My workplace wants another driver to pay 10,000$ for repairs. We are regular employees. What should I do? Do you guys have any legal advice?

They stuck a guy in a truck that has been known for having problems. Then conducted a farce of an investigation with their own mechanics. I haven’t driven since because I no longer believe that they will help us with any tickets. So I’ve been rejecting any truck and trailer combination that isn’t DOT compliant. I also found out that they’ve been pressuring drivers who get tickets to leave for years.

Depends on a lot of factors. If he caused the damages due to negligence then they could legitamately make him pay for the repairs AND can deduct from his wages BUT cannot go below federal minimum wage...even though drivers are exempt, they are not exempt from the rules regarding withholding
GoodGoodGoody@reddit
Negative.
Even in Trump’s zero worker protection America employers cannot legally deduct losses from wages. Would Republicans like to change that, oh yeah, but for now at least no dice.
They can terminate you or try to sue you but that’s it.
tributarybattles@reddit
No that's not true. Go be a Reddit Lord somewhere else.
GoodGoodGoody@reddit
Show me a United State where it’s legal.
Even in deepest red Mississippi and Alabama employers cannot legally deduct loses or damage from wages.
Go be wrong and outraged somewhere else.
tributarybattles@reddit
Reddit Lord I am talking about you inserting your politics into this particular thing. Trucking is about trucking not about your personal Trump derangement syndrome.

Buuuuull sheeet
First words of your comment, “That’s not true.”
Wroooong
It’s very much true that employers can’t legally deduct damages or loses from wages. You have zero clue what you’re talking about.
Equally true: It’s surprising Trump hasn’t changed that yet because he’s rolled back every other worker and consumer protection.
Like I said, take your outrage somewhxervelse.

What country is this?
FinzClortho@reddit
The company is responsible for company expenses. They do not get to offload risk onto employees. The company gets the reward by assuming all risk, they are responsible to pay repairs caused by drivers they took the risk to hire.
Exact-Leadership-521@reddit
I signed papers at the start of this job agreeing to pay for repairs and told him that paper would never leave his office and if he likes a folder or lies in the drawer next to his desk then hang on to it
mistman23@reddit
Is this W2 or 1099?
Exact-Leadership-521@reddit
Says w2 and I seen 1 statement but he didn't pay the full amount or on time and I'll show need to show him a pindrop of the location and say come get it and he'll pay me $1000 lol but I got a log book ticket again so nobody decent will hire me and that's ok. I'll get more log book tickets in the future cause I can
HowlingWolven@reddit
If the contract signed included a clause making drivers responsible, the only thing to do is to lawyer up. As a W2, it shouldn’t be your responsibility to pay for the truck.
If he’s a 1099 leasing the truck, that’s a whole different story.
YamStreet2972@reddit
Can you expand on that because I ended up with a ticket before I was coherence into going IC and was wondering if they were to offer legal help.
pstbltit85@reddit
State Labor Board
YamStreet2972@reddit
So if a company hires you on, and you get a ticket while in training, are they suppose to offer legal help with it?
mistman23@reddit
Employment or STAA Attorney depending on exact circumstances as well.
Redsoxdragon@reddit
Reach out to a labor attorney and contact your states labor board.
If you are not 1099 workers, charging employees for repair of company equipment is illegal.
Vanstrucker2222@reddit
I know a guy who works for Steven’s transport. He was a regular driver. Damaged some equipment and they made him pay. That’s illegal right? They legit took money out of his check for the damages he caused.

Thank you 💯

Is this a W2 or 1099 situation?
AntonChentel@reddit
Labor attorneys work on contingency: this means you pay nothing until you win, then they take like 40-55% of the settlement.
possibly_lost45@reddit
Who the fuck leaves for years. What kind of backwoods Russian company are you working for? Dude leave. Go find a better job.
OsBaculum@reddit
I think they meant the company's been pressuring drivers for years.
