Given that, anyone giving them ammunition is seen as a problem and these things are even written into teacher codes of conduct etc.
Oh 100%, but they'll deflect that with "kids will be kids, you should have known better or we'll give little Jonny detention for 2 hours, and then destroy your career too". Its a useless defence even though it shouldn't be.
It wouldn't be so bad if being a teacher came with a very strong salary, widespread respect and great conditions etc, you know the things that usually come with having to make such severe lifestyle compromises.

That’s a tricky area though. The expectation of privacy doesn’t just mean “physical” privacy (I.E. not being seen); it can also be situational, even an adult in a genuinely public place who is distressed is entitled to not have images of that state shared (think of someone who’s been in a car accident, or upset because they’ve had a breakup, that sort of thing).
IANAL but would argue that there is effectively a “what goes on tour stays on tour” situation here and although they’re content to be seen by other people in the same location, that doesn’t imply they consent to it being shared in any other situation.

There is always that worry in your head that you’ll hear a “hey miss” anywhere in the world! You're talking about how you think it should work rather than how it actually does work, which is what OP is interested in. In reality, yes, if a school becomes aware of topless pictures online or anywhere a pupil could see them (whether the teacher has posted them herself or not), she's losing her job. She will simply be unable to do her job or maintain discipline in class if the students are passing round topless photos of her and sniggering behind her back. That's the reality, whether you think it's fair or not.

No. You can certainly be sacked for doing something lawful in your private life which reflects on the school/teaching - eg there was a teacher barred last week for offering escort services and posting nudes on social media where her face couldn't be seen but there was enough to identify her.
However, topless sunbathing almost certainly wouldn't be enough because it's lawful here, not widely seen as immoral or otherwise wrong, and perhaps most importantly, trying to impose such a standard, when no one would try to regulate a male teacher in this way would be directly sexually discriminatory.
In fact, I suspect that (provided they weren't posting pics online) even full nudism would be OK. This probably wouldn't constitute sexual discrimination - because you can be an equal opportunity anti-nudist, but because there's a strong argument that naturism, for some people at least, meets the Grainger criteria for a philosophical belief.

It is not a criminal offence to take pictures of someone in a public place. There is an entire profession in doing exactly this for newspapers.
There is a case for saying there is an expectation of privacy on the topless beach. However, the teenagers aren't going to go check what's legal. If they do it, the damage is done, and they might get in trouble, but the picture would have been released already.

It’s not so much about legality as it is about breaching terms of employment, and anything that could cause reputational damage to the school or business that employs you can be seen as misconduct or even gross misconduct depending on how it’s defined in the behaviour policy. It’s totally legal to wear a t shirt with a cannabis leaf of it. But do it in the armed forces and you can risk being kicked out.

A teacher in the UK was recently banned from teaching at any school for having a personal x rated twitter account. The account didn't reference that he was a teacher and broke no laws but was found to break the professions code of conduct.
So I guess, yes, your friend could be sacked in the unlikely event that anyone ever found out.

It really just depends but they drill 'professional behaviour at all times' into you during training. I wouldn't go out and get drunk in the same town I teach in, for example. People saying you can't be fired for something you do outside of work, this is just not true for teaching.
I've heard of more than one teacher having the unfortunate experience of being away on holiday and finding out they're sharing a resort with a pupil and their family.

The example they gave was a teacher being photographed with a tray of beers, for them and their friends, all only having one each. Sacked for promoting binge drinking.

Please remind your friend to use PLENTY of sunblock and reapply frequently if she does go topless. The skin over breast tissue is extremely susceptible to burning and skin cancer, also to premature wrinkling and premature age spots. As the breasts are usually covered they have less melanin to protect them from UV radiation than arm or hand skin hence may burn far more quickly than she expects.

While no rules would be broken in this scenario, if there's a clause in the contract surrounding "reputational damages" sunbathing topless could come under this. After all it takes is a nosy parent to photograph and complain or for a sneaky student taking a picture and showing people at school for reputational damage to occur.
It's harsh but such can and does happen. When you're in a job that is a position of authority and responsibility you do need to be careful in all honesty.

This happens in quite a few professions, actually. While certain things in Amsterdam are legal, police officers/NHS/prison staff etc can be fired for doing the legal things there because they follow the rules for our country.

If your job in the UK does random drug tests you can also be fired for smoking weed on a holiday in Amsterdam aswell, as it can remain in your system for like 2 months after you’ve smoked it. So you could smoke a spliff in Amsterdam in January, come back to the UK and then not touch it whatsoever in February or March, and then fail a drug test at work on the 30th March and get fired for “having drugs in your system” lol. It’s not legal in Amsterdam either, if you’re in about cannabis. It’s just not criminalised but they could arrest anyone for weed/hash out there. The stores have a 500g in store maximum limit that they’re allowed to hold at one time. Which obviously leads to them having to restock at least once a day so they have to walk/drive across the city with up to half a kilo of hash/flower. It’s all illegal but they use their common sense with cannabis use, they know it isn’t physically addictive and having controlled access and usage areas is better than not having them. And it works. Even with tourists doing it. But never be under the illusion it’s legal in Holland. 18+ yrs old use of cannabis isn’t a criminal offence. It’s been decriminalised since 1976 and they did something in 2003 I think around growing at home. You can have 5 plants to grow. I’m not sure if there’s a weight limit tied to that but if there isn’t you could get a very nice amount for 3-4mnths til next Harvest.

At a Junior school near me, they had a young female teaching assistant around 20; she had bright green hair always wore a very short skirt and low top. Most places have a code of conduct which expects you to conduct yourself decently, in and out of work as you’re a reflection of their business etc. So, if for example you work at a school and during your time off, you’re pictured doing something “nefarious” such as being topless at a beach and it somehow goes viral. The reputation at the school you work at may not be seen in a good light, as most parents would not want their child being taught by someone whose tata’s has been seen by them and their child.

NAL but I think it is a lot more nuanced for teachers as they have their own regulatory board (TRA) to which they are responsible alongside their individual employer.
For example, if a teacher had a relationship with a child under 18 who did not attend their place of employment (i.e. a child who went to a different school), this would be activity outside of work.
However, this activity would hopefully lead to the teacher being 'struck off' the teaching register by the TRA which would then require their employer to fire them.
Obviously, this is a much more extreme scenario than being topless on a beach on holiday but it demonstrates the concept.

I doubt it. I think if she was spotted by some busybody parent it might cause a bit of a stir, but I can't see many people getting very upset about it. Apropos, very many years ago I ran into one of my male primary-school teachers at a nudist beach.

usually there would be things in the contract about not damaging the schools reputation.
however exactly how this plays out would be an it depends situation.
If someone posted the photos and tagged her social media with them she is probably okayish, unless she has her school listed on that social media. if she indicates her employeer then thats a different matter as she is associating her private conduct with her work.
thing is just because it would be theoretically difficult to fire someone for this doesn't mean they wouldn't find a different excuse. or just not renew a contract

I know the police will try and sack you if you smoke weed on holiday in a place that it’s legal to do so but that’s not really the same thing.
